Lidija Horvat je ​bivša kandidatkinja za Vrhovni sud i nova odvjetnica Zdravka Mamića. Njezin prvi potez je bio da je podnijela Državnom sudbenom vijeću zahtjev za sudjelovanjem u pokretanju stegovnom postupka za suce.

”Podnijeli smo zahtjev za sudjelovanjem u postupku. Smatramo da imamo pravni interes i to dosta jak. Načelo pravnog interesa nalaže pravo na sudjelovanje u postupku svakoj osobi koja ima neko svoje subjektivno pravo, koje je opravdano prihvatljivo, konkretno i u području prava. Nama je to jako važno zbog postupka pred Ustavnim sudom”, rekla je Horvat.

”To uključuje i uvid u isprave koje su u spisu, a i sudjelovanje u postupku. Znači da bismo imali uvid u očitovanja sudaca, tijek stegovnog postupka i u odluku. To je sve jako važno za korištenje tijekom dokazivanja povrede ljudskim prava, i pred Ustavnim sudom i europskim sudom”, dodala je Horvat.

‘Presuda koja ima takve manjkavosti ne može opstati’

Smatra kako je sporost USKOK-a neprihvatljiva s obzirom na snažnu poruku koja se time šalje, s obzirom na jačinu dokaza koja je priložena u spis, koja nije priložena samo sada, nego još 8. listopada 2020. godine.

”Smatram da su tu trebale biti provedene žurne radnje, koje očigledno nisu do sada”, rekla je Horvat za RTL.

Odvjetnica kaže kako je teško govoriti o razlozima zašto je bivši čelnik Dinama tek sada sa svim izašao u javnost.

”Ono što je jako važno je da presuda koja ima takve manjkavosti, takve grube povrede, ne može opstati. Ako se dokaže zaista ova korumpiranost, ove u najmanju ruku pristrane odluke i radnje sudaca, takva presuda ima tako jaku nevaljanu podlogu da ona ne može u ime Republike Hrvatske ostati na snazi”, izjavila je nova odvjetnica Zdravka Mamića.

‘Da sam na mjestu Zlate Đurđević, poštovala bih zakonsku proceduru’

Brojni političari su sve komentirali, a Mamićev tim vjeruje da je sve dobra podloga za rušenje presude. Pravo na suđenje od strane neovisnog i nepristranog suda je jedno od temeljnih ljudskih prava, naglašava Horvat. Odvjetnica je komentirala i napetosti između Milanovića i Plenkovića zbog izbora za Vrhovni sud.

”Kao što znate, bila sam i kandidatkinja, javila sam se na javni poziv i moram priznati da me jako zasmetalo što se događalo i na koji način se to ispolitiziralo i na koji način je to prezentirano u javnosti. Pa i način na koji se o kandidatima pričalo. Mislim da u jednoj demokratskoj zemlji se to ne bi smjelo događati. Govorimo o tome da osobe zadovoljavaju sve kriterije koje se traže za javni poziv i govorimo o tome da sada kada javni poziv bude ponovo raspisan, se nitko neće željeti javiti. S obzirom na to da se ishod zna”, komentirala je Horvat.

Tvrdi kako se ona više neće javiti na javni poziv jer smatra da se tek sad zbunjuje narod i šalje se loša poruka. Poruka da se ne treba javljati na javne pozive i da se na tom javnom pozivu neće odabrati najbolji. Ne misli pritom na gospođu Đurđević, već je kritična prema proceduri.

Procedura koja se na taj način provodi ne daje demokratsko pravo, smatra Horvat, da se između 50 ili 100 kandidata izabere najbolji.

”Da sam ja na mjestu Zlate Đurđević ja bi poštovala zakonsku proceduru”, izjavila je Horvat.

Lidija Horvat je ​bivša kandidatkinja za Vrhovni sud i nova odvjetnica Zdravka Mamića. Njezin prvi potez je bio da je podnijela Državnom sudbenom vijeću zahtjev za sudjelovanjem u pokretanju stegovnom postupka za suce.

”Podnijeli smo zahtjev za sudjelovanjem u postupku. Smatramo da imamo pravni interes i to dosta jak. Načelo pravnog interesa nalaže pravo na sudjelovanje u postupku svakoj osobi koja ima neko svoje subjektivno pravo, koje je opravdano prihvatljivo, konkretno i u području prava. Nama je to jako važno zbog postupka pred Ustavnim sudom”, rekla je Horvat.

