Građevinar iz Šestanovca odlučio je prije nekoliko godina od države tražiti 5300 eura (40 tisuća kuna) naknade štete za to što mu je vuk, kao strogo zaštićena vrsta, još prije devet godina usmrtio psa pasmine Slovački kopov. No, nepravomoćno presudom splitskog Općinskog suda dobio je tek 398 eura odštete dok će on, kao tužitelj, morati državi na ime troškova parničnog postupka isplatiti četiri puta više odnosno 1700 eura.

Ako ova presuda postane pravomoćna, bit će to još jedan pokazatelj svima da se sa "rogatim" ne isplati bosti posebice kad država tužbu shvati kao svojevrsnu ucjenu što se može iščitati iz dijela obrazloženja presude u kojem stoji da "tužitelj u svom iskazu, po ocjeni ovoga suda, nije rekao istinu o stvarnoj cijeni po kojoj je psa nabavio (navodi da ga je platio 30 tisuća kuna), osobito iz razloga što je veterinarski vještak tržišnu vrijednost tužiteljevog psa procijenio na 400 eura".

Čovjek je, dakle, tužio državu jer je njegov lovački pas, koji je bio na 10 metara dugom lancu, rastrgan dok je bio u pasjoj kućici koja se nalazila pored neograđenog vinograda gdje se pas nalazio kao bi čuvao grožđe od divljih svinja. Vještak koji je došao na očevid u ime Ministarstva zaštite okoliša i energetike zabilježio je da je psu otvoren i otrgan stražnji dio tijela, ali da životinja nije jedena. Konstatirao je da je šteta nastala od vuka te je predložio Ministarstvu da vlasniku nadoknade štetu od tri tisuće kuna prema odštetnom cjeniku jer pas ima rodovnicu za čistokrvnog psa.

No, država je, smatrajući da je vlasnik dijelom odgovoran za smrt psa jer nije poštivao kriterije koji propisuju kako psi tijekom noći moraju biti zatvoreni u prikladne boksove, staju ili tor minimalne visine ograde 1,8 metara, a ako to nije ispunjeno da se naknada umanjuje za 25 posto. Zato su mu ponudili 2 250 kuna.

Na to vlasnik nije htio pristati. Smatrao je da je takav iznos sramotno mali jer je ta naknada dvadeset puta manja od naknade za usmrćenje vuka koja iznosi 40 tisuća kuna i zato je on zatražio baš tu svotu.

- Tužitelj svog psa nije čuvao na odgovarajući način jer ga je tijekom noći ostavio zavezanog na lancu u neograđenom vinogradu i tako ga učinio dostupnim napadu divljih životinja. Međutim, kako u kriterijima pod naslovom "Utvrđivanje nadoknade štete od strogo zaštićenih velikih zvijeri na domaćim životinjama" nije određeno da će se visina štete za usmrćenog psa umanjiti za 25 posto ako pas nije odgovarajuće čuvan, to prema stavu ovoga sud nije bilo mjesta za umanjenje visine naknade štete. Naime, pas nije stoka pa se stoga u konkretnom slučaju ne primjenjuje točka 3. kriterija kojom je bilo predviđeno umanjenje od 25 posto... Tužitelj nema pravo na naknadu štete u visini tržišne vrijednosti psa, pa stoga nije važan niti njegov iskaz u dijelu u kojem opisuje način i cijenu po kojoj je psa nabavio - navodi se, uz ostalo, u nepravomoćnoj sudskoj presudi.

Građevinar iz Šestanovca odlučio je prije nekoliko godina od države tražiti 5300 eura (40 tisuća kuna) naknade štete za to što mu je vuk, kao strogo zaštićena vrsta, još prije devet godina usmrtio psa pasmine Slovački kopov. No, nepravomoćno presudom splitskog Općinskog suda dobio je tek 398 eura odštete dok će on, kao tužitelj, morati državi na ime troškova parničnog postupka isplatiti četiri puta više odnosno 1700 eura.

Ako ova presuda postane pravomoćna, bit će to još jedan pokazatelj svima da se sa "rogatim" ne isplati bosti posebice kad država tužbu shvati kao svojevrsnu ucjenu što se može iščitati iz dijela obrazloženja presude u kojem stoji da "tužitelj u svom iskazu, po ocjeni ovoga suda, nije rekao istinu o stvarnoj cijeni po kojoj je psa nabavio (navodi da ga je platio 30 tisuća kuna), osobito iz razloga što je veterinarski vještak tržišnu vrijednost tužiteljevog psa procijenio na 400 eura".

Čovjek je, dakle, tužio državu jer je njegov lovački pas, koji je bio na 10 metara dugom lancu, rastrgan dok je bio u pasjoj kućici koja se nalazila pored neograđenog vinograda gdje se pas nalazio kao bi čuvao grožđe od divljih svinja. Vještak koji je došao na očevid u ime Ministarstva zaštite okoliša i energetike zabilježio je da je psu otvoren i otrgan stražnji dio tijela, ali da životinja nije jedena. Konstatirao je da je šteta nastala od vuka te je predložio Ministarstvu da vlasniku nadoknade štetu od tri tisuće kuna prema odštetnom cjeniku jer pas ima rodovnicu za čistokrvnog psa.

No, država je, smatrajući da je vlasnik dijelom odgovoran za smrt psa jer nije poštivao kriterije koji propisuju kako psi tijekom noći moraju biti zatvoreni u prikladne boksove, staju ili tor minimalne visine ograde 1,8 metara, a ako to nije ispunjeno da se naknada umanjuje za 25 posto. Zato su mu ponudili 2 250 kuna.

Na to vlasnik nije htio pristati. Smatrao je da je takav iznos sramotno mali jer je ta naknada dvadeset puta manja od naknade za usmrćenje vuka koja iznosi 40 tisuća kuna i zato je on zatražio baš tu svotu.

- Tužitelj svog psa nije čuvao na odgovarajući način jer ga je tijekom noći ostavio zavezanog na lancu u neograđenom vinogradu i tako ga učinio dostupnim napadu divljih životinja. Međutim, kako u kriterijima pod naslovom "Utvrđivanje nadoknade štete od strogo zaštićenih velikih zvijeri na domaćim životinjama" nije određeno da će se visina štete za usmrćenog psa umanjiti za 25 posto ako pas nije odgovarajuće čuvan, to prema stavu ovoga sud nije bilo mjesta za umanjenje visine naknade štete. Naime, pas nije stoka pa se stoga u konkretnom slučaju ne primjenjuje točka 3. kriterija kojom je bilo predviđeno umanjenje od 25 posto... Tužitelj nema pravo na naknadu štete u visini tržišne vrijednosti psa, pa stoga nije važan niti njegov iskaz u dijelu u kojem opisuje način i cijenu po kojoj je psa nabavio - navodi se, uz ostalo, u nepravomoćnoj sudskoj presudi.
