Ustavni sud u srijedu je odlučio da su pandemijske mjere legitimne ne prihvativši prijedloge za ocjenom ustavnosti oko ovlasti Stožera civilne zaštite, uvođenja covid potvrda, obveznog testiranja zaposlenika u zdravstvu i socijali te posebnih mjera prilikom prijema pacijenata, piše N1.

Predsjednik Ustavnog suda, Miroslav Šeparović, obratio se javnosti i obrazložio odluku Ustavnog suda.

Ustavni sud na današnjoj sjednici donio je nekoliko odluka, koji se tiču prvenstveno Zakona o zaštiti pučanstva od zaraznih bolesti, tu nema ništa novo, osim što smo naložili da ubuduće Stožer kad donosi odluke mora obrazložiti svaku odluku koju je donio, tako da javnost i adresati znaju zašto se neka odluka donosi, rekao je Šeparović, dodavši da će to obrazloženje Stožer morati dati kod prve sljedeće odluke koju donesu.

Što se tiče covid-potvrda, odlučili smo o sustavu covid-potvrda i odlučili smo o sigurnosnoj mjeri obaveznoj testiranja pacijenata i sigurnosnoj mjeri obaveznog testiranja u zdravstvu i socijalnom sustavu. Te mjere imaju zakonsko uporište i posvećene su zaštiti zdravlja ljudi, a prvenstveno najranjivijih skupina i zaključili smo da je mjera prikladna da ostvari cilj zaštite zdravlja, nužna je, nije bilo manje restriktivnih mjera od nje i nije imala prekomjerni teret za adresate, Mjera je razumna, temelji se na stručnim i znanstvenim radovima, prema tome, nema diskriminacije, rekao je Šeparović.

Izdvojena mišljenja nije želio komentirati, kazavši da nije običaj da predsjednik Ustavnog suda prepričava izdvojena mišljenja kolega.

Komentirajući najavu da Stožer mora objašnjavati svoje odluke, Šeparović je rekao da će to ubuduće biti lakše za Ustavni sud oko donošenja odluka jesu li neke mjere primjerene. “To imamo ovlast tražiti i to nije sporno”, rekao je Šeparović.

“Stožer ne može uvesti obvezno cijepljenje, jer se to može uvesti samo zakonom. Ako Sabor želi uvesti obvezno cijepljenje, onda to može uvesti zakonom i onda bi ga Ustavni sud ocjenjivao”, rekao je Šeparović.

Pozivali smo se na preporuke Vijeća Europe koja govori o zabrani diskriminacije oko cijepljenja. Rezolucija zbog svog autoriteta i važnosti ima svoju snagu i Ustavni sud je uvažava. Vodili smo se i odlukama Ustavnog suda u Njemačkoj, koji je najbolji Ustavni sud na svijetu, koji je odlučio da je čak i policijski sad nije dobar, kao i zabrana odlaska u školu.

Ustavni sud u srijedu je odlučio da su pandemijske mjere legitimne ne prihvativši prijedloge za ocjenom ustavnosti oko ovlasti Stožera civilne zaštite, uvođenja covid potvrda, obveznog testiranja zaposlenika u zdravstvu i socijali te posebnih mjera prilikom prijema pacijenata, piše N1.

Predsjednik Ustavnog suda, Miroslav Šeparović, obratio se javnosti i obrazložio odluku Ustavnog suda.

Ustavni sud na današnjoj sjednici donio je nekoliko odluka, koji se tiču prvenstveno Zakona o zaštiti pučanstva od zaraznih bolesti, tu nema ništa novo, osim što smo naložili da ubuduće Stožer kad donosi odluke mora obrazložiti svaku odluku koju je donio, tako da javnost i adresati znaju zašto se neka odluka donosi, rekao je Šeparović, dodavši da će to obrazloženje Stožer morati dati kod prve sljedeće odluke koju donesu.

Što se tiče covid-potvrda, odlučili smo o sustavu covid-potvrda i odlučili smo o sigurnosnoj mjeri obaveznoj testiranja pacijenata i sigurnosnoj mjeri obaveznog testiranja u zdravstvu i socijalnom sustavu. Te mjere imaju zakonsko uporište i posvećene su zaštiti zdravlja ljudi, a prvenstveno najranjivijih skupina i zaključili smo da je mjera prikladna da ostvari cilj zaštite zdravlja, nužna je, nije bilo manje restriktivnih mjera od nje i nije imala prekomjerni teret za adresate, Mjera je razumna, temelji se na stručnim i znanstvenim radovima, prema tome, nema diskriminacije, rekao je Šeparović.

Izdvojena mišljenja nije želio komentirati, kazavši da nije običaj da predsjednik Ustavnog suda prepričava izdvojena mišljenja kolega.

Komentirajući najavu da Stožer mora objašnjavati svoje odluke, Šeparović je rekao da će to ubuduće biti lakše za Ustavni sud oko donošenja odluka jesu li neke mjere primjerene. “To imamo ovlast tražiti i to nije sporno”, rekao je Šeparović.

“Stožer ne može uvesti obvezno cijepljenje, jer se to može uvesti samo zakonom. Ako Sabor želi uvesti obvezno cijepljenje, onda to može uvesti zakonom i onda bi ga Ustavni sud ocjenjivao”, rekao je Šeparović.

Pozivali smo se na preporuke Vijeća Europe koja govori o zabrani diskriminacije oko cijepljenja. Rezolucija zbog svog autoriteta i važnosti ima svoju snagu i Ustavni sud je uvažava. Vodili smo se i odlukama Ustavnog suda u Njemačkoj, koji je najbolji Ustavni sud na svijetu, koji je odlučio da je čak i policijski sad nije dobar, kao i zabrana odlaska u školu.

Ustavni sud u srijedu je odlučio da su pandemijske mjere legitimne ne prihvativši prijedloge za ocjenom ustavnosti oko ovlasti Stožera civilne zaštite, uvođenja covid potvrda, obveznog testiranja zaposlenika u zdravstvu i socijali te posebnih mjera prilikom prijema pacijenata, piše N1.

Predsjednik Ustavnog suda, Miroslav Šeparović, obratio se javnosti i obrazložio odluku Ustavnog suda.

Ustavni sud na današnjoj sjednici donio je nekoliko odluka, koji se tiču prvenstveno Zakona o zaštiti pučanstva od zaraznih bolesti, tu nema ništa novo, osim što smo naložili da ubuduće Stožer kad donosi odluke mora obrazložiti svaku odluku koju je donio, tako da javnost i adresati znaju zašto se neka odluka donosi, rekao je Šeparović, dodavši da će to obrazloženje Stožer morati dati kod prve slje...
