Zapletima oko građevinskih radova na Marjanu, čini se, nema kraja. Javio nam se Ivan Luka Sablić, član uprave tvrtke "Plitvice Đogaš", tvrtke koja je vlasnik parcele na Šetalištu Ivana Meštrovića 55, s dojavom kako je građevinska inspekcija zabranila radove na gradnji bazena.

- Građevinska inspektorica je izašla na teren i stavila je tablu zabrane radova, a ja ne znam zašto. Rekla je da će mi objašnjene poslati na mail naknadno, kad malo promisli zbog čega. - ogorčeno kazuje Sablić.

Po njegovom tumačenju kojeg je poslao i Državnom inspektoratu, žaleći se na postupanje inspektorice, pored kuće se gradi vrtni bazen dimenzija cca 50 četvornih metara koji je visine 90 cm od tla, što je, kaže, u skladu s "Pravilnikom o jednostavnim i drugim građevinama i radovima".

Iz Državnog inspektorata objasnili su u svom odgovoru zašto je gradilište zatvoreno.

- Građevinska inspekcija Državnog inspektorata obavila je tijekom listopada 2021. godine inspekcijski nadzor na lokaciji. Nadzorom je utvrđeno da investitor gradi armiranobetonsku građevinu - otvoreni bazen s provedenim instalacijama bez pravomoćne odnosno izvršne građevinske dozvole.

S obzirom na to da za opisanu gradnju investitor nije predočio nikakav akt na temelju kojeg je pristupio građenju predmetnu građevine, kao ni potvrde nadležnih javnopravnih tijela, postavljanjem posebnog službenog znaka "Zatvoreno gradilište" obustavljeno je građenje - stoji u odgovoru Državnog inspektorata

Od Ministarstva graditeljstva, prostornog uređenja i državne imovine, kojem smo poslali sliku bazena na Marjanu, zatražili smo tumačenje je li građevina u skladu sa pojmom vrtnog bazena prema Pravilniku s obzirom na teren na kojem se nalazi.

- Temeljem odredbe članka 3. točke 4. Pravilnika građevina vrtni bazen definirana je kao građevina ukopana u okolni teren do dubine jednog metra.

Iz same definicije namjene vrtnog bazena proizlazi da se radi o građevini koja se gradi u vrtu, na čestici postojeće zgrade, a u svrhu obogaćivanja hortikulturnog uređenja čestice, pri čemu namjena vrtnog bazena nema u vidu njegovo korištenje za kupanje. Radi se, dakle, o nevelikoj građevini, čija veličina i izgled trebaju biti primjereni veličini vrta kao i veličini građevne čestice - objašnjavaju iz Ministarstva.

- Također, mogućnost građenja vrtnog bazena ovisi o važećem prostornom planu na području na kojem se namjerava graditi, u konkretnom slučaju Grada Splita, i to na način da se građevine iz toga Pravilnika ne smiju projektirati, graditi, odnosno izvoditi ako je to zabranjeno prostornim planom ili na drugi način protivno prostornom planu.

Nastavno na sve navedeno, upućujemo vas da se za predmetno tumačenje obratite Upravnom odjelu za prostorno planiranje i uređenje i zaštitu okoliša Grada Splita te građevinskoj inspekciji područnog ureda u Splitu - poručili su u Ministarstvu.

Drugim riječima, iz odgovora Ministarstva proizlazi da je vrtni bazen manja građevina namjenjena prvenstveno za hortikulturno uređivanje vrta, a ne za kupanje.

A bazen čiji su radovi obustavljeni na Kašjunima djeluje upravo kao velika kada. Također, u Ministarstvu tvrde da vrtni bazen treba biti ukopan do jedan metar, a građevina oko koje se digla prašina nije ukopana.

Teo Vojković: Gradnja bazena je protivna GUP-u

 

Budući da je Ivan Luka Sablić u medijima spominjao da je od Grada dobio Lokacijsku informaciju i Mišljenje da je to što namjeravaju graditi sukladno planu, poslali smo fotografiju bazena koju je snimio naš fotoreporter Vojko Bašić pročelniku Teu Vojkoviću i upitali ga je li Upravni odjel za prostorno planiranje, uređenje i zaštitu okoliša vidio kakve dimenzije bazena namjerava izvesti investitor. 

