Nastavlja se proces oko slučaja Ježinac, gdje je prije negoli su na parcelu došli bageri, bila gusta vegetacija u terasama vrtova.

Nakon građevinske inspekcije (koja je rekla da se radi prema glavnom projektu), nadzor je obavila i inspekcija zaštite prirode. Iz odgovora Državnog inspektorata ispada da njima nije sporan investitor koji je odnio komad brda, srušio zidove i iščupao zelenilo, nego županijski Upravni odjel za zaštitu okoliša, komunalne poslove, infrastrukturu i investicije, koji je odbio izdati dopuštenje za obavljanje radova.

- Inspekcija zaštite prirode izvršila je inspekcijski nadzor na lokaciji, pri čemu je uočen mogući nesklad izdane dokumentacije nadležnih. Stoga je, sukladno članku 205. stavak 1. Zakona o zaštiti prirode, inspekcija zaštite prirode zatražila od Ministarstva gospodarstva i održivog razvoja provođenje upravnog nadzora nad radom nadležnog upravnog odjela u konkretnom predmetu, a koji je izdao i Potvrdu i Rješenje - glasi odgovor iz Državnog inspektorata.

Da pojasnimo, županijski Upravni odjel je 12. kolovoza 2020. godine izdao Potvrdu kojom se odobrava Glavni projekt, da bi potom 10. lipnja 2021. izdao Rješenje kojim je odbio izdati dopuštenje za izvođenje radova rekonstrukcije potpornih i ogradnih zidova.

Kako doznajemo od Marije Vuković, pročelnice Upravnog odjela, za istu katastarsku česticu 9335/1 investitor je zatražio dvije dozvole.

Najprije je investitoru za gornji dio izdana građevinska dozvola za rekonstrukciju rampe i pomoćnu kućicu. No, Grad je odbio izdati drugu građevinsku dozvolu, a ta je za rekonstrukciju potpornih zidova i ograde na južnoj strani. U postupku u kojem Grad nije izdao građevinsku dozvolu, županijski Upravni odjel dao je Potvrdu u kolovozu 2020., u kojoj su naglasili da "potvrda vrijedi ako je predmetni zahvat sukladan s važećom prostorno-planskom dokumentacijom grada Splita".

- Nakon što su odbili izdati građevinsku dozvolu, nas su iz Grada u nekoliko navrata kontaktirali za novi postupak, a mi smo uvijek inzistirali da nam se kaže o kakvom se postupku radi.

Dok smo uporno čekali da nam se objasni, da bismo se mogli pravo očitovati, investitor je počeo s radovima, i to na osnovi Potvrde koju su od nas dobili za postupak u kojem je odbijena građevinska dozvola. Radi se o zloupotrebljavanju naše Potvrde od strane Grada - objašnjava Marija Vuković i dodaje da inspekcija nije izvršila uvid u kompletni spis predmeta, nego u ono što im je investitor pokazao.

U lipnju je investitor zatražio dopuštenje od Županije da mogu izvoditi radove rekonstrukcije zidova kad je već debelo "ogulio" teren, ali ga nisu dobili.

Selektivno tumačenje

- Mi drukčije postupamo ako ide građevinska dozvola, a drukčije kad ide naše dopuštenje u kojem dajemo uvjete. U spisu predmeta nije bilo uporabne dozvole koja bi dokazivala da su zidovi postojeći, tako da su stariji od 1968. godine.

U međuvremenu su u potpunosti uklonjeni svi zidovi. Odbili smo izdati dopuštenje, jer se u toj situaciji nije moglo govoriti o rekonstrukciji nego o izgradnji zahvata.

Grad Split selektivno čita GUP, oni su trebali odrediti je li potrebna zaštita okoliša u zaštićenom području. Da se Grad i njegov Upravni odjel pridržavaju odredbi GUP-a, ovo se ne bi dogodilo.

Pročelnik Boris Marelja zanemaruje članke GUP-a po kojima se zahvati ove vrste ne mogu izvoditi bez plana posebnih obilježja (PPPPO-a) i bez Plana za gospodarenje park-šumom, koji ne postoje. On se samo poziva na članak 108. A što je s člankom 105., koji točno navodi sadržaje koji se mogu graditi do izrade provedbenih dokumenata - kazuje Marija Vuković.

