Kako se čini da je poticanje razvoja obrtnika paušalaca u Hrvatskoj postalo sustav nalik Divljem zapadu, gdje se porezne pogodnosti koriste "protivno svrsi zakona", inspektori su ovih dana krenuli u akciju, a jedan od sektora u kojem je to posebno izazvalo pažnju je IT, piše Jutarnji.

Među ostalim, taj je problem u zadnje vrijeme pojačan upravo u domaćoj informatičkoj industriji jer, kako nam kaže Davor Runje, predsjednik Hrvatske nezavisne udruge softverskih izvoznika (CISEx), jake strane kompanije intenzivno vrbuju iskusne programere nudeći im dvostruko veća primanja ako rade za njih u statusu paušalnih obrtnika, što je podložno daleko manjim porezima nego dohodak od nesamostalnog rada. U pitanju je, zapravo, prikriveno zapošljavanje.

"Te strane tvrtke su u pandemiji proširile rad na daljinu i počele kroz paušalne obrte regrutirati naše najbolje ljude, a domaće kompanije su u lošijem položaju i ne mogu doći do adekvatne radne snage ili je zadržati", objašnjava. U pitanju su uglavnom velike kompanije iz SAD-a, Britanije, Njemačke, Nizozemske, pa i Poljske i Irske.

Eksplozija paušalaca

Broj paušalnih obrta u Hrvatskoj je općenito snažno narastao zadnjih godina te, prema posljednjim podacima, čine 48% svih obrta, a 2015. su činili 19 posto. Povećanje je znatno i u IT sektoru, gdje je trenutno oko 4500 "paušalaca" (za usporedbu, sve tvrtke članice udruge CISEx zapošljavaju oko 8000 ljudi).

Prema ocjeni direktora Udruge Glas poduzetnika i predsjednika Uprave IT tvrtke Poslovna inteligencija Dražena Oreščanina, od 70 do 80 posto paušalnih obrta je zapravo lažno, odnosno riječ je o prikrivenom zapošljavanju koje je omogućio "šupalj" i loše napisan zakon.

Niz grešaka države

Porezna uprava je sada objavila da pokreće postupke provjere te je na internet-stranicama poziv poduzetnicima da popune upitnik o načinu poslovanja, a usporedbom prikupljenih podataka o načinu poslovanja "preispitat će se postoje li obilježja nesamostalnog rada te utvrditi koriste li se porezne pogodnosti protivno svrsi zakona".

Vjerojatno će kao posljedica tih akcija slijediti niz teških kazni za lažne paušalne obrtnike, kaže Runje, a nešto slično se prije nekoliko godina dogodilo i u Sloveniji, gdje su i kompanije koje su na taj način angažirale radnu snagu bile kažnjene. U slučaju Hrvatske, napominje, većinom se radi o stranim tvrtkama koje nisu dostupne domaćim inspektorima. Oreščanin napominje i da cijelu situaciju vidi kao nepravdu: "Zapošljavam 170 ljudi i globalno sam konkurentan, a porezno sam u podređenom položaju".

Poslodavci s kojima smo razgovarali uglavnom smatraju da je država tu napravila niz grešaka, a pritom su diskriminirani oni koji su zaposleni preko ugovora o radu. Jedino pošteno rješenje je u boljem poreznom balansu, odnosno da se daleko manje oporezuje dohodak od nesamostalnog rada, a malo više primici kroz paušalne obrte. "Ako nekome godišnje ostane u džepu razlika veća od 100 tisuća kuna, a mala je šansa da će ga otkriti, jasno je da se prije odlučuje za tu varijantu nego ugovor o radu", dodaju.

Porezi i doprinosi samo osam posto

Popularnost paušalnih obrta silno je u Hrvatskoj narasla kada je podignut maksimalni godišnji limit primitaka sa 150.000 kuna na 300.000 kuna za paušalno oporezivanje samostalnih djelatnosti, a pandemija je to dodatno intenzivirala.

Na te je prihode vrlo mali iznos predviđen za plaćanje poreza i doprinosa, koji iznose oko osam posto, dok su na plaću od nesamostalnog rada 40-ak posto.

Još smo 2019. godine pisali da Ministarstvo financija kreće u bolji nadzor paušalnih obrtnika jer su kao problem detektirani oni koji glume da su obrtnici. Često, kako svjedoče poslodavci u IT-ju, i sami zaposlenici traže da budu plaćeni za rad putem paušalnog obrta, a neki onda dobiju i poticaj od države za samozapošljavanje.

Inače, prema Općem poreznom zakonu, utvrdi li se da je riječ o nesamostalnom radu, razlika poreza i doprinosa naplaćuje se posloprimcu, a to je paušalni obrtnik, dok je poslodavac u statusu jamac platac.

Kako se čini da je poticanje razvoja obrtnika paušalaca u Hrvatskoj postalo sustav nalik Divljem zapadu, gdje se porezne pogodnosti koriste "protivno svrsi zakona", inspektori su ovih dana krenuli u akciju, a jedan od sektora u kojem je to posebno izazvalo pažnju je IT, piše Jutarnji.

