Zna li uopće Mario Banožić da zbog nesreće koju je izazvao u subotu ujutro više nije ministar obrane? I kako je primio tu vijest? Ta su pitanja novinari Jutarnjeg lista uputili ministru branitelja Tomi Medvedu. Odgovor nisu dobili.
Medved ga je odlučio prešutjeti iako je po informacijama proteklih dana premijer Andrej Plenković njega zadužio za komunikaciju s bivšim ministrom koji se nalazi u Kliničkom bolničkom centru u Osijeku. Medved je, kako se može iščitati iz medija, Banožića u bolnici posjetio dva puta. No, je li Banožić bio dovoljno pribran da bi mu Medved priopćio da je njegova karijera gotova, ostala je javna nepoznanica.
Rok od osam dana
Informacija o tome kada je Banožić primio vijest o smjeni bitna je kako za proceduru razrješenja ministra tako i za njegov radni status, kao i odgovor na pitanje hoće li Banožić aktivirati saborski mandat ili se namjerava povući iz politike. Kako Banožić može aktivirati svoj saborski mandat ako nema svijest o tome da više nije ministar?
Ako je Banožićevo zdravstveno stanje bilo takvo da ga nije bilo moguće suočiti s tom informacijom prošlu subotu, može li se, u pravnom smislu, računati da mu od te subote teče rok od osam dana u kojem mora odlučiti hoće li se vratiti u saborske klupe i poslati zahtjev Mandatno-imunitetnom povjerenstvu?
Rješenje o razrješenju ministra obrane objavljeno je 15. studenoga u Narodnim novinama, uz napomenu da je stupilo na snagu s danom donošenja, a taj je bio 11. studenoga. To bi značilo da odluka u Narodnim novinama vrijedi retroaktivno, da stupa na snagu bez odgode, a objavljena je s odgodom od četiri dana.
Banožićeva dužnost ministra koja je bila nespojiva s dužnošću zastupnika je prestala i on ima neotuđivo pravo na svoj mandat, ali i obavezu da ga aktivira u roku od osam dana od dana prestanka nespojive dužnosti.
Robert Jankovics, predsjednik MIP-a, 11. studenoga računa kao datum kad je Banožić smijenjen i smatra da Banožiću rok od osam dana za povratak u Sabor teče od subote, odnosno istječe u nedjelju. Nakon tog roka Banožić nema mogućnosti povratka u Sabor, napominje Jankovics, jer Poslovnik ne predviđa nikakve izuzetke.
Opcija šest plus šest
Predsjednik MIP-a smatra da su dramatične okolnosti Banožićeva razrješenja razotkrile rupu u Poslovniku i članku 13, koji nije anticipirao i situacije poslovne sposobnosti kada osoba zbog zdravstvenog stanja nije sposobna predati zahtjev.
Ne zatraži li Banožić povratak u Sabor u roku od osam dana, što mora učiniti osobno, ostaje mu opcija šest plus šest, koja će mu osigurati pola godine ministarske plaće, a potom još pola godine 50 posto tog iznosa. Njegov slučaj ostaje za raspravu.

Zna li uopće Mario Banožić da zbog nesreće koju je izazvao u subotu ujutro više nije ministar obrane? I kako je primio tu vijest? Ta su pitanja novinari Jutarnjeg lista uputili ministru branitelja Tomi Medvedu. Odgovor nisu dobili.
Medved ga je odlučio prešutjeti iako je po informacijama proteklih dana premijer Andrej Plenković njega zadužio za komunikaciju s bivšim ministrom koji se nalazi u Kliničkom bolničkom centru u Osijeku. Medved je, kako se može iščitati iz medija, Banožića u bolnici posjetio dva puta. No, je li Banožić bio dovoljno pribran da bi mu Medved priopćio da je njegova karijera gotova, ostala je javna nepoznanica.
Rok od osam dana
Informacija o tome kada je Banožić primio vijest o smjeni bitna je kako za proceduru razrješenja ministra tako i za njegov radni status, kao i odgovor na pitanje hoće li Banožić aktivirati saborski mandat ili se namjerava povući iz politike. Kako Banožić može aktivirati svoj saborski mandat ako nema svijest o tome da više nije ministar?
Ako je Banožićevo zdravstveno stanje bilo takvo da ga nije bilo moguće suočiti s tom informacijom prošlu subotu, može li se, u pravnom smislu, računati da mu od te subote teče rok od osam dana u kojem mora odlučiti hoće li se vratiti u saborske klupe i poslati zahtjev Mandatno-imunitetnom povjerenstvu?
Rješenje o razrješenju ministra obrane objavljeno je 15. studenoga u Narodnim novinama, uz napomenu da je stupilo na snagu s danom donošenja, a taj je bio 11. studenoga. To bi značilo da odluka u Narodnim novinama vrijedi retroaktivno, da stupa na snagu bez odgode, a objavljena je s odgodom od četiri dana.
Banožićeva dužnost ministra koja je bila nespojiva s dužnošću zastupnika je prestala i on ima neotuđivo pravo na svoj mandat, ali i obavezu da ga aktivira u roku od osam dana od dana prestanka nespojive dužnosti.
Robert Jankovics, predsjednik MIP-a, 11. studenoga računa kao datum kad je Banožić smijenjen i smatra da Banožiću rok od osam dana za povratak u Sabor teče od subote, odnosno istječe u nedjelju. Nakon tog roka Banožić nema mogućnosti povratka u Sabor, napominje Jankovics, jer Poslovnik ne predviđa nikakve izuzetke.
Opcija šest plus šest
Predsjednik MIP-a smatra da su dramatične okolnosti Banožićeva razrješenja razotkrile rupu u Poslovniku i članku 13, koji nije anticipirao i situacije poslovne sposobnosti kada osoba zbog zdravstvenog stanja nije sposobna predati zahtjev.
Ne zatraži li Banožić povratak u Sabor u roku od osam dana, što mora učiniti osobno, ostaje mu opcija šest plus šest, koja će mu osigurati pola godine ministarske plaće, a potom još pola godine 50 posto tog iznosa. Njegov slučaj ostaje za raspravu.
