Ključna riječ je pravomoćna sudska presuda: na temelju te ovršne isprave Split ship managemet (SSM) u stečaju blokirao je račun splitskog Jadroplova za 12 milijuna kuna.

Neugodna vijest za brodara sa Zapadne obale i to u nezgodnom trenutku: firma u stečaju blokirala ‘Jadroplov‘ za 12 milijuna kuna!

Evo kako to detaljnije objašnjava Natalija Mladineo, stečajna upraviteljica SSM-a:

"Još koncem studenog 1999. godine Trgovački sud u Splitu donio je rješenje kojim je naloženo Jadroplov da isplati SSM-u ukupno 455.000 dolara, uvećano za pripadajuću kamatu."

U siječnju 2015. godine Jadroplov se žalio, pa je pokrenuta parnica na istom sudu. Ishod je bio u korist SSM-a, uz tumačenje o načinu obračuna kamata: važile su stope kao za dolarske štedne uloge po viđenju.

Jadroplov se opet žalio, a Visoki trgovački sud RH u srpnju 2018. potvrdio je prvostupanjsku presudu.

Splitska brodarska tvrtka izjavila je potom reviziju, ali je Vrhovni sud RH na sjednici koncem siječnja 2020. godine reviziju odbio.

"Na Skupštini vjerovnika održanoj u ovom stečajnom postupku 11. siječnja 2022. vjerovnici su ovlastili stečajnu upraviteljicu da temeljem pravomoćne, ovršne i izvršne presude izravnom naplatom na FINA-i pokrene postupak namirenja naplatom dosuđenih potraživanja.

S obzirom da se radi o izravnoj naplati pokrenutoj putem Financijske agencije, ona je nadležna i za obračun kamate, a sukladno pravomoćnoj presudi i visini kamatne stope koja je u RH vrijedila u to vrijeme, pa do trenutka isplate", kaže stečajna upraviteljica SSM-a.

Ističe da je zakon jasan i nedvosmislen kod postupka naplate utvrđenih tražbina stečajnih vjerovnika. Oni se raspoređuju u dvije skupine: prvi i drugi viši isplatni red. Kada se podmire troškovi stečajnog postupka i ostale obveze stečajne mase pristupa se diobi stečajnim vjerovnicima. Ali, najprije se namiruje prvi red. I to u cijelosti, ako je moguće. Onda ide drugi red. Ako nema dovoljno, onda se i prvi i drugi red namiruju razmjerno.

"Stečajni zakon ne poznaje mehanizme kojima bi se bilo koji od stečajnih vjerovnika namirio u cijelosti svojih potraživanja, a na štetu drugih koji bi se namirili djelomično ili nikako."

Prema riječima stečajne upraviteljice SSM-a, "Ratko Božić i s njim povezana društva su tijekom stečajnog postupka cesijom otkupljivali tražbine drugih stečajnih vjerovnika i tako stali u njihov položaj."

Posebno ističe da su Božić i s njim povezana društva stečajni vjerovnici drugog višeg isplatnog reda u slučaju stečaja SSM-a.

"To znači da ni pod kojim uvjetima sredstva koja se naplate od Jadroplova neće biti usmjerena prema njima jer za to ne postoje zakonske odredbe koje bi im dale ta prava", zaključujuje Mladineo.

Ključna riječ je pravomoćna sudska presuda: na temelju te ovršne isprave Split ship managemet (SSM) u stečaju blokirao je račun splitskog Jadroplova za 12 milijuna kuna.

Neugodna vijest za brodara sa Zapadne obale i to u nezgodnom trenutku: firma u stečaju blokirala ‘Jadroplov‘ za 12 milijuna kuna!

Evo kako to detaljnije objašnjava Natalija Mladineo, stečajna upraviteljica SSM-a:

"Još koncem studenog 1999. godine Trgovački sud u Splitu donio je rješenje kojim je naloženo Jadroplov da isplati SSM-u ukupno 455.000 dolara, uvećano za pripadajuću kamatu."

U siječnju 2015. godine Jadroplov se žalio, pa je pokrenuta parnica na istom sudu. Ishod je bio u korist SSM-a, uz tumačenje o načinu obračuna kamata: važile su stope kao za dolarske štedne uloge po viđenju.

Jadroplov se opet žalio, a Visoki trgovački sud RH u srpnju 2018. potvrdio je prvostupanjsku presudu.

Splitska brodarska tvrtka izjavila je potom reviziju, ali je Vrhovni sud RH na sjednici koncem siječnja 2020. godine reviziju odbio.

"Na Skupštini vjerovnika održanoj u ovom stečajnom postupku 11. siječnja 2022. vjerovnici su ovlastili stečajnu upraviteljicu da temeljem pravomoćne, ovršne i izvršne presude izravnom naplatom na FINA-i pokrene postupak namirenja naplatom dosuđenih potraživanja.

S obzirom da se radi o izravnoj naplati pokrenutoj putem Financijske agencije, ona je nadležna i za obračun kamate, a sukladno pravomoćnoj presudi i visini kamatne stope koja je u RH vrijedila u to vrijeme, pa do trenutka isplate", kaže stečajna upraviteljica SSM-a.

Ističe da je zakon jasan i nedvosmislen kod postupka naplate utvrđenih tražbina stečajnih vjerovnika. Oni se raspoređuju u dvije skupine: prvi i drugi viši isplatni red. Kada se podmire troškovi stečajnog postupka i ostale obveze stečajne mase pristupa se diobi stečajnim vjerovnicima. Ali, najprije se namiruje prvi red. I to u cijelosti, ako je moguće. Onda ide drugi red. Ako nema dovoljno, onda se i prvi i drugi red namiruju razmjerno.

"Stečajni zakon ne poznaje mehanizme kojima bi se bilo koji od stečajnih vjerovnika namirio u cijelosti svojih potraživanja, a na štetu drugih koji bi se namirili djelomično ili nikako."

Prema riječima stečajne upraviteljice SSM-a, "Ratko Božić i s njim povezana društva su tijekom stečajnog postupka cesijom otkupljivali tražbine drugih stečajnih vjerovnika i tako stali u njihov položaj."

Posebno ističe da su Božić i s njim povezana društva stečajni vjerovnici drugog višeg isplatnog reda u slučaju stečaja SSM-a.

"To znači da ni pod kojim uvjetima sredstva koja se naplate od Jadroplova neće biti usmjerena prema njima jer za to ne postoje zakonske odredbe koje bi im dale ta prava", zaključujuje Mladineo.

Ključna riječ je pravomoćna sudska presuda: na temelju te ovršne isprave Split ship managemet (SSM) u stečaju blokirao je račun splitskog Jadroplova za 12 milijuna kuna.

Neugodna vijest za brodara sa Zapadne obale i to u nezgodnom trenutku: firma u stečaju blokirala ‘Jadroplov‘ za 12 milijuna kuna!

Evo kako to detaljnije objašnjava Natalija Mladineo, stečajna upraviteljica SSM-a:

"Još koncem studenog 1999. godine Trgovački sud u Splitu donio je rješenje kojim je naloženo Jadroplov da isplati SSM-u ukupno 455.000 dolara, uvećano za pripadajuću kamatu."

U siječnju 2015. godine Jadroplov se žalio, pa je pokrenuta parnica na istom sudu. Ishod je bio u korist SSM-a, uz tumačenje o načinu obračuna kamata: važile su stope kao za dolarske štedne uloge po viđenju.
