Blago nam se, krenulo je! Parlamentarni izbori će se, bože zdravlja, održati za oko godinu dana, a kada točno – ne zna se. Možda već u proljeće, a možda iduće jeseni. No ono što se ne zna, to je po kakvom ćemo izbornom zakonu nahrupiti na birališta te, ako bude sreće, izabrati još mudrije i još sposobnije narodne predstavnike, Vladu i, dakako, premijera.

Odnosno premijerku, da budemo precizniji. Zasad se znaju imena troje možebitnih premijera – sadašnji premijer i HDZ-ov kandidat Andrej Plenković, SDP-ov Peđa Grbin, ali i Sandra Benčić iz stranke Možemo. Njih troje, uostalom, prema istraživanju Crobarometra, imaju i ponajviše šanse. Barem danas. No izbori su još jako, jako daleko.

Dok možebitni premijeri paradiraju, o izbornim pravilima Sabor će u utorak, 19. rujna, raspravljati o Vladinom Konačnom prijedlogu Zakona o izbornim jedinicama za izbor zastupnika u Hrvatski sabor. Prethodni zakon, sjećamo se, u veljači je ukinuo Ustavni sud. Neki se sjećaju da je Ustavni sud još prije 13 godina počeo opravdano grintati na Zakon, no nitko ga nije obadavao pa su se od 2010. do danas održale četiri runde parlamentarnih izbora. No popis stanovnika lani je pokazao da Ustavni sud jednostavno mora reagirati na evidentnu neustavnost izbornih pravila pa je odlučio ukinuti Zakon o izbornim jedinicama.

O čemu je riječ? Narušavanje jednakosti biračkog prava može imati različite pojavne oblike, od kojih je izbor istog broja zastupnika u izbornim jedinicama s bitno različitim brojem birača samo jedna od takvih stvari. Ukoliko različit broj birača bira isti broj zastupnika, onda je opravdano zaključiti da glasovi birača u izbornim jedinicama u kojima ih je manje imaju veću težinu nego glasovi birača u izbornim jedinicama u kojima ih je više.

To posljedično dovodi do toga da je za mandat zastupnika u izbornoj jedinici s manjim brojem birača potrebno manje glasova, a za mandat u izbornoj jedinici s većim brojem birača potreban je veći broj glasova. Ukoliko svi zastupnici imaju istovrsni mandat s aspekta njihovih prava i dužnosti, onda je jasno kako se u takvoj situaciji radi o obliku diskriminacije na temelju prebivališta.

Stoga je zakon ukinut, ali mu je rok trajanja produljen samo do 1. listopada ove godine. Zato je Vlada brže-bolje, po ljetnim žegama krenula sastavljati novi zakon, a usput ga u medijima predstavljati kao izraz genijalnog pravničkog uma ministra pravosuđa i uprave Ivana Malenice i državnih tajnika koji su mu neposredno podređeni.

Sukus onoga što se dade iščitati iz Maleničinih besjeda jest – učinili su maksimum da promijene minimum u neustavnom zakonu. I to je, da se razumijemo, posve očekivano.

Naime, ako je Ustavni sud dopustio sebi da se od 2010., kad je uputio prve prigovore na zakon, do danas zadrži samo na grintanju, logično je da Vlada očekuje kako će i novi zakon, bez obzira na to koliko ustavan ili pravedan on bio, biti jednako tretiran. Drugim riječima, oni će zakon donijeti, a o eventualnim neustavnostima će razmisliti... Za nekih 11 ili 12 godina i još četiri nova izborna kruga. A dotle, tko živ, tko mrtav!

Blago nam se, krenulo je! Parlamentarni izbori će se, bože zdravlja, održati za oko godinu dana, a kada točno – ne zna se. Možda već u proljeće, a možda iduće jeseni. No ono što se ne zna, to je po kakvom ćemo izbornom zakonu nahrupiti na birališta te, ako bude sreće, izabrati još mudrije i još sposobnije narodne predstavnike, Vladu i, dakako, premijera.

Odnosno premijerku, da budemo precizniji. Zasad se znaju imena troje možebitnih premijera – sadašnji premijer i HDZ-ov kandidat Andrej Plenković, SDP-ov Peđa Grbin, ali i Sandra Benčić iz stranke Možemo. Njih troje, uostalom, prema istraživanju Crobarometra, imaju i ponajviše šanse. Barem danas. No izbori su još jako, jako daleko.

Dok možebitni premijeri paradiraju, o izbornim pravilima Sabor će u utorak, 19. rujna, raspravljati o Vladinom Konačnom prijedlogu Zakona o izbornim jedinicama za izbor zastupnika u Hrvatski sabor. Prethodni zakon, sjećamo se, u veljači je ukinuo Ustavni sud. Neki se sjećaju da je Ustavni sud još prije 13 godina počeo opravdano grintati na Zakon, no nitko ga nije obadavao pa su se od 2010. do danas održale četiri runde parlamentarnih izbora. No popis stanovnika lani je pokazao da Ustavni sud jednostavno mora reagirati na evidentnu neustavnost izbornih pravila pa je odlučio ukinuti Zakon o izbornim jedinicama.

O čemu je riječ? Narušavanje jednakosti biračkog prava može imati različite pojavne oblike, od kojih je izbor istog broja zastupnika u izbornim jedinicama s bitno različitim brojem birača samo jedna od takvih stvari. Ukoliko različit broj birača bira isti broj zastupnika, onda je opravdano zaključiti da glasovi birača u izbornim jedinicama u kojima ih je manje imaju veću težinu nego glasovi birača u izbornim jedinicama u kojima ih je više.

To posljedično dovodi do toga da je za mandat zastupnika u izbornoj jedinici s manjim brojem birača potrebno manje glasova, a za mandat u izbornoj jedinici s većim brojem birača potreban je veći broj glasova. Ukoliko svi zastupnici imaju istovrsni mandat s aspekta njihovih prava i dužnosti, onda je jasno kako se u takvoj situaciji radi o obliku diskriminacije na temelju prebivališta.

Stoga je zakon ukinut, ali mu je rok trajanja produljen samo do 1. listopada ove godine. Zato je Vlada brže-bolje, po ljetnim žegama krenula sastavljati novi zakon, a usput ga u medijima predstavljati kao izraz genijalnog pravničkog uma ministra pravosuđa i uprave Ivana Malenice i državnih tajnika koji su mu neposredno podređeni.

Sukus onoga što se dade iščitati iz Maleničinih besjeda jest – učinili su maksimum da promijene minimum u neustavnom zakonu. I to je, da se razumijemo, posve očekivano.

Naime, ako je Ustavni sud dopustio sebi da se od 2010., kad je uputio prve prigovore na zakon, do danas zadrži samo na grintanju, logično je da Vlada očekuje kako će i novi zakon, bez obzira na to koliko ustavan ili pravedan on bio, biti jednako tretiran. Drugim riječima, oni će zakon donijeti, a o eventualnim neustavnostima će razmisliti... Za nekih 11 ili 12 godina i još četiri nova izborna kruga. A dotle, tko živ, tko mrtav!