- U predmetu u kojem je moj prethodnik dao Mišljenje ne postoji Idejni projekt oznake T.D.A 02-10/20-ID, od 01/2021 izrađen od ovlaštenog arhitekta Jurice Jelavića, dipl.ing.arh.

Što se tiče usklađenosti zahvata sa prostorno-planskom dokumentacijom, očitujem se kako je predmetni zahvat u području koje je GUP-om Grada Splita određeno kao područje namjene: Rekreacijska namjena – kupališta – R3.

Na tim površinama mogu se uređivati plaže i oblikovati obalna linija, odnosno zadržavati obala u prirodnom stanju (na poluotoku Marjan i području Duilovo – Orišac - Stobreč).

Površine se mogu uređivati za boravak na otvorenom uz obveznu sadnju visokog zelenila. Na uređenim plažama moguća je gradnja građevina što upotpunjuju i služe osnovnoj djelatnosti (garderobe, sanitarije, manji ugostiteljski sadržaji, spremišta rekvizita), ukupne BRP-e do maksimalno 200 m2/ha cjelovite uređene površine kupališta.

Konkretna lokacija nalazi se u području gdje važe urbana pravila: 8.3.1.7c. Park šuma s mogućom rekonstrukcijom postojećih građevina za javne sadržaje i ekskluzivni turizam - Vila Dalmacija

Članak 59.

Omogućava se zaštita, održavanje i uređenje područja ovog dijela Park šume Marjan kroz izradu ili nakon izrade PPPPO-a (u granicama obuhvata utvrđenim Prostornim planom uređenja Grada Splita), prema slijedećim pravilima:

- maksimalno čuvanje prirodnih karakteristika terena;

- čuvanje i uređivanje kvalitetne vegetacije;

- održavanje i rekonstrukcija postojećih građevina, koje se mogu namijeniti javnim sadržajima i ekskluzivnom turizmu.

Dakle, slijedom gore citiranih odredbi GUP-a Grada Splita, mišljenja sam da je gradnja građevine koja je prikazana na priloženoj fotografiji protivna važećim odredbama GUP-a- zaključuje pročelnik Vojković u svom odgovoru.

Zapletima oko građevinskih radova na Marjanu, čini se, nema kraja. Javio nam se Ivan Luka Sablić, član uprave tvrtke "Plitvice Đogaš", tvrtke koja je vlasnik parcele na Šetalištu Ivana Meštrovića 55, s dojavom kako je građevinska inspekcija zabranila radove na gradnji bazena.

- Građevinska inspektorica je izašla na teren i stavila je tablu zabrane radova, a ja ne znam zašto. Rekla je da će mi objašnjene poslati na mail naknadno, kad malo promisli zbog čega. - ogorčeno kazuje Sablić.

Po njegovom tumačenju kojeg je poslao i Državnom inspektoratu, žaleći se na postupanje inspektorice, pored kuće se gradi vrtni bazen dimenzija cca 50 četvornih metara koji je visine 90 cm od tla, što je, kaže, u skladu s "Pravilnikom o jednostavnim i drugim građevinama i radovima".

Iz Državnog inspektorata objasnili su u svom odgovoru zašto je gradilište zatvoreno.

- Građevinska inspekcija Državnog inspektorata obavila je tijekom listopada 2021. godine inspekcijski nadzor na lokaciji. Nadzorom je utvrđeno da investitor gradi armiranobetonsku građevinu - otvoreni bazen s provedenim instalacijama bez pravomoćne odnosno izvršne građevinske dozvole.

S obzirom na to da za opisanu gradnju investitor nije predočio nikakav akt na temelju kojeg je pristupio građenju predmetnu građevine, kao ni potvrde nadležnih javnopravnih tijela, postavljanjem posebnog službenog znaka "Zatvoreno gradilište" obustavljeno je građenje - stoji u odgovoru Državnog inspektorata

Od Ministarstva graditeljstva, prostornog uređenja i državne imovine, kojem smo poslali sliku bazena na Marjanu, zatražili smo tumačenje je li građevina u skladu sa pojmom vrtnog bazena prema Pravilniku s obzirom na teren na kojem se nalazi.

- Temeljem odredbe članka 3. točke 4. Pravilnika građevina vrtni bazen definirana je kao građevina ukopana u okolni teren do dubine jednog metra.

