Visoki trgovački sud odlučio je da tvrtka "Tu doma" iz Vranjica, koja je u vlasništvu braće Matka i Josipa Mijića, inače suvlasnika "Građe Solin", ne može preuzeti hotel "Bellevue" neposrednom nagodbom.

To znači da će se hotel prodavati na javnoj dražbi, koja bi se ubrzo trebala održati na Trgovačkom sudu u Splitu. Prije toga održat će se Skupština vjerovnika na kojoj će se odrediti početna cijena i način prodaje, odnosno hoće li to biti prikupljanjem pisanih ponuda. 

Kako je potvrdio Maroje Stjepović, stečajni upravitelj "Laurusa", za hotel "Bellevue" postoji velik interes domaćih i stranih investitora, samo je pitanje koliku cijenu će taj turistički dragulj s Prokurativa postići.

Mijići su, naime, nakon što su otkupili 6,6 milijuna kuna potraživanja od tvrtke "Althea Management Limited" s Cipra, postali većinski vjerovnici "Laurusa" u stečaju i zauzeli mjesto koje je do tada imala poznata poduzetnička obitelj Crnčević, koja, prema dostupnim podacima, stoji iza tvrtke s Cipra.

Tako su Mijići došli u poziciju da imaju najviše glasova u Skupštini vjerovnika i da kao Skupština vjerovnika mogu predložiti i izglasati prijedlog da njihova tvrtka "Tu doma" hotel preuzme neposrednom nagodbom, uz obvezu da podmiri dva milijuna eura dugova ostalih vjerovnika.

Trgovački sud je potom takvu odluku Skupštine vjerovnika ukinuo s obrazloženjem da je protivna zajedničkim interesima vjerovnika i jer predstavlja nedopušteno raspolaganje. Na to se žalila tvrtka "Tu doma", a njezina žalba je sada odbačena.

– Skupština vjerovnika ovlaštena je odlučiti o načinu unovčenja imovine koja nije opterećena razlučnim pravom, i to nije sporno. Međutim, skupština vjerovnika nije ovlaštena odlučiti o načinu namirenja vjerovnika u stečajnom postupku – naveo je viši sud, te istaknuo kako treba voditi računa i o pravima osoba koje imaju dionice "Laurusa" (a to su država i bivši radnici, op.a.), kojima je stečajni upravitelj, nakon namirenja stečajnih vjerovnika, dužan predati preostali višak stečajne mase – naveo je Visoki trgovački sud.

Visoki trgovački sud odlučio je da tvrtka "Tu doma" iz Vranjica, koja je u vlasništvu braće Matka i Josipa Mijića, inače suvlasnika "Građe Solin", ne može preuzeti hotel "Bellevue" neposrednom nagodbom.

To znači da će se hotel prodavati na javnoj dražbi, koja bi se ubrzo trebala održati na Trgovačkom sudu u Splitu. Prije toga održat će se Skupština vjerovnika na kojoj će se odrediti početna cijena i način prodaje, odnosno hoće li to biti prikupljanjem pisanih ponuda. 

Kako je potvrdio Maroje Stjepović, stečajni upravitelj "Laurusa", za hotel "Bellevue" postoji velik interes domaćih i stranih investitora, samo je pitanje koliku cijenu će taj turistički dragulj s Prokurativa postići.

Mijići su, naime, nakon što su otkupili 6,6 milijuna kuna potraživanja od tvrtke "Althea Management Limited" s Cipra, postali većinski vjerovnici "Laurusa" u stečaju i zauzeli mjesto koje je do tada imala poznata poduzetnička obitelj Crnčević, koja, prema dostupnim podacima, stoji iza tvrtke s Cipra.

Tako su Mijići došli u poziciju da imaju najviše glasova u Skupštini vjerovnika i da kao Skupština vjerovnika mogu predložiti i izglasati prijedlog da njihova tvrtka "Tu doma" hotel preuzme neposrednom nagodbom, uz obvezu da podmiri dva milijuna eura dugova ostalih vjerovnika.

Trgovački sud je potom takvu odluku Skupštine vjerovnika ukinuo s obrazloženjem da je protivna zajedničkim interesima vjerovnika i jer predstavlja nedopušteno raspolaganje. Na to se žalila tvrtka "Tu doma", a njezina žalba je sada odbačena.

– Skupština vjerovnika ovlaštena je odlučiti o načinu unovčenja imovine koja nije opterećena razlučnim pravom, i to nije sporno. Međutim, skupština vjerovnika nije ovlaštena odlučiti o načinu namirenja vjerovnika u stečajnom postupku – naveo je viši sud, te istaknuo kako treba voditi računa i o pravima osoba koje imaju dionice "Laurusa" (a to su država i bivši radnici, op.a.), kojima je stečajni upravitelj, nakon namirenja stečajnih vjerovnika, dužan predati preostali višak stečajne mase – naveo je Visoki trgovački sud.