Je li upravni odjel Grada "labavo" tumači odredbe GUP-a, upitali smo pročelnika Borisa Marelju. On nam je kazao da je u veljači 2020. izdana građevna dozvola za rekonstrukciju dviju postojećih građevina (prilaznu rampu s pomoćnim prostorijama ispod nje i građevinu pomoćne namjene), i to u postojećim gabaritima. Naveo je da GUP određuje kako se sve postojeće građevine mogu rekonstruirati, pa tako i one u park-šumi.

Opasni zidovi

U srpnju 2020. je Upravni odjel odbacio zahtjev da se i za potporne zidove na južnoj strani izda građevinska dozvola jer se za to ne izdaje, kaže Marelja i objašnjava da se zidovi takve visine mogu raditi prema pravilniku o jednostavnim građevinama.

- Dana 29. ožujka ove godine investitor je prijavio početak izvođenja radova, čime je udovoljio svim zakonom predviđenim radnjama - ističe pročelnik.

- Odredbom članka 108. Generalnog urbanističkog plana Splita određena je rekonstrukcija građevina čija je namjena protivna planiranoj namjeni, dopušta se sanacija postojećih ograda i potpornih zidova radi sanacije terena. Iako navedeni članak dopušta i minorne izmjene gabarita građevine, isto se ne odnosi na građevine u Park-šumi Marjan, koje se mogu rekonstruirati u postojećim gabaritima - napominje Marelja, koji dodaje da su postojeći zidovi bili popucali i predstavljali opasnost.

Nakon tog odgovora poslali smo Marelji prije dva dana upit zašto se poziva na članak 108. ako u stavku 3. stoji da se zahvati koji su nabrojani, a među njima i rekonstrukcija zidova, ne odnose na Park-šumu Marjan, ali nismo dobili njegov odgovor do zaključenja ovog teksta.

Nastavlja se proces oko slučaja Ježinac, gdje je prije negoli su na parcelu došli bageri, bila gusta vegetacija u terasama vrtova.

Nakon građevinske inspekcije (koja je rekla da se radi prema glavnom projektu), nadzor je obavila i inspekcija zaštite prirode. Iz odgovora Državnog inspektorata ispada da njima nije sporan investitor koji je odnio komad brda, srušio zidove i iščupao zelenilo, nego županijski Upravni odjel za zaštitu okoliša, komunalne poslove, infrastrukturu i investicije, koji je odbio izdati dopuštenje za obavljanje radova.

- Inspekcija zaštite prirode izvršila je inspekcijski nadzor na lokaciji, pri čemu je uočen mogući nesklad izdane dokumentacije nadležnih. Stoga je, sukladno članku 205. stavak 1. Zakona o zaštiti prirode, inspekcija zaštite prirode zatražila od Ministarstva gospodarstva i održivog razvoja provođenje upravnog nadzora nad radom nadležnog upravnog odjela u konkretnom predmetu, a koji je izdao i Potvrdu i Rješenje - glasi odgovor iz Državnog inspektorata.

Da pojasnimo, županijski Upravni odjel je 12. kolovoza 2020. godine izdao Potvrdu kojom se odobrava Glavni projekt, da bi potom 10. lipnja 2021. izdao Rješenje kojim je odbio izdati dopuštenje za izvođenje radova rekonstrukcije potpornih i ogradnih zidova.

Kako doznajemo od Marije Vuković, pročelnice Upravnog odjela, za istu katastarsku česticu 9335/1 investitor je zatražio dvije dozvole.

Najprije je investitoru za gornji dio izdana građevinska dozvola za rekonstrukciju rampe i pomoćnu kućicu. No, Grad je odbio izdati drugu građevinsku dozvolu, a ta je za rekonstrukciju potpornih zidova i ograde na južnoj strani. U postupku u kojem Grad nije izdao građevinsku dozvolu, županijski Upravni odjel dao je Potvrdu u kolovozu 2020., u kojoj su naglasili da "potvrda vrijedi ako je predmetni zahvat sukladan s važećom prostorno-planskom dokumentacijom grada Splita".