Iz same definicije namjene vrtnog bazena proizlazi da se radi o građevini koja se gradi u vrtu, na čestici postojeće zgrade, a u svrhu obogaćivanja hortikulturnog uređenja čestice, pri čemu namjena vrtnog bazena nema u vidu njegovo korištenje za kupanje. Radi se, dakle, o nevelikoj građevini, čija veličina i izgled trebaju biti primjereni veličini vrta kao i veličini građevne čestice - objašnjavaju iz Ministarstva.

- Također, mogućnost građenja vrtnog bazena ovisi o važećem prostornom planu na području na kojem se namjerava graditi, u konkretnom slučaju Grada Splita, i to na način da se građevine iz toga Pravilnika ne smiju projektirati, graditi, odnosno izvoditi ako je to zabranjeno prostornim planom ili na drugi način protivno prostornom planu.

Nastavno na sve navedeno, upućujemo vas da se za predmetno tumačenje obratite Upravnom odjelu za prostorno planiranje i uređenje i zaštitu okoliša Grada Splita te građevinskoj inspekciji područnog ureda u Splitu - poručili su u Ministarstvu.

Drugim riječima, iz odgovora Ministarstva proizlazi da je vrtni bazen manja građevina namjenjena prvenstveno za hortikulturno uređivanje vrta, a ne za kupanje.

A bazen čiji su radovi obustavljeni na Kašjunima djeluje upravo kao velika kada. Također, u Ministarstvu tvrde da vrtni bazen treba biti ukopan do jedan metar, a građevina oko koje se digla prašina nije ukopana.

Teo Vojković: Gradnja bazena je protivna GUP-u

 

Budući da je Ivan Luka Sablić u medijima spominjao da je od Grada dobio Lokacijsku informaciju i Mišljenje da je to što namjeravaju graditi sukladno planu, poslali smo fotografiju bazena koju je snimio naš fotoreporter Vojko Bašić pročelniku Teu Vojkoviću i upitali ga je li Upravni odjel za prostorno planiranje, uređenje i zaštitu okoliša vidio kakve dimenzije bazena namjerava izvesti investitor. 

- U predmetu u kojem je moj prethodnik dao Mišljenje ne postoji Idejni projekt oznake T.D.A 02-10/20-ID, od 01/2021 izrađen od ovlaštenog arhitekta Jurice Jelavića, dipl.ing.arh.

Što se tiče usklađenosti zahvata sa prostorno-planskom dokumentacijom, očitujem se kako je predmetni zahvat u području koje je GUP-om Grada Splita određeno kao područje namjene: Rekreacijska namjena – kupališta – R3.

Na tim površinama mogu se uređivati plaže i oblikovati obalna linija, odnosno zadržavati obala u prirodnom stanju (na poluotoku Marjan i području Duilovo – Orišac - Stobreč).

Površine se mogu uređivati za boravak na otvorenom uz obveznu sadnju visokog zelenila. Na uređenim plažama moguća je gradnja građevina što upotpunjuju i služe osnovnoj djelatnosti (garderobe, sanitarije, manji ugostiteljski sadržaji, spremišta rekvizita), ukupne BRP-e do maksimalno 200 m2/ha cjelovite uređene površine kupališta.

Konkretna lokacija nalazi se u području gdje važe urbana pravila: 8.3.1.7c. Park šuma s mogućom rekonstrukcijom postojećih građevina za javne sadržaje i ekskluzivni turizam - Vila Dalmacija

Članak 59.

Omogućava se zaštita, održavanje i uređenje područja ovog dijela Park šume Marjan kroz izradu ili nakon izrade PPPPO-a (u granicama obuhvata utvrđenim Prostornim planom uređenja Grada Splita), prema slijedećim pravilima:

- maksimalno čuvanje prirodnih karakteristika terena;

- čuvanje i uređivanje kvalitetne vegetacije;

- održavanje i rekonstrukcija postojećih građevina, koje se mogu namijeniti javnim sadržajima i ekskluzivnom turizmu.

Dakle, slijedom gore citiranih odredbi GUP-a Grada Splita, mišljenja sam da je gradnja građevine koja je prikazana na priloženoj fotografiji protivna važećim odredbama GUP-a- zaključuje pročelnik Vojković u svom odgovoru.
