Opća bolnica isplatila je više od pola milijuna kuna odštete zbog liječničke pogreške tijekom poroda, zbog koje je dijete trajno ostalo osoba s invaliditetom, piše Danica.hr.
No, kako se djetetu godinama nakon tog slučaja stanje opet pogoršalo, obitelj je podnijela novu tužbu protiv bolnice, a sud im dao za pravo i u nepravomoćnoj presudi odlučio da trebaju dobiti dodatnu odštetu. Koliku – znat će se nakon okončanja postupka.
U tužbi i tijekom postupka obitelj je navela kako je je uslijed liječničkog propusta pri porodu majke tijekom 2007. godjne kod djeteta “došlo do pareze preksusa brahijalisa, te je obitelj 2009. pokrenula postupak protiv Opće bolnice u Virovitici”.
Postupak se, međutim, vodio nevjerojatno dugo i sporo – sve do svibnja 2015. godine kad virovitička bolnica i obitelj sklapaju sudsku nagodbu kojom bolnica pristaje obitelji isplatiti više od 500.000 kuna odštete.
Osim toga, bolnica se obvezala dječaku plaćati 2500 kuna mjesečne rente sve do kraja školovanja. A nakon punoljetnosti, odnosno redovnog školovanja, u slučaju da se utvrdi trajna nesposobnost za rad uslijed komplikacija tijekom poroda, stranke su se obvezale sporazumno definirati model i način obeštećenja.
“Nakon zaključenja sudske nagodbe, zdravstveno stanje djeteta se pogoršalo tako da je u potpunosti izgubio funkciju desnog ramena, odnosno došlo je do dislokacije humeralne glave s displazijom glenoida.
Zbog toga je dijete podvrgnuto iznimno rizičnom i složenom operativnom zahvatu u ortopedskoj bolnici Spital Speising u Beču”, navodi se u današnjoj nepravomoćnoj presudi.
Sudac je, tako, u petak zaključio kako “postoji obveza tužene Opće bolnice Virovitica, nadoknaditi štetu tužitelju maloljetniku nastalu uslijed pogoršanja zdravstvenog stanja nakon zaključenja sudske nagodbe, a za koje se u vrijeme zaključenja sudske nagodbe nije moglo znati, niti isto predvidjeti”.
Međupresuda je nepravomoćna i Opća bolnica u Virovitici na nju ima pravo žalbe u zakonskom roku od 14 dana od primitka.

Opća bolnica isplatila je više od pola milijuna kuna odštete zbog liječničke pogreške tijekom poroda, zbog koje je dijete trajno ostalo osoba s invaliditetom, piše Danica.hr.
No, kako se djetetu godinama nakon tog slučaja stanje opet pogoršalo, obitelj je podnijela novu tužbu protiv bolnice, a sud im dao za pravo i u nepravomoćnoj presudi odlučio da trebaju dobiti dodatnu odštetu. Koliku – znat će se nakon okončanja postupka.
U tužbi i tijekom postupka obitelj je navela kako je je uslijed liječničkog propusta pri porodu majke tijekom 2007. godjne kod djeteta “došlo do pareze preksusa brahijalisa, te je obitelj 2009. pokrenula postupak protiv Opće bolnice u Virovitici”.
Postupak se, međutim, vodio nevjerojatno dugo i sporo – sve do svibnja 2015. godine kad virovitička bolnica i obitelj sklapaju sudsku nagodbu kojom bolnica pristaje obitelji isplatiti više od 500.000 kuna odštete.
Osim toga, bolnica se obvezala dječaku plaćati 2500 kuna mjesečne rente sve do kraja školovanja. A nakon punoljetnosti, odnosno redovnog školovanja, u slučaju da se utvrdi trajna nesposobnost za rad uslijed komplikacija tijekom poroda, stranke su se obvezale sporazumno definirati model i način obeštećenja.
“Nakon zaključenja sudske nagodbe, zdravstveno stanje djeteta se pogoršalo tako da je u potpunosti izgubio funkciju desnog ramena, odnosno došlo je do dislokacije humeralne glave s displazijom glenoida.
Zbog toga je dijete podvrgnuto iznimno rizičnom i složenom operativnom zahvatu u ortopedskoj bolnici Spital Speising u Beču”, navodi se u današnjoj nepravomoćnoj presudi.
Sudac je, tako, u petak zaključio kako “postoji obveza tužene Opće bolnice Virovitica, nadoknaditi štetu tužitelju maloljetniku nastalu uslijed pogoršanja zdravstvenog stanja nakon zaključenja sudske nagodbe, a za koje se u vrijeme zaključenja sudske nagodbe nije moglo znati, niti isto predvidjeti”.
Međupresuda je nepravomoćna i Opća bolnica u Virovitici na nju ima pravo žalbe u zakonskom roku od 14 dana od primitka.
