Odvjetnici Kazimira Bačića, uhićenog u ovotjednoj antikorupcijskoj akciji Uskoka i policije, reagirali su na postupak njegova razrješenja s mjesta glavnog ravnatelja HRT-a koji je u petak pokrenut na sjednici Nadzornog odbora javne radiotelevizije.

U priopćenju koje donosi N1 potvrđuju da je Bačić uhićen u sklopu postupanja Uskoka te da mu je određen istražni zatvor zbog opasnosti od utjecaja na svjedoke koje će se u narednom kraćem razdoblju ispitati.

Osvrnuli su se i na pravni položaj u kojem se trenutno nalazi njihov klijent. Kažu da kazneni postupak protiv Bačića još uvijek nije započeo jer on započinje pravomoćnošću rješenja o provođenju istrage, a što u konkretnom slučaju još nije postignuto.

Pišu i da je Županijski sud u Zagrebu prihvatio prijedlog Uskoka da se Bačiću odredi istražni zatvor zbog opasnosti od utjecaja na svjedoke, a “odbio prijedlog Uskoka za određivanje istražnog zatvora zbog opasnosti da bi g. Kazimir Bačić, kao glavni ravnatelj Hrvatske radiotelevizije, daljnjim radom na svom radnom mjestu mogao počiniti neko novo kazneno djelo”.

- Ukoliko uzmemo u obzir ranije navedeno, razvidno je kako kazneni postupak u odnosu na glavnog ravnatelja Hrvatske radiotelevizije još uvijek nije započeo, obzirom ne postoji pravomoćno rješenje o provođenju istrage, te je sud odbio navode USKOK-a o postojanju opasnosti od učina kaznenog djela povratkom g. Kazimira Bačića, nakon što se saslušaju predloženi svjedoci, na svoje radno mjesto glavnog ravnatelja Hrvatske radiotelevizije.

Kad navedenom dodamo činjenicu kako u odnosu na g. Kazimira Bačića u potpunosti egzistira presumpcija nevinosti, propisana i zajamčena svakom hrvatskom građaninu čl. 28. Ustava Republike Hrvatske, u kojem stoji kako je svatko nedužan i nitko ga ne može smatrati krivim za kazneno djelo dok mu se pravomoćnom sudskom presudom ne utvrdi krivnja, te čl. 3. st. 1. Zakona o kaznenom postupku, koji navedeno identično propisuje, tada je sasvim razvidno kako ne postoje razlozi za pokretanjem postupka razrješenja g. Kazimira Bačića s mjesta Glavnog ravnatelja Hrvatske radiotelevizije, pišu odvjetnici.

Naglašavaju i da Zakon o kaznenom postupku određuje da, ukoliko je propisano pokretanje kaznenog postupka, za posljedicu ima ograničavanje određenih prava te da posljedice, ako zakonom nije drugačije određeno, nastupaju potvrđivanjem optužnice za kazneno djelo.

- Uzimajući u obzir, uz sve ranije navedeno, da je g. Kazimir Bačić negirao počinjenje kaznenog djela koje mu se stavlja na teret te da je isti iznio svoju obranu, potpuno je nejasno i na zakonu neutemeljeno postupanje Nadzornog odbora Hrvatske radiotelevizije, ukoliko su dostupni podaci iz sredstava javnog priopćavanja istiniti, a prema kojima proizlazi da je navedeno tijelo donijelo jednoglasnu odluku o pokretanju postupka razrješenja Glavnog ravnatelja Hrvatske radiotelevizije g Kazimira Bačića, obzirom da trenutno nije ispunjen niti jedan uvjet za pokretanje takvog postupka iz čl. 20. st. 6. Zakona o Hrvatskoj radioteleviziji, pišu odvjetnici.

- Ukoliko već sam Nadzorni odbor Hrvatske radiotelevizije nije pri donošenju svoje odluke o pokretanju postupka za razrješenje Glavnog ravnatelja g. Kazimira Bačića uzeo u obzir sve ranije navedeno, a trebao je, zasigurno će Hrvatski sabor, kao nositelj zakonodavne vlasti u Republici Hrvatskoj, voditi računa o jednakoj primjeni Ustava Republike Hrvatske i ranije navedenih zakona prema svim građanima Republike Hrvatske, pa tako i prema g. Kazimiru Bačiću.

Ovakvim postupanjem, Nadzorni odbor Hrvatske radiotelevizije prejudicira kaznenu odgovornost g. Kazimira Bačića te se razlozima suprotnim odluci nadležnog suda koristi kako bi razriješio g. Kazimira Bačića s mjesta glavnog ravnatelja Hrvatske radiotelevizije odnosno vlastite interne prijepore i probitke pretpostavio poštivanju Ustava i zakona.

Ovakvim postupanjem Nadzornog odbora Hrvatske radio televizije ne poštuju se odredbe Ustava Republike Hrvatske, odredbe Zakona o Hrvatskoj radioteleviziji te Ustavom i zakonom zajamčeno pravo na rad g. Kazimira Bačića, pišu odvjetnici Nikola Mandić i Ivan Stanić.

Odvjetnici Kazimira Bačića, uhićenog u ovotjednoj antikorupcijskoj akciji Uskoka i policije, reagirali su na postupak njegova razrješenja s mjesta glavnog ravnatelja HRT-a koji je u petak pokrenut na sjednici Nadzornog odbora javne radiotelevizije.

U priopćenju koje donosi N1 potvrđuju da je Bačić uhićen u sklopu postupanja Uskoka te da mu je određen istražni zatvor zbog opasnosti od utjecaja na svjedoke koje će se u narednom kraćem razdoblju ispitati.

