Udruga Franak održat će u subotu, 1. travnja 2023., prosvjed na Zrinjevcu s početkom u 12.00 sati. Autobusi u Zagreb dolaze s ljudima iz Vukovara, Vinkovaca, Đakova, Osijeka, Slavonskog Broda, Požege, Nove Gradiške, Novske, Varaždina, Čakovca, Rijeke, Pule, Umaga, Pazina, Zadra, Šibenika, Splita, Metkovića i Dubrovnika.

Njihovo priopćenje prenosimo u cijelosti: 

"S prosvjeda ćemo uputiti poruku Vrhovnom sudu kako je došlo krajnje vrijeme za odluke o krucijalnim pravnim shvaćanjima, koje su morale odavno biti donesene, ali zbog tromosti i neodgovornosti sudaca Vrhovnog suda RH to još uvijek nije učinjeno. Ususret tomu prosvjedu, upućujemo naše prosvjedne zahtjeve Vrhovnom sudu RH, Vladi RH i Hrvatskom saboru, dok nedjelotvornoj i s namjerom nesposobnoj Hrvatskoj narodnoj banci upućujemo prosvjednu notu – poručuju iz Udruge Franak dan prije velikog prosvjeda. 

U priopćenju navode i kako glase prosvjedni zahtjevi i prosvjedna nota:

VRHOVNOM SUDU RH

Zahtijevamo da Vrhovni sud RH u roku od 15 dana od 1. travnja 2023. donese potrebne odluke:

1. O ništetnosti ugovora s ništetnom valutnom klauzulom i ništetnom promjenjivom kamatnom stopom.

2. O pravu na puno obeštećenje svih potrošača s konvertiranim kreditima na temelju Zakona o izmjeni i dopunama Zakona o potrošačkom kreditiranju (NN 102/15).

VLADI RH I HRVATSKOM SABORU

Zahtijevamo da Vlada RH predloži u hitnoj proceduri te da Hrvatski sabor izglasa u adekvatnim zakonskim aktima:

1. Produljenje roka zastare potraživanja do 31. prosinca 2024. za sve potrošačke kredite s valutnom klauzulom CHF koji su obuhvaćeni kolektivnom sudskom presudom u slučaju franak. Uslijed pravne nesigurnosti koju je uzrokovao Vrhovni sud RH mnogi potrošači nisu tužili na vrijeme i zanemarili su svoja prava, zbog straha od neuspjeha na sudovima. Zbog toga je potrebno produljiti rokove zastare potraživanja koji sada teku do 14. lipnja 2023. po svim pojedinačnim tužbama koje se temelje na kolektivnoj sudskoj presudi.

2. Oslobađanje od sudskih pristojbi te troškova vještačenja svih potrošača koji su obuhvaćeni kolektivnom sudskom presudom u tzv. slučaju franak.

HRVATSKOJ NARODNOJ BANCI

Upućujemo prosvjednu notu HNB-u:

1. Zbog toga jer je HNB neaktivno svojim svjesnim i namjernim nečinjenjem pogodovao bankama u višegodišnjem pljačkanju hrvatskih potrošača ugovaranjem i primjenom ništetnih ugovornih odredaba o promjenjivim kamatnim stopama. Banke su ugovarale sve do 2013. ništetne ugovorne odredbe o promjeni kamatne stope odlukom vjerovnika, i to u svim vrstama i valutama potrošačkih ugovora o kreditu. HNB u tome ima ulogu subjekta koji unatoč činjenici da je regulator i nadziratelj rada banaka, nije učinio ništa u sprječavanju dugogodišnje nepoštene, nesavjesne i nezakonite poslovne prakse banaka, praveći se kao da ga se to uopće ne tiče.

2. Zbog toga jer HNB nije učinio ništa nakon pravomoćnosti kolektivne sudske presude u smjeru preporuke bankama da postupe u skladu s presudom i ponude potrošačima nagodbe, kako potrošači ne bi morali pokretati sudske postupke. HNB je stalno tvrdio kako se radi o pojedinačnim postupcima i različitim ugovornim odnosima, a to je notorna laž. Naime, svi ugovori o kreditu sadrže identične ugovorne odredbe o kojima se nije pregovaralo i koje su uzrokovale neravnotežu prava i obveza na štetu potrošača.

ZAKLJUČAK NA TEMELJU ARGUMENATA

Pravomoćna presuda u kolektivnom slučaju franak kojom je utvrđena ništetnost valutne klauzule CHF donesena je 14. lipnja 2018. i tada je počeo teći zastarni rok za potraživanja na temelju te ništetnosti koji istječe 14. lipnja 2023. Budući da potrošači s konverzijama sve do danas nisu dobili sudsko utvrđenje pravne sigurnosti za svoje tužbe, prosvjedujemo zbog sporosti Vrhovnog suda i zbog nečinjenja HNB-a, Vlade Republike Hrvatske i Hrvatskog sabora. 

Tražimo ispred 55.000 potrošača s konvertiranim kreditima, da se naš zahtjev Vrhovnom sudu vezano za odluku o punom obeštećenju realizira, a u kontekstu neodržive pravne nesigurnosti da se realiziraju i naši zahtjevi upućeni Vladi i Saboru o zastarama potraživanja te oslobađanju od sudskih pristojbi!

Tražimo ispred 125.000 potrošača s ništetnim ugovornim odredbama o glavnom predmetu i cijeni kredita, da se konačno riješi na Vrhovnom sudu RH i pitanje ništetnosti cijelih ugovora, također radi pravne sigurnosti u njihovim sudskim postupcima. Revizije po tom pitanju su spremne za donošenje odluke već više od godinu dana.

