Protiv 41-godišnjeg Jerka Čukušića iz Solina, koji je radio kao poreznik u zagrebačkoj ispostavi Dubrava, a koji je imao ili ima i svoje firme za prodaju vozila po Dalmaciji, Županijsko državno odvjetništvo u Splitu je, nakon provedene istrage, podiglo pred Županijskim sudom u Splitu optužnicu.

Čukušić je optužen zbog počinjenja kaznenog djela zlouporabe povjerenja u gospodarskom poslovanju, krivotvorenja poslovne isprave, utaje poreza i kaznenog djela pranja novca.

Optužnicom se okrivljeniku stavlja na teret da je od 1. siječnja 2017. do 30. rujna 2018. nakon što je njegovo trgovačko društvo “Gold Cars” d.o.o. iz Solina u svrhu daljnje prodaje uvezlo iz zemalja Europske unije najmanje devedeset osam vozila, sastavio fiktivne račune trgovačkog društva u kojima je prodajnu cijenu uvećao za porez na dodanu vrijednost i u nakani izbjegavanja plaćanja poreza, u poslovnim knjigama trgovačkog društva nije knjižio ove račune i nije obračunao, prijavio, niti uplatio u državni proračun Republike Hrvatske u računima iskazani porez na dodanu vrijednost.

Navedene račune okrivljenik je predavao kupcima koji su mu u gotovini plaćali na ruke ili s njim povezanim osobama, a taj je novac okrivljenik potom neosnovano za sebe zadržao i nije ga uplatio na račun trgovačkog društva, niti je u poslovnim knjigama trgovačkog društva knjižio tako sastavljene račune.

Držanje za sebe

Trgovačko društvo nije obračunalo, niti prijavilo i nije platilo u računima iskazani porez na dodanu vrijednost koji je okrivljenik neosnovano zadržao za sebe.

Čukušić je, tereti ga se, na prethodno opisani način, prodajom devedeset osam osobnih vozila od kupaca primio u gotovini iznos od 3.913.262,14 kuna koji nije uplatio na račun trgovačkog društva, te u poslovnim knjigama trgovačkog društva, koje je porezni obveznik prema državnom proračunu Republike Hrvatske, nije knjižio tako sastavljene račune te nije obračunao, niti na račun trgovačkog društva uplatio po takvim računima plaćeni porez na dodanu vrijednost u iznosu od 1.981.741,25 kuna, kao ni porez na dobit od 64.026,97 kuna.

Okrivljenik je za ukupan iznos poreza od 2.045.768,04 kuna oštetio državni proračun Republike Hrvatske. U poslovanju trgovačkog društva d.o.o. Solin Čukušić je pretplatio iznos dobavljačima za 1.593.302,21 kunu. Okrivljenik je počinjenjem ovog kaznenog djela na štetu trgovačkog društva pribavio nepripadnu imovinsku korist u ukupnom iznosu od 7.648,88 kuna.

Stavljanje na teret

Okrivljeniku se stavlja na teret da je od 6. veljače 2017. do 30. rujnu 2018. na području Županije splitsko-dalmatinske, u vrijeme kada se svi njegovi osobni računi nalaze u trajnoj blokadi od 2012. godine s nepodmirenim osobnim obvezama od 581.686,25 kuna, za vrijeme i nakon počinjenja kaznenog djela kojim je neosnovano na štetu trgovačkog društva pribavio iznos od 14.636.431,44 kuna, u nakani prikazivanja da je ova sredstva zakonito stekao, uplaćivao ih i koristio u poslovanju trgovačkog društva u kojem je okrivljenik jedini osnivač i direktor.

Tereti ga se da je u poslovnim knjigama trgovačkog društva takve uplate knjižio kao vlastite pozajmice stvarajući obvezu i dug trgovačkog društva prema njemu, a ta je sredstva trgovačko društvo koristilo u poslovanju uvoza i prodaje vozila. Okrivljeniku je po ovako stvorenoj obvezi s osnova vraćanja pozajmica s računa trgovačkog društva isplaćen iznos od najmanje 3.136.974,73 kune.

Protiv 41-godišnjeg Jerka Čukušića iz Solina, koji je radio kao poreznik u zagrebačkoj ispostavi Dubrava, a koji je imao ili ima i svoje firme za prodaju vozila po Dalmaciji, Županijsko državno odvjetništvo u Splitu je, nakon provedene istrage, podiglo pred Županijskim sudom u Splitu optužnicu.

Čukušić je optužen zbog počinjenja kaznenog djela zlouporabe povjerenja u gospodarskom poslovanju, krivotvorenja poslovne isprave, utaje poreza i kaznenog djela pranja novca.