Osvrnuli su se i na pravni položaj u kojem se trenutno nalazi njihov klijent. Kažu da kazneni postupak protiv Bačića još uvijek nije započeo jer on započinje pravomoćnošću rješenja o provođenju istrage, a što u konkretnom slučaju još nije postignuto.

Pišu i da je Županijski sud u Zagrebu prihvatio prijedlog Uskoka da se Bačiću odredi istražni zatvor zbog opasnosti od utjecaja na svjedoke, a “odbio prijedlog Uskoka za određivanje istražnog zatvora zbog opasnosti da bi g. Kazimir Bačić, kao glavni ravnatelj Hrvatske radiotelevizije, daljnjim radom na svom radnom mjestu mogao počiniti neko novo kazneno djelo”.

- Ukoliko uzmemo u obzir ranije navedeno, razvidno je kako kazneni postupak u odnosu na glavnog ravnatelja Hrvatske radiotelevizije još uvijek nije započeo, obzirom ne postoji pravomoćno rješenje o provođenju istrage, te je sud odbio navode USKOK-a o postojanju opasnosti od učina kaznenog djela povratkom g. Kazimira Bačića, nakon što se saslušaju predloženi svjedoci, na svoje radno mjesto glavnog ravnatelja Hrvatske radiotelevizije.

Kad navedenom dodamo činjenicu kako u odnosu na g. Kazimira Bačića u potpunosti egzistira presumpcija nevinosti, propisana i zajamčena svakom hrvatskom građaninu čl. 28. Ustava Republike Hrvatske, u kojem stoji kako je svatko nedužan i nitko ga ne može smatrati krivim za kazneno djelo dok mu se pravomoćnom sudskom presudom ne utvrdi krivnja, te čl. 3. st. 1. Zakona o kaznenom postupku, koji navedeno identično propisuje, tada je sasvim razvidno kako ne postoje razlozi za pokretanjem postupka razrješenja g. Kazimira Bačića s mjesta Glavnog ravnatelja Hrvatske radiotelevizije, pišu odvjetnici.

Naglašavaju i da Zakon o kaznenom postupku određuje da, ukoliko je propisano pokretanje kaznenog postupka, za posljedicu ima ograničavanje određenih prava te da posljedice, ako zakonom nije drugačije određeno, nastupaju potvrđivanjem optužnice za kazneno djelo.

- Uzimajući u obzir, uz sve ranije navedeno, da je g. Kazimir Bačić negirao počinjenje kaznenog djela koje mu se stavlja na teret te da je isti iznio svoju obranu, potpuno je nejasno i na zakonu neutemeljeno postupanje Nadzornog odbora Hrvatske radiotelevizije, ukoliko su dostupni podaci iz sredstava javnog priopćavanja istiniti, a prema kojima proizlazi da je navedeno tijelo donijelo jednoglasnu odluku o pokretanju postupka razrješenja Glavnog ravnatelja Hrvatske radiotelevizije g Kazimira Bačića, obzirom da trenutno nije ispunjen niti jedan uvjet za pokretanje takvog postupka iz čl. 20. st. 6. Zakona o Hrvatskoj radioteleviziji, pišu odvjetnici.

- Ukoliko već sam Nadzorni odbor Hrvatske radiotelevizije nije pri donošenju svoje odluke o pokretanju postupka za razrješenje Glavnog ravnatelja g. Kazimira Bačića uzeo u obzir sve ranije navedeno, a trebao je, zasigurno će Hrvatski sabor, kao nositelj zakonodavne vlasti u Republici Hrvatskoj, voditi računa o jednakoj primjeni Ustava Republike Hrvatske i ranije navedenih zakona prema svim građanima Republike Hrvatske, pa tako i prema g. Kazimiru Bačiću.

Ovakvim postupanjem, Nadzorni odbor Hrvatske radiotelevizije prejudicira kaznenu odgovornost g. Kazimira Bačića te se razlozima suprotnim odluci nadležnog suda koristi kako bi razriješio g. Kazimira Bačića s mjesta glavnog ravnatelja Hrvatske radiotelevizije odnosno vlastite interne prijepore i probitke pretpostavio poštivanju Ustava i zakona.

Ovakvim postupanjem Nadzornog odbora Hrvatske radio televizije ne poštuju se odredbe Ustava Republike Hrvatske, odredbe Zakona o Hrvatskoj radioteleviziji te Ustavom i zakonom zajamčeno pravo na rad g. Kazimira Bačića, pišu odvjetnici Nikola Mandić i Ivan Stanić.

Odvjetnici uhićenog Kazimira Bačića: Nadzorni odbor HRT-a ne poštuje Ustav, nema razloga za njegovu smjenu

Odvjetnici Kazimira Bačića, uhićenog u ovotjednoj antikorupcijskoj akciji Uskoka i policije, reagirali su na postupak njegova razrješenja s mjesta glavnog ravnatelja HRT-a koji je u petak pokrenut na sjednici Nadzornog odbora javne radiotelevizije.

U priopćenju koje donosi N1 potvrđuju da je Bačić uhićen u sklopu postupanja Uskoka te da mu je određen istražni zatvor zbog opasnosti od utjecaja na svjedoke koje će se u narednom kraćem razdoblju ispitati.

Osvrnuli su se i na pravni položaj u kojem se trenutno nalazi njihov klijent. Kažu da kazneni postupak protiv Bačića još uvijek nije započeo jer on započinje pravomoćnošću rješenja o provođenju istrage, a što u konkretnom slučaju još nije postignuto.

Pišu i da je Županijski sud u Zagrebu prihvatio prijedlog Uskoka...
