Ubojice obitelji Zec možda ipak dođu pred lice pravde. Za taj je zločin do sada osuđen jedino Tomislav Merčep. No izravni počinitelji, ljudi koji su te prosinačke noći 1991. povukli okidač, oslobođeni su. Iako su, netom nakon što su uhićeni, sve priznali. Ali iskaze su dali bez prisutnosti odvjetnika, pa ih je sud proglasio – nevažećima.

Odvjetnik Anto Nobilo tvrdi da postoji pravna mogućnost da im se, trideset godina nakon zločina, ipak sudi.

– Ne znam u kojem je trenutačno stanju spis o ovom slučaju. Dio osumnjičenika je umro, ne znam jesu li živi svjedoci koji su tada dali iskaze, no postoje dva načina da se postupak ponovno pokrene: da se pribavi neki novi dokaz i da ih se optuži za ratni zločin – kaže Nobilo, koji je u vrijeme ubojstva obitelji Zec bio šef kaznenog odjela na Okružnom javnom tužiteljstvu u Zagrebu.

– U trenutku kada su 1991. osumnjičenici privedeni, mi u Tužiteljstvu nismo znali razmjere djelovanja tog eskadrona smrti. Tužilaštvo je imalo samo ubojstvo te obitelji, a dosta toga je tada upućivalo na to da je podloga zločina bila pljačka. Međutim, kasnije se u slučaju Pakračke poljane pokazalo da su oni sustavno odvozili Srbe, i pritom ih naravno pljačkali, ali da je to bilo djelovanje koje se može okarakterizirati kao ratni zločin – pojašnjava.

Odluka na Vrhovnom sudu

Naknadno se dokazalo u suđenju Merčepu da je na taj način ubijeno 44 muškaraca, jedna žena i jedno dijete, a Merčep je tada po zapovjednoj odgovornosti osuđen i za obitelj Zec.

Vrhovni sud je, prema njegovim riječima, već u nekoliko navrata prihvatio i primijenio odredbe Haaškog suda, kojima je omogućeno suđenje za ratne zločine bez obzira što su nacionalni sudovi već prije donosili odluke za druga kaznena djela.

– Haag je time želio omesti nacionalna pravosuđa da osumnjičenicima za ratne zločine sude zbog nečeg drugog, a ne zbog ratnog zločina. Time se na neki način suspendira staro pravno načelo po kojemu se u istoj stvari ne može suditi dva puta. Vrhovni sud je već u nekoliko presuda odustao od tog principa pozvavši se na Statut Haaškog suda. Sada bi, naravno, trebalo vidjeti sve detalje i ispitati može li se ili ne pokrenuti novi postupak u slučaju likvidacije obitelji Zec – naglašava Nobilo. Taj posao bi trebalo obaviti Državno odvjetništvo.

Vladimir Šeks ovih je dana ustvrdio da su tadašnji tužitelji Nobilo i Tihomir Rubeša zapravo krivi jer su "propustili upozoriti istražnog suca da ne ispituje osumnjičene jer nema branitelja".

– Je li to učinjeno iz neznanja ili nečega drugoga, ja o tome ne mogu suditi, i nakon toga je sudsko vijeće zapisnik o ispitivanju okrivljenih bez branitelja izdvojilo iz spisa kao nezakonite dokaze. I to su onda postali bezvrijedni dokazi – ustvrdio je Šeks.

Nobilo pak tvrdi da to nije točno.

Tražili smo branitelja

– Šeks je stari manipulator. U to je doba Zakon o kaznenom postupku određivao da je obvezna obrana za kaznena djela za koje je predviđena smrtna kazna. A onda je božićnim Ustavom iz 1990. ukinuta smrtna kazna i uvedena maksimalna kazna od 20 godina. U toj situaciji Okružni sud na svojem Kolegiju sudaca istrage zauzima stav da više nema obveze za odvjetnikom. Suprotno tome, Tužilaštvo je smatralo da za najteža djela okrivljenik treba imati obranu od početka i upravo sam ja na Kolegiju taj stav elaborirao – kaže nam Nobilo.

Nakon što su merčepovci privedeni u Đorđićevu, ispitala su ih dva suca, a Nobilo je došao pomoći Rubeši, čiji je to bio slučaj.

– Tada smo vidjeli da nema branitelja, sucima istrage smo rekli naš stav: da branitelja mora biti s obzirom da je riječ o najtežim kaznenim djelima. Suci nam tada odgovaraju da oni smatraju da ne trebaju odvjetnici, nas dvojica inzistiramo i potom sutkinja Jolanka Nemeth, a već je bila noć, zove kući tadašnjeg predsjednika suda Vojka Madirazzu i kaže mu da tužitelji inzistiraju na odvjetnicima. On joj odgovara tko će sad zvati pet odvjetnika koje treba platiti. Ona je tada dobila direktnu naredbu predsjednika suda da se odvjetnici ne zovu, vratila se i rekla nam kakva je njihova odluka – pojašnjava Nobilo.

Jesu li tužitelji u situaciji u kojoj su još uvijek istragu vodili suci istrage mogli postupiti drukčije?

– To je bila odluka Okružnog suda, tužitelji tu nisu mogli ništa, i to Šeks jako dobro zna. Da smo tada donijeli odluku suprotnu zaključku Kolegija sudaca, nas bi sankcionirali. Tužitelji nisu slobodni strijelci – ističe Nobilo.

