Vrhovni sud završio je u ponedjeljak prijepodne javni dio sjednice u aferi Spice nakon koje će "u razumnom roku" donijeti odluku o žalbama na napravomoćnu presudu iz 2016. godine.

Bivši potpredsjednik vlade Damir Polančec i sedmorica suokrivljenika tada su oslobođeni optužbe da su pokušali preuzeti vlasništvo nad Podravkom te ju pritom oštetili za gotovo 400 milijuna kuna.

Iako su nepravomoćnom presudom zagrebačkog Županijskog suda oslobođeni za pokušaj preuzimanje Podravke tvrtkinim novcem, četvorica optuženih proglašeni su krivima da su Podravku oštetili dajući 65 milijuna kuna zajma splitskoj tvrtki SMS.

Uz Polančeca i bivše čelnike koprivničke tvrtke Darka Marinca, Zdravka Šestaka, Josipa Pavlovića i Sašu Romca, Uskok je u tzv. aferi Spice teretio vlasnika i direktora splitske tvrtke SMS Srđana Mladinića, suvlasnika varaždinske Fima Grupe Milana Horvata te odvjetnika Zorana Markovića.

Za zajam SMS-u kojim je Podravka oštećena za 65 milijuna kuna Marinac je osuđen na dvije godine zatvora, Šestak i Pavlović na 10, odnosno devet mjeseci koje mogu zamijeniti društveno korisnim radom, a Mladinić na šest mjeseci zatvora uvjetno, uz rok kušnje od dvije godine. Marinac, postane li presuda pravomoćna, Podravci mora vratiti 65 milijuna kuna, a ostala trojica nešto više od 10 milijuna kuna.

"U ponedjeljak je održan javni dio sjednice u povodu žalbi Uskoka i nekih okrivljenika. To je završilo i krenuo je najavni dio na kojoj će suci Vrhovnog suda donijeti odluku", izjavio je Hini Polančecov odvjetnik Anto Nobilo.

Polančecov odvjetnik očekuje da će Vrhovni sud pravomoćno okončati slučaj

Kazao je kako je predsjednik vijeća sudac Damir Kos najavio da će Vrhovni sud odluku donijeti u "razumnom roku".

"To je fleksibilan termin", kazao je Nobilo, ističući kako očekuje da će Vrhovni sud predmet pravomoćno okončati, posebno jer je riječ o slučaju iz 2009. kada je Polančec bio pritvoren kao prvi član vlade osumnjičen u nekoj kriminalnoj aferi.

Vrhovni sud nepravomoćnu presudu može potvrditi, preinačiti ili ukinuti što bi značilo da se treba ponoviti suđenje koje je bilo jedno od najdugotrajnijih i najsloženijih u hrvatskoj pravosudnoj praksi.

Počelo je u lipnju 2011. a u pet godina postupka održano je oko 300 rasprava i ispitano preko 130 svjedoka. Sudski spis imao je rekordnih 50 tisuća stranica. Zabilježen je i rekord u iznošenju obrana. Tako je primjerice Šestak svoju obranu iznosio čak 32 dana, a Polančec deset.

Optuženici i njihovi odvjetnici su od početka isticali da tužiteljstvo nema dokaz ni za jednu tvrdnju iz optužnice. Optužbe da su se udružili kako bi preuzeli većinsko vlasništvo nad Podravkom odbacivali su riječima da su koprivničku prehrambenu tvrtku tek branili od neprijateljskog preuzimanja.

Vrhovni sud završio je u ponedjeljak prijepodne javni dio sjednice u aferi Spice nakon koje će "u razumnom roku" donijeti odluku o žalbama na napravomoćnu presudu iz 2016. godine.

Bivši potpredsjednik vlade Damir Polančec i sedmorica suokrivljenika tada su oslobođeni optužbe da su pokušali preuzeti vlasništvo nad Podravkom te ju pritom oštetili za gotovo 400 milijuna kuna.