Među ostalim, taj je problem u zadnje vrijeme pojačan upravo u domaćoj informatičkoj industriji jer, kako nam kaže Davor Runje, predsjednik Hrvatske nezavisne udruge softverskih izvoznika (CISEx), jake strane kompanije intenzivno vrbuju iskusne programere nudeći im dvostruko veća primanja ako rade za njih u statusu paušalnih obrtnika, što je podložno daleko manjim porezima nego dohodak od nesamostalnog rada. U pitanju je, zapravo, prikriveno zapošljavanje.

"Te strane tvrtke su u pandemiji proširile rad na daljinu i počele kroz paušalne obrte regrutirati naše najbolje ljude, a domaće kompanije su u lošijem položaju i ne mogu doći do adekvatne radne snage ili je zadržati", objašnjava. U pitanju su uglavnom velike kompanije iz SAD-a, Britanije, Njemačke, Nizozemske, pa i Poljske i Irske.

Broj paušalnih obrta u Hrvatskoj je općenito snažno narastao zadnjih godina te, prema posljednjim podacima, čine 48% svih obrta, a 2015. su činili 19 posto. Povećanje je znatno i u IT sektoru, gdje je trenutno oko 4500 "paušalaca" (za usporedbu, sve tvrtke članice udruge CISEx zapošljavaju oko 8000 ljudi).

Prema ocjeni direktora Udruge Glas poduzetnika i predsjednika Uprave IT tvrtke Poslovna inteligencija Dražena Oreščanina, od 70 do 80 posto paušalnih obrta je zapravo lažno, odnosno riječ je o prikrivenom zapošljavanju koje je omogućio "šupalj" i loše napisan zakon.

Niz grešaka države

Porezna uprava je sada objavila da pokreće postupke provjere te je na internet-stranicama poziv poduzetnicima da popune upitnik o načinu poslovanja, a usporedbom prikupljenih podataka o načinu poslovanja "preispitat će se postoje li obilježja nesamostalnog rada te utvrditi koriste li se porezne pogodnosti protivno svrsi zakona".

Vjerojatno će kao posljedica tih akcija slijediti niz teških kazni za lažne paušalne obrtnike, kaže Runje, a nešto slično se prije nekoliko godina dogodilo i u Sloveniji, gdje su i kompanije koje su na taj način angažirale radnu snagu bile kažnjene. U slučaju Hrvatske, napominje, većinom se radi o stranim tvrtkama koje nisu dostupne domaćim inspektorima. Oreščanin napominje i da cijelu situaciju vidi kao nepravdu: "Zapošljavam 170 ljudi i globalno sam konkurentan, a porezno sam u podređenom položaju".

Poslodavci s kojima smo razgovarali uglavnom smatraju da je država tu napravila niz grešaka, a pritom su diskriminirani oni koji su zaposleni preko ugovora o radu. Jedino pošteno rješenje je u boljem poreznom balansu, odnosno da se daleko manje oporezuje dohodak od nesamostalnog rada, a malo više primici kroz paušalne obrte. "Ako nekome godišnje ostane u džepu razlika veća od 100 tisuća kuna, a mala je šansa da će ga otkriti, jasno je da se prije odlučuje za tu varijantu nego ugovor o radu", dodaju.

Porezi i doprinosi samo osam posto

Popularnost paušalnih obrta silno je u Hrvatskoj narasla kada je podignut maksimalni godišnji limit primitaka sa 150.000 kuna na 300.000 kuna za paušalno oporezivanje samostalnih djelatnosti, a pandemija je to dodatno intenzivirala.

Na te je prihode vrlo mali iznos predviđen za plaćanje poreza i doprinosa, koji iznose oko osam posto, dok su na plaću od nesamostalnog rada 40-ak posto.

Još smo 2019. godine pisali da Ministarstvo financija kreće u bolji nadzor paušalnih obrtnika jer su kao problem detektirani oni koji glume da su obrtnici. Često, kako svjedoče poslodavci u IT-ju, i sami zaposlenici traže da budu plaćeni za rad putem paušalnog obrta, a neki onda dobiju i poticaj od države za samozapošljavanje.

Inače, prema Općem poreznom zakonu, utvrdi li se da je riječ o nesamostalnom radu, razlika poreza i doprinosa naplaćuje se posloprimcu, a to je paušalni obrtnik, dok je poslodavac u statusu jamac platac.

Kako se čini da je poticanje razvoja obrtnika paušalaca u Hrvatskoj postalo sustav nalik Divljem zapadu, gdje se porezne pogodnosti koriste "protivno svrsi zakona", inspektori su ovih dana krenuli u akciju, a jedan od sektora u kojem je to posebno izazvalo pažnju je IT, piše Jutarnji.

Među ostalim, taj je problem u zadnje vrijeme pojačan upravo u domaćoj informatičkoj industriji jer, kako nam kaže Davor Runje, predsjednik Hrvatske nezavisne udruge softverskih izvoznika (CISEx), jake strane kompanije intenzivno vrbuju iskusne programere nudeći im dvostruko veća primanja ako rade za njih u statusu paušalnih obrtnika, što je podložno daleko manjim porezima nego dohodak od nesamostalnog rada. U pitanju je, zapravo, prikriveno zapošljavanje.
