Saznajemo iz pravosudnih krugova da je značenje trećeg pravnog shvaćanja, koje je dobilo 13 potrebnih glasova sudaca Vrhovnog suda na sjednici Građanskog odjela održanoj 13. i 20.12.2022., ipak drugačije od onoga što je Vrhovni sud šturo objavio, priopćili su iz Udruge Franak.
Prema informacijama koje imaju, ono što se htjelo reći tim shvaćanjem bilo bi sljedeće:
1. Potrošač s konvertiranim kreditom ima pravo na zatezne kamate koje se obračunavaju na njegove preplaćene iznose, i to do dana konverzije.
2. Te zatezne kamate postaju glavnica duga na koju onda opet teku zatezne kamate od dana podizanja pojedinačne tužbe pa do isplate.
Takvo pravno shvaćanje potpuno je nezakonito, proturječno, neprihvatljivo i u konačnici protivno presudama Suda EU, jer ono ne omogućuje punu restituciju potrošačima koji su konvertirali kredite, ističu u Udruzi Franak.
Nadalje naglašavaju kako preplaćeni iznosi anuiteta NISU vraćeni konverzijom pa se onda ti iznosi moraju vratiti svakom potrošaču koji podigne tužbu zajedno s pripadajućim zateznim kamatama.
Navode također kako utvrđenjem ništetnosti odredaba o kamati i valuti u svakom konvertiranom CHF kreditu na dan konverzije vrijede sljedeće postavke:
1. Stvarna glavnica nije ona koja je konvertirana.Stvarna glavnica manja je od konvertirane glavnice oko 10%. Ukratko, preostala glavnica kredita nije konverzijom svedena na početne parametre.
2. Potrošač ima pravo na povrat razlike tečaja, na preplaćene kamate i na pripadajuće zatezne kamate na sve te utvrđene preplaćene iznose.
3. Budući da potrošač konverzijom nije dobio glavnicu na koju ima pravo izuzećem ništetnih odredaba, u sudskom postupku on mora dobiti i razliku u odnosu na stvarnu glavnicu, s pripadajućim zateznim kamatama.
Budući da potrošač nije dobio ništa opisano pod točkama 1. do 3. banka mu to mora vratiti na temelju presude u sudskom postupku, ističu u Udruzi Franak.
Pravno shvaćanje kojim bi banke zadržale neosnovano stečeni novac, a potrošaču isplatile samo zatezne kamate bez vraćanja tog istog oduzetog novca, pravno je i logički apsurdno i neodrživo shvaćanje te je takvo shvaćanje očito nerazumno i protivno svim ustavnim i konvencijskim jamstvima, naglašavaju u priopćenju.
Molimo suce Vrhovnog suda RH da se ne igraju prava, nego da sude u skladu s pravnim propisima, Ustavom i Konvencijom. Izmišljanje protuzakonitih rješenja kojima se pogoduje bankama nije Ustavom propisana zadaća Vrhovnog suda. Bila bi velika sramota za Vrhovni sud RH da još jednom doživi debakl na Ustavnom sudu uslijed suđenja suprotnog hrvatskom pravu i pravu EU-apa stoga očekujemo da nakaradno treće pravno shvaćanje nakon internih kontrola zakonitosti nikada službeno i ne bude objavljeno – poručuju iz Udruge Franak.

Saznajemo iz pravosudnih krugova da je značenje trećeg pravnog shvaćanja, koje je dobilo 13 potrebnih glasova sudaca Vrhovnog suda na sjednici Građanskog odjela održanoj 13. i 20.12.2022., ipak drugačije od onoga što je Vrhovni sud šturo objavio, priopćili su iz Udruge Franak.
Prema informacijama koje imaju, ono što se htjelo reći tim shvaćanjem bilo bi sljedeće:
1. Potrošač s konvertiranim kreditom ima pravo na zatezne kamate koje se obračunavaju na njegove preplaćene iznose, i to do dana konverzije.
2. Te zatezne kamate postaju glavnica duga na koju onda opet teku zatezne kamate od dana podizanja pojedinačne tužbe pa do isplate.
Takvo pravno shvaćanje potpuno je nezakonito, proturječno, neprihvatljivo i u konačnici protivno presudama Suda EU, jer ono ne omogućuje punu restituciju potrošačima koji su konvertirali kredite, ističu u Udruzi Franak.
Nadalje naglašavaju kako preplaćeni iznosi anuiteta NISU vraćeni konverzijom pa se onda ti iznosi moraju vratiti svakom potrošaču koji podigne tužbu zajedno s pripadajućim zateznim kamatama.
Navode također kako utvrđenjem ništetnosti odredaba o kamati i valuti u svakom konvertiranom CHF kreditu na dan konverzije vrijede sljedeće postavke:
1. Stvarna glavnica nije ona koja je konvertirana.Stvarna glavnica manja je od konvertirane glavnice oko 10%. Ukratko, preostala glavnica kredita nije konverzijom svedena na početne parametre.
2. Potrošač ima pravo na povrat razlike tečaja, na preplaćene kamate i na pripadajuće zatezne kamate na sve te utvrđene preplaćene iznose.
3. Budući da potrošač konverzijom nije dobio glavnicu na koju ima pravo izuzećem ništetnih odredaba, u sudskom postupku on mora dobiti i razliku u odnosu na stvarnu glavnicu, s pripadajućim zateznim kamatama.
Budući da potrošač nije dobio ništa opisano pod točkama 1. do 3. banka mu to mora vratiti na temelju presude u sudskom postupku, ističu u Udruzi Franak.
Pravno shvaćanje kojim bi banke zadržale neosnovano stečeni novac, a potrošaču isplatile samo zatezne kamate bez vraćanja tog istog oduzetog novca, pravno je i logički apsurdno i neodrživo shvaćanje te je takvo shvaćanje očito nerazumno i protivno svim ustavnim i konvencijskim jamstvima, naglašavaju u priopćenju.
Molimo suce Vrhovnog suda RH da se ne igraju prava, nego da sude u skladu s pravnim propisima, Ustavom i Konvencijom. Izmišljanje protuzakonitih rješenja kojima se pogoduje bankama nije Ustavom propisana zadaća Vrhovnog suda. Bila bi velika sramota za Vrhovni sud RH da još jednom doživi debakl na Ustavnom sudu uslijed suđenja suprotnog hrvatskom pravu i pravu EU-apa stoga očekujemo da nakaradno treće pravno shvaćanje nakon internih kontrola zakonitosti nikada službeno i ne bude objavljeno – poručuju iz Udruge Franak.
