Kao i prije pet godina, postupak protiv hrvatskih nogometaša Luke Modrića i Dejana Lovrena zbog davanja lažnoga iskaza na suđenju Zdravku Mamiću, i ovoga puta će se voditi pred Općinskim kaznenim sudom u Zagrebu.

Odlučio je tako Visoki kazneni sud prihvaćajući prijedlog koji su Modrić i Lovren podnijeli tražeći promjenu nadležnosti suda, a nakon što je osječko Općinsko tužiteljstvo ove godine "ponovilo" dizanje optužnica protiv Modrića i Lovrena pred Općinskim sudom u Osijeku.

Prije pet godina, isto tužiteljstvo je bilo podignulo gotovo identične optužnice protiv obojice, te su nakon što je tada Vrhovni sud prebacio nadležnost u Zagreb, zagrebački Općinski kazneni te zagrebački Županijski sud odbacili optužnice protiv obojice smatrajući između ostaloga kako je za ocjenu istinitosti njihovih iskaza na suđenju Zdravku Mamiću preuranjeno, budući tada još nije bila donesena presuda protiv Mamića, te sud nije u zaključku naveo kako smatra da su Modrićev i Lovrenov iskaz lažni, piše Jutarnji list.

Međutim, sada je, kao što je poznato, presuda protiv Mamića pravomoćna te je državno odvjetništvo zaključilo kako ima argumente za podizanje novih, identičnih optužnica. Štoviše, između ostaloga pozivaju se na navode Vrhovnoga suda koji je u presudi Mamićima naveo kako činjenica da je postupak protiv Modrića i Lovrena ranije obustavljen ne znači i da su oni oslobođeni za to djelo, već su sudovi zaključili kako je bilo preuranjeno govoriti o njihovoj krivnji.

No, obrana sada dvojice nogometaša, za koje tužitelji traže bezuvjetnu kaznu po godinu dana zatvora, sada tvrdi kako se postupak protiv Modrića i Lovrena ne može jednostavno ponoviti budući bi se radilo o kršenju načela da se nekome dva puta sudi za istu stvar. Uskoro će se vidjeti hoće li pak postupak završiti s istim ishodom kao i ranije ili ne.

Kao i prije pet godina, postupak protiv hrvatskih nogometaša Luke Modrića i Dejana Lovrena zbog davanja lažnoga iskaza na suđenju Zdravku Mamiću, i ovoga puta će se voditi pred Općinskim kaznenim sudom u Zagrebu.

Odlučio je tako Visoki kazneni sud prihvaćajući prijedlog koji su Modrić i Lovren podnijeli tražeći promjenu nadležnosti suda, a nakon što je osječko Općinsko tužiteljstvo ove godine "ponovilo" dizanje optužnica protiv Modrića i Lovrena pred Općinskim sudom u Osijeku.

Prije pet godina, isto tužiteljstvo je bilo podignulo gotovo identične optužnice protiv obojice, te su nakon što je tada Vrhovni sud prebacio nadležnost u Zagreb, zagrebački Općinski kazneni te zagrebački Županijski sud odbacili optužnice protiv obojice smatrajući između ostaloga kako je za ocjenu istinitosti njihovih iskaza na suđenju Zdravku Mamiću preuranjeno, budući tada još nije bila donesena presuda protiv Mamića, te sud nije u zaključku naveo kako smatra da su Modrićev i Lovrenov iskaz lažni, piše Jutarnji list.

Međutim, sada je, kao što je poznato, presuda protiv Mamića pravomoćna te je državno odvjetništvo zaključilo kako ima argumente za podizanje novih, identičnih optužnica. Štoviše, između ostaloga pozivaju se na navode Vrhovnoga suda koji je u presudi Mamićima naveo kako činjenica da je postupak protiv Modrića i Lovrena ranije obustavljen ne znači i da su oni oslobođeni za to djelo, već su sudovi zaključili kako je bilo preuranjeno govoriti o njihovoj krivnji.

No, obrana sada dvojice nogometaša, za koje tužitelji traže bezuvjetnu kaznu po godinu dana zatvora, sada tvrdi kako se postupak protiv Modrića i Lovrena ne može jednostavno ponoviti budući bi se radilo o kršenju načela da se nekome dva puta sudi za istu stvar. Uskoro će se vidjeti hoće li pak postupak završiti s istim ishodom kao i ranije ili ne.