Ubojice obitelji Zec možda ipak dođu pred lice pravde. Za taj je zločin do sada osuđen jedino Tomislav Merčep. No izravni počinitelji, ljudi koji su te prosinačke noći 1991. povukli okidač, oslobođeni su. Iako su, netom nakon što su uhićeni, sve priznali. Ali iskaze su dali bez prisutnosti odvjetnika, pa ih je sud proglasio – nevažećima.

Odvjetnik Anto Nobilo tvrdi da postoji pravna mogućnost da im se, trideset godina nakon zločina, ipak sudi.

– Ne znam u kojem je trenutačno stanju spis o ovom slučaju. Dio osumnjičenika je umro, ne znam jesu li živi svjedoci koji su tada dali iskaze, no postoje dva načina da se postupak ponovno pokrene: da se pribavi neki novi dokaz i da ih se optuži za ratni zločin – kaže Nobilo, koji je u vrijeme ubojstva obitelji Zec bio šef kaznenog odjela na Okružnom javnom tužiteljstvu u Zagrebu.

– U trenutku kada su 1991. osumnjičenici privedeni, mi u Tužiteljstvu nismo znali razmjere djelovanja tog eskadrona smrti. Tužilaštvo je imalo samo ubojstvo te obitelji, a dosta toga je tada upućivalo na to da je podloga zločina bila pljačka. Međutim, kasnije se u slučaju Pakračke poljane pokazalo da su oni sustavno odvozili Srbe, i pritom ih naravno pljačkali, ali da je to bilo djelovanje koje se može okarakterizirati kao ratni zločin – pojašnjava.

Odluka na Vrhovnom sudu

Naknadno se dokazalo u suđenju Merčepu da je na taj način ubijeno 44 muškaraca, jedna žena i jedno dijete, a Merčep je tada po zapovjednoj odgovornosti osuđen i za obitelj Zec.

Vrhovni sud je, prema njegovim riječima, već u nekoliko navrata prihvatio i primijenio odredbe Haaškog suda, kojima je omogućeno suđenje za ratne zločine bez obzira što su nacionalni sudovi već prije donosili odluke za druga kaznena djela.

– Haag je time želio omesti nacionalna pravosuđa da osumnjičenicima za ratne zločine sude zbog nečeg drugog, a ne zbog ratnog zločina. Time se na neki način suspendira staro pravno načelo po kojemu se u istoj stvari ne može suditi dva puta. Vrhovni sud je već u nekoliko presuda odustao od tog principa pozvavši se na Statut Haaškog suda. Sada bi, naravno, trebalo vidjeti sve detalje i ispitati može li se ili ne pokrenuti novi postupak u slučaju likvidacije obitelji Zec – naglašava Nobilo. Taj posao bi trebalo obaviti Državno odvjetništvo.

Vladimir Šeks ovih je dana ustvrdio da su tadašnji tužitelji Nobilo i Tihomir Rubeša zapravo krivi jer su "propustili upozoriti istražnog suca da ne ispituje osumnjičene jer nema branitelja".

– Je li to učinjeno iz neznanja ili nečega drugoga, ja o tome ne mogu suditi, i nakon toga je sudsko vijeće zapisnik o ispitivanju okrivljenih bez branitelja izdvojilo iz spisa kao nezakonite dokaze. I to su onda postali bezvrijedni dokazi – ustvrdio je Šeks.

Nobilo pak tvrdi da to nije točno.

Tražili smo branitelja

– Šeks je stari manipulator. U to je doba Zakon o kaznenom postupku određivao da je obvezna obrana za kaznena djela za koje je predviđena smrtna kazna. A onda je božićnim Ustavom iz 1990. ukinuta smrtna kazna i uvedena maksimalna kazna od 20 godina. U toj situaciji Okružni sud na svojem Kolegiju sudaca istrage zauzima stav da više nema obveze za odvjetnikom. Suprotno tome, Tužilaštvo je smatralo da za najteža djela okrivljenik treba imati obranu od početka i upravo sam ja na Kolegiju taj stav elaborirao – kaže nam Nobilo.

Nakon što su merčepovci privedeni u Đorđićevu, ispitala su ih dva suca, a Nobilo je došao pomoći Rubeši, čiji je to bio slučaj.

– Tada smo vidjeli da nema branitelja, sucima istrage smo rekli naš stav: da branitelja mora biti s obzirom da je riječ o najtežim kaznenim djelima. Suci nam tada odgovaraju da oni smatraju da ne trebaju odvjetnici, nas dvojica inzistiramo i potom sutkinja Jolanka Nemeth, a već je bila noć, zove kući tadašnjeg predsjednika suda Vojka Madirazzu i kaže mu da tužitelji inzistiraju na odvjetnicima. On joj odgovara tko će sad zvati pet odvjetnika koje treba platiti. Ona je tada dobila direktnu naredbu predsjednika suda da se odvjetnici ne zovu, vratila se i rekla nam kakva je njihova odluka – pojašnjava Nobilo.

Jesu li tužitelji u situaciji u kojoj su još uvijek istragu vodili suci istrage mogli postupiti drukčije?

– To je bila odluka Okružnog suda, tužitelji tu nisu mogli ništa, i to Šeks jako dobro zna. Da smo tada donijeli odluku suprotnu zaključku Kolegija sudaca, nas bi sankcionirali. Tužitelji nisu slobodni strijelci – ističe Nobilo.
