Pravno shvaćanje Vrhovnog suda Republike Hrvatske dobilo je potvrdu u odluci Suda Europske unije, objavio je VSRH na svojoj internetskoj stranici. Priopćenje donosimo u cijelosti.
“Građanski odjel Vrhovnog suda Republike Hrvatske donio je pravno shvaćanje 30. siječnja 2020. koje glasi:
'Zastarni rok u slučaju restitucijskog zahtjeva prema kojem su ugovorne strane dužne vratiti jedna drugoj sve ono što su primile na temelju ništetnog ugovora, odnosno u slučaju zahtjeva iz članka 323. stavak 1. ZOO/05 (članak 104. stavak 1. ZOO/91) kao posljedice utvrđenja ništetnosti ugovora, počinje teći od dana pravomoćnosti sudske odluke kojom je utvrđena ili na drugi način ustanovljena ništetnost ugovora.'
To pravno shvaćanje dobilo je potvrdu u presudi Suda Europske unije u predmetu C-485/19. (Profi Credit Slovakia) od 22. travnja 2021.
U toj je odluci zauzeto shvaćanje da odredbe slovačkog Građanskog zakonika prema kojima se zastara restitucijskog zahtjeva i kod potrošačkih ugovora koji su utvrđeni ništetnim računa od izvršenog plaćanja, nije u skladu s pravnom stečevinom EU, makar samo trajanje zastarnog roka samo nije protivno pravu EU.
Pravnim shvaćanjem donesenim prije odluke Suda Europske unije, Vrhovni sud Republike Hrvatske pokazao je da prilikom zauzimanja pravnih shvaćanja tumači domaće pravo u skladu s načelom djelotvornosti kao jednim od temeljnih načela prava Europske unije”, objavio je VSRH.
Udruga Franak na svojoj Facebook stranici čestitala je “sucima Vrhovnog suda na hrabrosti da promijene svoju zastarjelu sudsku praksu koja je bila izrazito nepravična, i potpuno nelogična”.
-Uistinu nije bilo životno utvrđivati ništetnost bilo kad, i imati pravo na potraživanja samo 5 godina nakon stjecanja bez osnove. Pravno shvaćanje od 30.1.2020. dobilo je potvrdu i na Sudu EU, čime je nepovratno otvorena nova stranica u sudskoj praksi.
Svi potrošači koji tuže banke zbog ništetnosti ugovorenih odredaba odnosno ugovora (ako se prihvati NU), dobit će svoj novac! - naveli su, uz ostalo, u obavijesti o priopćenju Vrrhovnog suda Republike Hrvatske.

- Sada je definitivno utvrđeno kako nema zastare potraživanja, ukoliko se utvrđuje ništetnost ugovora ili odredaba, i da zastara počinje teći tek kada se ta ništetnost utvrdi. Očekujem da uskoro VSRH potvrdi taj stav i u jednoj od revizija za preplaćene kamate iz euro i kunskih kredita – istaknuo je Aleksić.
Dodaje i kako osim toga, čekajuo i odluku VSRH o ništetnosti CHF ugovora te odluku Suda EU o pravu na obeštećenje nakon konverzije.

“Građanski odjel Vrhovnog suda Republike Hrvatske donio je pravno shvaćanje 30. siječnja 2020. koje glasi:
'Zastarni rok u slučaju restitucijskog zahtjeva prema kojem su ugovorne strane dužne vratiti jedna drugoj sve ono što su primile na temelju ništetnog ugovora, odnosno u slučaju zahtjeva iz članka 323. stavak 1. ZOO/05 (članak 104. stavak 1. ZOO/91) kao posljedice utvrđenja ništetnosti ugovora, počinje teći od dana pravomoćnosti sudske odluke kojom je utvrđena ili na drugi način ustanovljena ništetnost ugovora.'
To pravno shvaćanje dobilo je potvrdu u presudi Suda Europske unije u predmetu C-485/19. (Profi Credit Slovakia) od 22. travnja 2021.
U toj je odluci zauzeto shvaćanje da odredbe slovačkog Građanskog zakonika prema kojima se zastara restitucijskog zahtjeva i kod potrošačkih ugovora koji su utvrđeni ništetnim računa od izvršenog plaćanja, nije u skladu s pravnom stečevinom EU, makar samo trajanje zastarnog roka samo nije protivno pravu EU.
Pravnim shvaćanjem donesenim prije odluke Suda Europske unije, Vrhovni sud Republike Hrvatske pokazao je da prilikom zauzimanja pravnih shvaćanja tumači domaće pravo u skladu s načelom djelotvornosti kao jednim od temeljnih načela prava Europske unije”, objavio je VSRH.
Udruga Franak na svojoj Facebook stranici čestitala je “sucima Vrhovnog suda na hrabrosti da promijene svoju zastarjelu sudsku praksu koja je bila izrazito nepravična, i potpuno nelogična”.
-Uistinu nije bilo životno utvrđivati ništetnost bilo kad, i imati pravo na potraživanja samo 5 godina nakon stjecanja bez osnove. Pravno shvaćanje od 30.1.2020. dobilo je potvrdu i na Sudu EU, čime je nepovratno otvorena nova stranica u sudskoj praksi.
Svi potrošači koji tuže banke zbog ništetnosti ugovorenih odredaba odnosno ugovora (ako se prihvati NU), dobit će svoj novac! - naveli su, uz ostalo, u obavijesti o priopćenju Vrrhovnog suda Republike Hrvatske.
Za komentar smo pitali Gorana Aleksića, koordinatora Ekonomsko-pravnog tima Udruge Franak.
- Sada je definitivno utvrđeno kako nema zastare potraživanja, ukoliko se utvrđuje ništetnost ugovora ili odredaba, i da zastara počinje teći tek kada se ta ništetnost utvrdi. Očekujem da uskoro VSRH potvrdi taj stav i u jednoj od revizija za preplaćene kamate iz euro i kunskih kredita – istaknuo je Aleksić.
Dodaje i kako osim toga, čekajuo i odluku VSRH o ništetnosti CHF ugovora te odluku Suda EU o pravu na obeštećenje nakon konverzije.