”To uključuje i uvid u isprave koje su u spisu, a i sudjelovanje u postupku. Znači da bismo imali uvid u očitovanja sudaca, tijek stegovnog postupka i u odluku. To je sve jako važno za korištenje tijekom dokazivanja povrede ljudskim prava, i pred Ustavnim sudom i europskim sudom”, dodala je Horvat.

‘Presuda koja ima takve manjkavosti ne može opstati’

Smatra kako je sporost USKOK-a neprihvatljiva s obzirom na snažnu poruku koja se time šalje, s obzirom na jačinu dokaza koja je priložena u spis, koja nije priložena samo sada, nego još 8. listopada 2020. godine.

”Smatram da su tu trebale biti provedene žurne radnje, koje očigledno nisu do sada”, rekla je Horvat za RTL.

Odvjetnica kaže kako je teško govoriti o razlozima zašto je bivši čelnik Dinama tek sada sa svim izašao u javnost.

”Ono što je jako važno je da presuda koja ima takve manjkavosti, takve grube povrede, ne može opstati. Ako se dokaže zaista ova korumpiranost, ove u najmanju ruku pristrane odluke i radnje sudaca, takva presuda ima tako jaku nevaljanu podlogu da ona ne može u ime Republike Hrvatske ostati na snazi”, izjavila je nova odvjetnica Zdravka Mamića.

‘Da sam na mjestu Zlate Đurđević, poštovala bih zakonsku proceduru’

Brojni političari su sve komentirali, a Mamićev tim vjeruje da je sve dobra podloga za rušenje presude. Pravo na suđenje od strane neovisnog i nepristranog suda je jedno od temeljnih ljudskih prava, naglašava Horvat. Odvjetnica je komentirala i napetosti između Milanovića i Plenkovića zbog izbora za Vrhovni sud.

”Kao što znate, bila sam i kandidatkinja, javila sam se na javni poziv i moram priznati da me jako zasmetalo što se događalo i na koji način se to ispolitiziralo i na koji način je to prezentirano u javnosti. Pa i način na koji se o kandidatima pričalo. Mislim da u jednoj demokratskoj zemlji se to ne bi smjelo događati. Govorimo o tome da osobe zadovoljavaju sve kriterije koje se traže za javni poziv i govorimo o tome da sada kada javni poziv bude ponovo raspisan, se nitko neće željeti javiti. S obzirom na to da se ishod zna”, komentirala je Horvat.

Tvrdi kako se ona više neće javiti na javni poziv jer smatra da se tek sad zbunjuje narod i šalje se loša poruka. Poruka da se ne treba javljati na javne pozive i da se na tom javnom pozivu neće odabrati najbolji. Ne misli pritom na gospođu Đurđević, već je kritična prema proceduri.

Procedura koja se na taj način provodi ne daje demokratsko pravo, smatra Horvat, da se između 50 ili 100 kandidata izabere najbolji.

”Da sam ja na mjestu Zlate Đurđević ja bi poštovala zakonsku proceduru”, izjavila je Horvat.

Lidija Horvat, nova odvjetnica Zdravka Mamića: Ako se dokaže korumpiranost sudaca, presuda je nevaljana

Lidija Horvat je ​bivša kandidatkinja za Vrhovni sud i nova odvjetnica Zdravka Mamića. Njezin prvi potez je bio da je podnijela Državnom sudbenom vijeću zahtjev za sudjelovanjem u pokretanju stegovnom postupka za suce.

”Podnijeli smo zahtjev za sudjelovanjem u postupku. Smatramo da imamo pravni interes i to dosta jak. Načelo pravnog interesa nalaže pravo na sudjelovanje u postupku svakoj osobi koja ima neko svoje subjektivno pravo, koje je opravdano prihvatljivo, konkretno i u području prava. Nama je to jako važno zbog postupka pred Ustavnim sudom”, rekla je Horvat.

”To uključuje i uvid u isprave koje su u spisu, a i sudjelovanje u postupku. Znači da bismo imali uvid u očitovanja sudaca, tijek stegovnog postupka i u odluku. To je sve jako važno za korištenje tijekom dokaziva...