Udruga Franak održat će u subotu, 1. travnja 2023., prosvjed na Zrinjevcu s početkom u 12.00 sati. Autobusi u Zagreb dolaze s ljudima iz Vukovara, Vinkovaca, Đakova, Osijeka, Slavonskog Broda, Požege, Nove Gradiške, Novske, Varaždina, Čakovca, Rijeke, Pule, Umaga, Pazina, Zadra, Šibenika, Splita, Metkovića i Dubrovnika.

Njihovo priopćenje prenosimo u cijelosti: 

"S prosvjeda ćemo uputiti poruku Vrhovnom sudu kako je došlo krajnje vrijeme za odluke o krucijalnim pravnim shvaćanjima, koje su morale odavno biti donesene, ali zbog tromosti i neodgovornosti sudaca Vrhovnog suda RH to još uvijek nije učinjeno. Ususret tomu prosvjedu, upućujemo naše prosvjedne zahtjeve Vrhovnom sudu RH, Vladi RH i Hrvatskom saboru, dok nedjelotvornoj i s namjerom nesposobnoj Hrvatskoj narodnoj banci upućujemo prosvjednu notu – poručuju iz Udruge Franak dan prije velikog prosvjeda. 

U priopćenju navode i kako glase prosvjedni zahtjevi i prosvjedna nota:

VRHOVNOM SUDU RH

Zahtijevamo da Vrhovni sud RH u roku od 15 dana od 1. travnja 2023. donese potrebne odluke:

1. O ništetnosti ugovora s ništetnom valutnom klauzulom i ništetnom promjenjivom kamatnom stopom.

2. O pravu na puno obeštećenje svih potrošača s konvertiranim kreditima na temelju Zakona o izmjeni i dopunama Zakona o potrošačkom kreditiranju (NN 102/15).

VLADI RH I HRVATSKOM SABORU

Zahtijevamo da Vlada RH predloži u hitnoj proceduri te da Hrvatski sabor izglasa u adekvatnim zakonskim aktima:

1. Produljenje roka zastare potraživanja do 31. prosinca 2024. za sve potrošačke kredite s valutnom klauzulom CHF koji su obuhvaćeni kolektivnom sudskom presudom u slučaju franak. Uslijed pravne nesigurnosti koju je uzrokovao Vrhovni sud RH mnogi potrošači nisu tužili na vrijeme i zanemarili su svoja prava, zbog straha od neuspjeha na sudovima. Zbog toga je potrebno produljiti rokove zastare potraživanja koji sada teku do 14. lipnja 2023. po svim pojedinačnim tužbama koje se temelje na kolektivnoj sudskoj presudi.

2. Oslobađanje od sudskih pristojbi te troškova vještačenja svih potrošača koji su obuhvaćeni kolektivnom sudskom presudom u tzv. slučaju franak.

HRVATSKOJ NARODNOJ BANCI

Upućujemo prosvjednu notu HNB-u:

1. Zbog toga jer je HNB neaktivno svojim svjesnim i namjernim nečinjenjem pogodovao bankama u višegodišnjem pljačkanju hrvatskih potrošača ugovaranjem i primjenom ništetnih ugovornih odredaba o promjenjivim kamatnim stopama. Banke su ugovarale sve do 2013. ništetne ugovorne odredbe o promjeni kamatne stope odlukom vjerovnika, i to u svim vrstama i valutama potrošačkih ugovora o kreditu. HNB u tome ima ulogu subjekta koji unatoč činjenici da je regulator i nadziratelj rada banaka, nije učinio ništa u sprječavanju dugogodišnje nepoštene, nesavjesne i nezakonite poslovne prakse banaka, praveći se kao da ga se to uopće ne tiče.

2. Zbog toga jer HNB nije učinio ništa nakon pravomoćnosti kolektivne sudske presude u smjeru preporuke bankama da postupe u skladu s presudom i ponude potrošačima nagodbe, kako potrošači ne bi morali pokretati sudske postupke. HNB je stalno tvrdio kako se radi o pojedinačnim postupcima i različitim ugovornim odnosima, a to je notorna laž. Naime, svi ugovori o kreditu sadrže identične ugovorne odredbe o kojima se nije pregovaralo i koje su uzrokovale neravnotežu prava i obveza na štetu potrošača.

ZAKLJUČAK NA TEMELJU ARGUMENATA

Pravomoćna presuda u kolektivnom slučaju franak kojom je utvrđena ništetnost valutne klauzule CHF donesena je 14. lipnja 2018. i tada je počeo teći zastarni rok za potraživanja na temelju te ništetnosti koji istječe 14. lipnja 2023. Budući da potrošači s konverzijama sve do danas nisu dobili sudsko utvrđenje pravne sigurnosti za svoje tužbe, prosvjedujemo zbog sporosti Vrhovnog suda i zbog nečinjenja HNB-a, Vlade Republike Hrvatske i Hrvatskog sabora. 

Tražimo ispred 55.000 potrošača s konvertiranim kreditima, da se naš zahtjev Vrhovnom sudu vezano za odluku o punom obeštećenju realizira, a u kontekstu neodržive pravne nesigurnosti da se realiziraju i naši zahtjevi upućeni Vladi i Saboru o zastarama potraživanja te oslobađanju od sudskih pristojbi!

Tražimo ispred 125.000 potrošača s ništetnim ugovornim odredbama o glavnom predmetu i cijeni kredita, da se konačno riješi na Vrhovnom sudu RH i pitanje ništetnosti cijelih ugovora, također radi pravne sigurnosti u njihovim sudskim postupcima. Revizije po tom pitanju su spremne za donošenje odluke već više od godinu dana.
