Kaznenog zakona, te protiv dvoje državljana Republike Hrvatske (1980. i 1982.) zbog počinjenja kaznenih djela pomaganja u počinjenju kaznenog djela prijevare iz čl. 236. st. 2. u svezi sa st. 1. i u svezi sa čl. 38. i krivotvorenja isprave iz čl. 278. st. 1., a sve u svezi sa čl. 51. KZ-a. (7. 8. 2020.)

Okrivljenicima se stavlja na teret da su od 7. veljače 2018. do 9. svibnja 2018. u Dubrovniku, s ciljem da se prvookrivljenik (1952.) nepripadno okoristi u većem iznosu, počinili navedena kaznena djela.

Prvookrivljenika se tereti da je zaposleniku matičnog ureda neistinito predočio kako je on na temelju usmene oporuke jedini nasljednik pokojne državljanke Republike Hrvatske (1927.) te je u prilog svojih tvrdnji dostavio neistinite izjave drugookrivljenice (1980.) i trećeokrivljenika (1982.) u kojima su oni svjesno neistinito naveli da su svjedočili usmenoj oporuci pokojnice kojom ona ostavlja prvookrivljeniku svu svoju imovinu i ušteđevinu, a sve kako bi prvookrivljenik stekao nepripadnu imovinsku korist u većem iznosu.

Prvookrivljenik je potom 9. svibnja 2018., tijekom ostavinskog postupka koji se vodio kod javnog bilježnika, nakon što je prethodno pribavio neautentičnu vlastoručnu oporuku pokojnice u kojoj je neistinito navedeno da ona njemu ostavlja svu svoju imovinu; u nakani da se tom oporukom posluži kao pravom i da dovede u zabludu javnog bilježnika; priložio tu oporuku tijekom ostavinske rasprave. Javni bilježnik je, ne posumnjavši u autentičnost te oporuke, istog dana proglasio oporuku valjanom, a potom 12. prosinca 2018. na temelju te oporuke donio rješenje o nasljeđivanju kojim je prvookrivljenik proglašen jedinim nasljednikom nekretnina i novčanih sredstava koje čine ostavinu pokojnice, kao i točno neutvrđenog iznosa potraživanja prema zavodu za mirovinsko osiguranje na temelju neisplaćene mirovine.

Navedeno rješenje provedeno je i u zemljišnim knjigama.
Prvookrivljenika se tereti da se nepripadno okoristio u točno neutvrđenom iznosu, a svakako većem od 60.000,00 kuna, za koji je oštetio zakonsku nasljednicu pokojnice. protiv državljanina Republike Hrvatske (1952.) zbog počinjenja kaznenih djela prijevare iz čl. 236. st. 2. u svezi sa st. 1. i krivotvorenja isprave iz čl. 278. st. 1., a sve u svezi s čl. 51. Kaznenog zakona, te protiv dvoje državljana Republike Hrvatske (1980. i 1982.) zbog počinjenja kaznenih djela pomaganja u počinjenju kaznenog djela prijevare iz čl. 236. st. 2. u svezi sa st. 1. i u svezi sa čl. 38. i krivotvorenja isprave iz čl. 278. st. 1., a sve u svezi sa čl. 51. KZ-a. (7. 8. 2020.)

Okrivljenicima se stavlja na teret da su od 7. veljače 2018. do 9. svibnja 2018. u Dubrovniku, s ciljem da se prvookrivljenik (1952.) nepripadno okoristi u većem iznosu, počinili navedena kaznena djela.

Prvookrivljenika se tereti da je zaposleniku matičnog ureda neistinito predočio kako je on na temelju usmene oporuke jedini nasljednik pokojne državljanke Republike Hrvatske (1927.) te je u prilog svojih tvrdnji dostavio neistinite izjave drugookrivljenice (1980.) i trećeokrivljenika (1982.) u kojima su oni svjesno neistinito naveli da su svjedočili usmenoj oporuci pokojnice kojom ona ostavlja prvookrivljeniku svu svoju imovinu i ušteđevinu, a sve kako bi prvookrivljenik stekao nepripadnu imovinsku korist u većem iznosu.

