Jedan Splićanin doživio je neugodno iskustvo u poznatoj trgovini odjeće. Kako tvrdi, nisu mu htjeli uvažiti reklamaciju na nekorišteni proizvodi, te su ga čak i mirisali, a njegovo pismo koje je poslao portalu Dalmacija Danas prenosimo u cijelosti.

- Kupio sam majicu te nekoliko dana kasnije, odlučujem majicu vratiti u istu poslovnicu, naravno, sukladno s politikom povrata, u roku od 30 dana, nenošenu i s originalnom ušivenom etiketom.

Nakon dolaska na blagajnu za povrat, djelatnica poziva „menadžericu”, pretpostavljam - voditeljicu smjene, koja gotovo u istom trenu tvrdi kako je majica nošena i kako nije za povrat „jer ju ona mora vratiti na prodaju”.

Nakon upita da pojasni kako to "majica nije za povrat”, nudi mi opet isto objašnjenje da je nošena te da mi može donijeti drugu majicu iz prodajnog prostora da ih usporedimo. Pristajem na to i nakon donošenje te druge majice i usporedbe s mojom ispada da su majice u potpunosti identične po svim svojstvima i da nema nikakve razlike među njima (diskoloracija, habanje ili oštećenja) osim toga što je moja neznatno naborana iz očitih razloga (nisam ju donio na vješalici u poslovnicu, nego složenu u torbi).

Svakako, nakon kratke rasprave i dalje tvrdi da ona "po iskustvu zna da je majica nošena", što naravno nije istina, ali kao konačni dokaz u bizarnom preokretu počinje njušiti tu majicu nekoliko puta i govoriti da „zna kako miriše roba iz dućana, a ova majica ne miriše na dućan”.

Nažalost, nisam zajedno s njom počeo njušiti majicu na prepunoj blagajni okružen ljudima pa sam tako propustio priliku da i vama predočim te razlike u mirisu iako sumnjam da bi meni kao laiku bile i jasne.

Nakon bespovratno potrošenih 10 minuta mog života i vašeg vremena, u konačnici je ipak odobrila povrat, ali kao reklamaciju jer je nekoliko vlakana pulovera (srećom) bilo izvučeno pa smo oboje imali alibi za rješenje ovoga problema.

Za kraj, mene kao kupca zanima spada li u poslovnu politiku tvrtke njušenje robe na blagajni za povrate i ako da, zašto to nije navedeno na poleđini računa ili istaknuto na blagajni jer za neke djelatnike tvrtke očito nije dovoljno samo da roba nije nošena i da ima u potpunosti ista fizička i vizualna svojstva nego mora i mirisati po tvornicama zemalja u razvoju?"

Podsjetimo, prema Zakonu o zaštiti potrošača propisano da se potrošač ne može odreći niti mu se mogu ograničiti prava koja ima na temelju ovoga zakona ili drugih zakona kojima se štite prava potrošača, a člankom 43. stavkom 1. zakona propisano je da je trgovac dužan potrošaču ispuniti ugovor u skladu s odredbama ugovora, spomenutog zakona i Zakona o obveznim odnosima.

U slučaju kada proizvod koji ste kupili ima nedostatak, a vi ste o tome na vrijeme izvijestili trgovca, možete, po svom izboru, tražiti popravak stvari, zamjenu stvari ili sniženje cijene. Ako ste zatražili popravak stvari ili zamjenu stvari a to nije moguće ili nije omogućeno u razumnom roku, možete zahtijevati sniženje cijene stvari ili povrat novca (raskid ugovora) - piše u pismu Splićanina, prenosi Dalmacija Danas.

Jedan Splićanin doživio je neugodno iskustvo u poznatoj trgovini odjeće. Kako tvrdi, nisu mu htjeli uvažiti reklamaciju na nekorišteni proizvodi, te su ga čak i mirisali, a njegovo pismo koje je poslao portalu Dalmacija Danas prenosimo u cijelosti.

- Kupio sam majicu te nekoliko dana kasnije, odlučujem majicu vratiti u istu poslovnicu, naravno, sukladno s politikom povrata, u roku od 30 dana, nenošenu i s originalnom ušivenom etiketom.

Nakon dolaska na blagajnu za povrat, djelatnica poziva „menadžericu”, pretpostavljam - voditeljicu smjene, koja gotovo u istom trenu tvrdi kako je majica nošena i kako nije za povrat „jer ju ona mora vratiti na prodaju”.

Nakon upita da pojasni kako to "majica nije za povrat”, nudi mi opet isto objašnjenje da je nošena te da mi može donijeti drugu majicu iz prodajnog prostora da ih usporedimo. Pristajem na to i nakon donošenje te druge majice i usporedbe s mojom ispada da su majice u potpunosti identične po svim svojstvima i da nema nikakve razlike među njima (diskoloracija, habanje ili oštećenja) osim toga što je moja neznatno naborana iz očitih razloga (nisam ju donio na vješalici u poslovnicu, nego složenu u torbi).

Svakako, nakon kratke rasprave i dalje tvrdi da ona "po iskustvu zna da je majica nošena", što naravno nije istina, ali kao konačni dokaz u bizarnom preokretu počinje njušiti tu majicu nekoliko puta i govoriti da „zna kako miriše roba iz dućana, a ova majica ne miriše na dućan”.

Nažalost, nisam zajedno s njom počeo njušiti majicu na prepunoj blagajni okružen ljudima pa sam tako propustio priliku da i vama predočim te razlike u mirisu iako sumnjam da bi meni kao laiku bile i jasne.

Nakon bespovratno potrošenih 10 minuta mog života i vašeg vremena, u konačnici je ipak odobrila povrat, ali kao reklamaciju jer je nekoliko vlakana pulovera (srećom) bilo izvučeno pa smo oboje imali alibi za rješenje ovoga problema.

Za kraj, mene kao kupca zanima spada li u poslovnu politiku tvrtke njušenje robe na blagajni za povrate i ako da, zašto to nije navedeno na poleđini računa ili istaknuto na blagajni jer za neke djelatnike tvrtke očito nije dovoljno samo da roba nije nošena i da ima u potpunosti ista fizička i vizualna svojstva nego mora i mirisati po tvornicama zemalja u razvoju?"

Podsjetimo, prema Zakonu o zaštiti potrošača propisano da se potrošač ne može odreći niti mu se mogu ograničiti prava koja ima na temelju ovoga zakona ili drugih zakona kojima se štite prava potrošača, a člankom 43. stavkom 1. zakona propisano je da je trgovac dužan potrošaču ispuniti ugovor u skladu s odredbama ugovora, spomenutog zakona i Zakona o obveznim odnosima.

U slučaju kada proizvod koji ste kupili ima nedostatak, a vi ste o tome na vrijeme izvijestili trgovca, možete, po svom izboru, tražiti popravak stvari, zamjenu stvari ili sniženje cijene. Ako ste zatražili popravak stvari ili zamjenu stvari a to nije moguće ili nije omogućeno u razumnom roku, možete zahtijevati sniženje cijene stvari ili povrat novca (raskid ugovora) - piše u pismu Splićanina, prenosi Dalmacija Danas.