Optužnicom se okrivljeniku stavlja na teret da je od 1. siječnja 2017. do 30. rujna 2018. nakon što je njegovo trgovačko društvo “Gold Cars” d.o.o. iz Solina u svrhu daljnje prodaje uvezlo iz zemalja Europske unije najmanje devedeset osam vozila, sastavio fiktivne račune trgovačkog društva u kojima je prodajnu cijenu uvećao za porez na dodanu vrijednost i u nakani izbjegavanja plaćanja poreza, u poslovnim knjigama trgovačkog društva nije knjižio ove račune i nije obračunao, prijavio, niti uplatio u državni proračun Republike Hrvatske u računima iskazani porez na dodanu vrijednost.

Navedene račune okrivljenik je predavao kupcima koji su mu u gotovini plaćali na ruke ili s njim povezanim osobama, a taj je novac okrivljenik potom neosnovano za sebe zadržao i nije ga uplatio na račun trgovačkog društva, niti je u poslovnim knjigama trgovačkog društva knjižio tako sastavljene račune.

Držanje za sebe

Trgovačko društvo nije obračunalo, niti prijavilo i nije platilo u računima iskazani porez na dodanu vrijednost koji je okrivljenik neosnovano zadržao za sebe.

Čukušić je, tereti ga se, na prethodno opisani način, prodajom devedeset osam osobnih vozila od kupaca primio u gotovini iznos od 3.913.262,14 kuna koji nije uplatio na račun trgovačkog društva, te u poslovnim knjigama trgovačkog društva, koje je porezni obveznik prema državnom proračunu Republike Hrvatske, nije knjižio tako sastavljene račune te nije obračunao, niti na račun trgovačkog društva uplatio po takvim računima plaćeni porez na dodanu vrijednost u iznosu od 1.981.741,25 kuna, kao ni porez na dobit od 64.026,97 kuna.

Okrivljenik je za ukupan iznos poreza od 2.045.768,04 kuna oštetio državni proračun Republike Hrvatske. U poslovanju trgovačkog društva d.o.o. Solin Čukušić je pretplatio iznos dobavljačima za 1.593.302,21 kunu. Okrivljenik je počinjenjem ovog kaznenog djela na štetu trgovačkog društva pribavio nepripadnu imovinsku korist u ukupnom iznosu od 7.648,88 kuna.

Stavljanje na teret

Okrivljeniku se stavlja na teret da je od 6. veljače 2017. do 30. rujnu 2018. na području Županije splitsko-dalmatinske, u vrijeme kada se svi njegovi osobni računi nalaze u trajnoj blokadi od 2012. godine s nepodmirenim osobnim obvezama od 581.686,25 kuna, za vrijeme i nakon počinjenja kaznenog djela kojim je neosnovano na štetu trgovačkog društva pribavio iznos od 14.636.431,44 kuna, u nakani prikazivanja da je ova sredstva zakonito stekao, uplaćivao ih i koristio u poslovanju trgovačkog društva u kojem je okrivljenik jedini osnivač i direktor.

Tereti ga se da je u poslovnim knjigama trgovačkog društva takve uplate knjižio kao vlastite pozajmice stvarajući obvezu i dug trgovačkog društva prema njemu, a ta je sredstva trgovačko društvo koristilo u poslovanju uvoza i prodaje vozila. Okrivljeniku je po ovako stvorenoj obvezi s osnova vraćanja pozajmica s računa trgovačkog društva isplaćen iznos od najmanje 3.136.974,73 kune.

Protiv 41-godišnjeg Jerka Čukušića iz Solina, koji je radio kao poreznik u zagrebačkoj ispostavi Dubrava, a koji je imao ili ima i svoje firme za prodaju vozila po Dalmaciji, Županijsko državno odvjetništvo u Splitu je, nakon provedene istrage, podiglo pred Županijskim sudom u Splitu optužnicu.

Čukušić je optužen zbog počinjenja kaznenog djela zlouporabe povjerenja u gospodarskom poslovanju, krivotvorenja poslovne isprave, utaje poreza i kaznenog djela pranja novca.

Optužnicom se okrivljeniku stavlja na teret da je od 1. siječnja 2017. do 30. rujna 2018. nakon što je njegovo trgovačko društvo “Gold Cars” d.o.o. iz Solina u svrhu daljnje prodaje uvezlo iz zemalja Europske unije najmanje devedeset osam vozila, sastavio fiktivne račune trgovačkog društva u kojima je prodajnu c...