Prvookrivljenik je potom 9. svibnja 2018., tijekom ostavinskog postupka koji se vodio kod javnog bilježnika, nakon što je prethodno pribavio neautentičnu vlastoručnu oporuku pokojnice u kojoj je neistinito navedeno da ona njemu ostavlja svu svoju imovinu; u nakani da se tom oporukom posluži kao pravom i da dovede u zabludu javnog bilježnika; priložio tu oporuku tijekom ostavinske rasprave. Javni bilježnik je, ne posumnjavši u autentičnost te oporuke, istog dana proglasio oporuku valjanom, a potom 12. prosinca 2018. na temelju te oporuke donio rješenje o nasljeđivanju kojim je prvookrivljenik proglašen jedinim nasljednikom nekretnina i novčanih sredstava koje čine ostavinu pokojnice, kao i točno neutvrđenog iznosa potraživanja prema zavodu za mirovinsko osiguranje na temelju neisplaćene mirovine.

Navedeno rješenje provedeno je i u zemljišnim knjigama.
Prvookrivljenika se tereti da se nepripadno okoristio u točno neutvrđenom iznosu, a svakako većem od 60.000,00 kuna, za koji je oštetio zakonsku nasljednicu pokojnice. OPTUŽNICA DORH-a Lažnom oporukom pribavio sebi nasljedstvo u novcu i nekretninama

Općinsko državno odvjetništvo u Dubrovniku je 7. kolovoza 2020. podiglo pred Općinskim sudom u Dubrovniku optužnicu protiv državljanina Republike Hrvatske (1952.) zbog počinjenja kaznenih djela prijevare iz čl. 236. st. 2. u svezi sa st. 1. i krivotvorenja isprave iz čl. 278. st. 1., a sve u svezi s čl. 51. Kaznenog zakona, te protiv dvoje državljana Republike Hrvatske (1980. i 1982.) zbog počinjenja kaznenih djela pomaganja u počinjenju kaznenog djela prijevare iz čl. 236. st. 2. u svezi sa st. 1. i u svezi sa čl. 38. i krivotvorenja isprave iz čl. 278. st. 1., a sve u svezi sa čl. 51. KZ-a. (7. 8. 2020.)

Okrivljenicima se stavlja na teret da su od 7. veljače 2018. do 9. svibnja 2018. u Dubrovniku, s ciljem da se prvookrivljenik (1952.) nepripadno okoristi u većem iznosu, počinili navedena kaznena djela.

Prvookrivljenika se tereti da je zaposleniku matičnog ureda neistinito predočio kako je on na temelju usmene oporuke jedini nasljednik pokojne državljanke Republike Hrvatske (1927.) te je u prilog svojih tvrdnji dostavio neistinite izjave drugookrivljenice (1980.) i trećeokrivljenika (1982.) u kojima su oni svjesno neistinito naveli da su svjedočili usmenoj oporuci pokojnice kojom ona ostavlja prvookrivljeniku svu svoju imovinu i ušteđevinu, a sve kako bi prvookrivljenik stekao nepripadnu imovinsku korist u većem iznosu.

Prvookrivljenik je potom 9. svibnja 2018., tijekom ostavinskog postupka koji se vodio kod javnog bilježnika, nakon što je prethodno pribavio neautentičnu vlastoručnu oporuku pokojnice u kojoj je neistinito navedeno da ona njemu ostavlja svu svoju imovinu; u nakani da se tom oporukom posluži kao pravom i da dovede u zabludu javnog bilježnika; priložio tu oporuku tijekom ostavinske rasprave. Javni bilježnik je, ne posumnjavši u autentičnost te oporuke, istog dana proglasio oporuku valjanom, a potom 12. prosinca 2018. na temelju te oporuke donio rješenje o nasljeđivanju kojim je prvookrivljenik proglašen jedinim nasljednikom nekretnina i novčanih sredstava koje čine ostavinu pokojnice, kao i točno neutvrđenog iznosa potraživanja prema zavodu za mirovinsko osiguranje na temelju neisplaćene mirovine.

Navedeno rješenje provedeno je i u zemljišnim knjigama.
Prvookrivljenika se tereti da se nepripadno okoristio u točno neutvrđenom iznosu, a svakako većem od 60.000,00 kuna, za koji je oštetio zakonsku nasljednicu pokojnice.