- Nakon što su odbili izdati građevinsku dozvolu, nas su iz Grada u nekoliko navrata kontaktirali za novi postupak, a mi smo uvijek inzistirali da nam se kaže o kakvom se postupku radi.

Dok smo uporno čekali da nam se objasni, da bismo se mogli pravo očitovati, investitor je počeo s radovima, i to na osnovi Potvrde koju su od nas dobili za postupak u kojem je odbijena građevinska dozvola. Radi se o zloupotrebljavanju naše Potvrde od strane Grada - objašnjava Marija Vuković i dodaje da inspekcija nije izvršila uvid u kompletni spis predmeta, nego u ono što im je investitor pokazao.

U lipnju je investitor zatražio dopuštenje od Županije da mogu izvoditi radove rekonstrukcije zidova kad je već debelo "ogulio" teren, ali ga nisu dobili.

Selektivno tumačenje

- Mi drukčije postupamo ako ide građevinska dozvola, a drukčije kad ide naše dopuštenje u kojem dajemo uvjete. U spisu predmeta nije bilo uporabne dozvole koja bi dokazivala da su zidovi postojeći, tako da su stariji od 1968. godine.

U međuvremenu su u potpunosti uklonjeni svi zidovi. Odbili smo izdati dopuštenje, jer se u toj situaciji nije moglo govoriti o rekonstrukciji nego o izgradnji zahvata.

Grad Split selektivno čita GUP, oni su trebali odrediti je li potrebna zaštita okoliša u zaštićenom području. Da se Grad i njegov Upravni odjel pridržavaju odredbi GUP-a, ovo se ne bi dogodilo.

Pročelnik Boris Marelja zanemaruje članke GUP-a po kojima se zahvati ove vrste ne mogu izvoditi bez plana posebnih obilježja (PPPPO-a) i bez Plana za gospodarenje park-šumom, koji ne postoje. On se samo poziva na članak 108. A što je s člankom 105., koji točno navodi sadržaje koji se mogu graditi do izrade provedbenih dokumenata - kazuje Marija Vuković.

Je li upravni odjel Grada "labavo" tumači odredbe GUP-a, upitali smo pročelnika Borisa Marelju. On nam je kazao da je u veljači 2020. izdana građevna dozvola za rekonstrukciju dviju postojećih građevina (prilaznu rampu s pomoćnim prostorijama ispod nje i građevinu pomoćne namjene), i to u postojećim gabaritima. Naveo je da GUP određuje kako se sve postojeće građevine mogu rekonstruirati, pa tako i one u park-šumi.

Opasni zidovi

U srpnju 2020. je Upravni odjel odbacio zahtjev da se i za potporne zidove na južnoj strani izda građevinska dozvola jer se za to ne izdaje, kaže Marelja i objašnjava da se zidovi takve visine mogu raditi prema pravilniku o jednostavnim građevinama.

- Dana 29. ožujka ove godine investitor je prijavio početak izvođenja radova, čime je udovoljio svim zakonom predviđenim radnjama - ističe pročelnik.

- Odredbom članka 108. Generalnog urbanističkog plana Splita određena je rekonstrukcija građevina čija je namjena protivna planiranoj namjeni, dopušta se sanacija postojećih ograda i potpornih zidova radi sanacije terena. Iako navedeni članak dopušta i minorne izmjene gabarita građevine, isto se ne odnosi na građevine u Park-šumi Marjan, koje se mogu rekonstruirati u postojećim gabaritima - napominje Marelja, koji dodaje da su postojeći zidovi bili popucali i predstavljali opasnost.

Nakon tog odgovora poslali smo Marelji prije dva dana upit zašto se poziva na članak 108. ako u stavku 3. stoji da se zahvati koji su nabrojani, a među njima i rekonstrukcija zidova, ne odnose na Park-šumu Marjan, ali nismo dobili njegov odgovor do zaključenja ovog teksta.