Iako su nepravomoćnom presudom zagrebačkog Županijskog suda oslobođeni za pokušaj preuzimanje Podravke tvrtkinim novcem, četvorica optuženih proglašeni su krivima da su Podravku oštetili dajući 65 milijuna kuna zajma splitskoj tvrtki SMS.

Uz Polančeca i bivše čelnike koprivničke tvrtke Darka Marinca, Zdravka Šestaka, Josipa Pavlovića i Sašu Romca, Uskok je u tzv. aferi Spice teretio vlasnika i direktora splitske tvrtke SMS Srđana Mladinića, suvlasnika varaždinske Fima Grupe Milana Horvata te odvjetnika Zorana Markovića.

Za zajam SMS-u kojim je Podravka oštećena za 65 milijuna kuna Marinac je osuđen na dvije godine zatvora, Šestak i Pavlović na 10, odnosno devet mjeseci koje mogu zamijeniti društveno korisnim radom, a Mladinić na šest mjeseci zatvora uvjetno, uz rok kušnje od dvije godine. Marinac, postane li presuda pravomoćna, Podravci mora vratiti 65 milijuna kuna, a ostala trojica nešto više od 10 milijuna kuna.

"U ponedjeljak je održan javni dio sjednice u povodu žalbi Uskoka i nekih okrivljenika. To je završilo i krenuo je najavni dio na kojoj će suci Vrhovnog suda donijeti odluku", izjavio je Hini Polančecov odvjetnik Anto Nobilo.

Polančecov odvjetnik očekuje da će Vrhovni sud pravomoćno okončati slučaj

Kazao je kako je predsjednik vijeća sudac Damir Kos najavio da će Vrhovni sud odluku donijeti u "razumnom roku".

"To je fleksibilan termin", kazao je Nobilo, ističući kako očekuje da će Vrhovni sud predmet pravomoćno okončati, posebno jer je riječ o slučaju iz 2009. kada je Polančec bio pritvoren kao prvi član vlade osumnjičen u nekoj kriminalnoj aferi.

Vrhovni sud nepravomoćnu presudu može potvrditi, preinačiti ili ukinuti što bi značilo da se treba ponoviti suđenje koje je bilo jedno od najdugotrajnijih i najsloženijih u hrvatskoj pravosudnoj praksi.

Počelo je u lipnju 2011. a u pet godina postupka održano je oko 300 rasprava i ispitano preko 130 svjedoka. Sudski spis imao je rekordnih 50 tisuća stranica. Zabilježen je i rekord u iznošenju obrana. Tako je primjerice Šestak svoju obranu iznosio čak 32 dana, a Polančec deset.

Optuženici i njihovi odvjetnici su od početka isticali da tužiteljstvo nema dokaz ni za jednu tvrdnju iz optužnice. Optužbe da su se udružili kako bi preuzeli većinsko vlasništvo nad Podravkom odbacivali su riječima da su koprivničku prehrambenu tvrtku tek branili od neprijateljskog preuzimanja.

Završen javni dio sjednice Vrhovnog suda o aferi Spice, odluka ‘u razumnom roku‘

Vrhovni sud završio je u ponedjeljak prijepodne javni dio sjednice u aferi Spice nakon koje će "u razumnom roku" donijeti odluku o žalbama na napravomoćnu presudu iz 2016. godine.

Bivši potpredsjednik vlade Damir Polančec i sedmorica suokrivljenika tada su oslobođeni optužbe da su pokušali preuzeti vlasništvo nad Podravkom te ju pritom oštetili za gotovo 400 milijuna kuna.

Iako su nepravomoćnom presudom zagrebačkog Županijskog suda oslobođeni za pokušaj preuzimanje Podravke tvrtkinim novcem, četvorica optuženih proglašeni su krivima da su Podravku oštetili dajući 65 milijuna kuna zajma splitskoj tvrtki SMS.

Uz Polančeca i bivše čelnike koprivničke tvrtke Darka Marinca, Zdravka Šestaka, Josipa Pavlovića i Sašu Romca, Uskok je u tzv. aferi Spice teretio vlasnika i dire...
