U glavnom gradu SAD-a nedavno je od metastatskog karcinoma gušterače umrla 87-godišnja sutkinja Vrhovnog suda Ruth Bader Ginsburg, ikona liberalne Amerike, građanskih prava i feminističkog pokreta. Čak tri puta dosad pobijedila je rak, no četvrti povratak bolesti za nju je bio koban.
Po mišljenju mnogih, riječ je o istinskoj heroini koja je ostavila dubok trag u povijesti ove zemlje: o borbenom životu Ruth Bader Ginsburg snimljeni su filmovi ("Na temelju spola") i napisane brojne knjige, te je uživala gotovo mitski status nacionalne zastupnice ženskih prava i vrhunskog pravnog autoriteta.
Bila je tek druga žena u povijesti u togi vrhovne sutkinje SAD-a, a na funkciju je nominirana u vrijeme Clintonove administracije.
Najveći dio svoje prethodne karijere provela je kao zagovornica ravnopravnosti spolova, pobijedivši u brojnim raspravama baš pred Vrhovnim sudom.
Kao pro-bono odvjetnica dugo je radila za Američku uniju građanskih sloboda, te bi se bez pretjerivanja moglo reći da je predstavljala oličenje vrijednosti posve suprotnih Donaldu Trumpu. Nisu se slagali doslovno ni oko jedne teme, a sutkinja Ginsburg jednom ga je javno, krajnje nediplomatski, nazvala običnim prevarantom.
Kao dar s nebesa, njezina je smrt aktualnom predsjedniku SAD-a otvorila iznimnu priliku da manje od mjesec i pol dana prije krajnje neizvjesnih izbora osigura utjecaj nad najvišom pravnom instancom u zemlji i osvoji presudan strateški položaj za naknadne pravne bitke.
Trump je šansu odmah prepoznao, te najavio da će za nasljednicu sutkinje Ginsburg već idućeg tjedna harno nominirati također ženu, te da će se proces njezina izbora svakako završiti do izlaska na birališta.
Premda je unuka sutkinje Ginsburg Clara Spera objavila da je posljednja želja njene bake bila da joj ne imenuju nasljednika u Vrhovnom sudu dok novi predsjednik ne bude u Bijeloj kući, samo su naivci povjerovali kako će joj Trump uvažiti zadnju volju.
Čelnik konzervativne većine u Senatu Mitch McConnell je također obznanio kako odmah pokreću proces odabira novog suca, a čelnik demokratske manjine Chuck Schumer za to ne želi ni čuti, te poručuje da se prije toga imenovanja svakako treba čuti glas američkih građana.
Zanimljivo je da se istom frazom baš republikanac Mconnell 2016. godine uspješno poslužio u blokadi izbora novog suca Vrhovnog suda nakon smrti Antonina Scalie. Republikanski Senat tad je odbio potvrditi imenovanje suca Merricka Garlanda kojega je predložio tadašnji predsjednik Barack Obama.
Aktualnim naprasnim imenovanjem konzervativnog Trumpova kandidata ili kandidatkinje više bi se nego izgledno poremetila ideološko-politička ravnoteža među devet američkih vrhovnih sudaca o kojoj se tradicionalno pomno vodi računa: pet ih se dosadašnjih smatralo konzervativcima, a četvero liberalima, pa bi drastična prevaga od 6 naprema 3 itekako utjecala ne samo na postizborne rasprave, nego i na brojne pravorijeke u dugogodišnjoj američkoj sudskoj praksi. Suci Vrhovnog suda SAD-a imenuju se, naime, doživotno.
Demokratski predsjednički kandidat Joe Biden zatražio je i osobno od članova Senata da ne glasaju o kandidatu za Vrhovni sud prije predsjedničkih izbora. Plan aktualnog predsjednika i svog rivala Donalda Trumpa nazvao je izrazom "najsirovije političke moći“.
Mišljenje o Trumpovim namjerama nije, međutim, usko uvjetovano bojom političke opcije, jer i neki republikanski senatori također zagovaraju fair-play i nominiranje kandidata za Vrhovni sud nakon izbora. Senatorica Susan Collins i senatorica Lisa Murkowski, obje republikanke, zadnje su se otvoreno usprotivile Trumpovom planu, svjesne da je i većina Amerikanaca, prema provedenim anketama, nesklona takvom rješenju.
Prema anketi koju je objavio Reuters, 62 posto građana SAD-a sklono je izbor nove sutkinje Vrhovnog suda prepustiti pobjedniku skorih izbora, a samo 23 posto njih misli suprotno. S odgodom imenovanja slaže se oko 80 posto demokrata i čak 50 posto republikanaca, shvaćajući da će u suprotnom slučaju pogaziti vlastitu stranačku logiku iz 2016. godine.

U glavnom gradu SAD-a nedavno je od metastatskog karcinoma gušterače umrla 87-godišnja sutkinja Vrhovnog suda Ruth Bader Ginsburg, ikona liberalne Amerike, građanskih prava i feminističkog pokreta. Čak tri puta dosad pobijedila je rak, no četvrti povratak bolesti za nju je bio koban.
Po mišljenju mnogih, riječ je o istinskoj heroini koja je ostavila dubok trag u povijesti ove zemlje: o borbenom životu Ruth Bader Ginsburg snimljeni su filmovi ("Na temelju spola") i napisane brojne knjige, te je uživala gotovo mitski status nacionalne zastupnice ženskih prava i vrhunskog pravnog autoriteta.
Bila je tek druga žena u povijesti u togi vrhovne sutkinje SAD-a, a na funkciju je nominirana u vrijeme Clintonove administracije.
Najveći dio svoje prethodne karijere provela je kao zagovornica ravnopravnosti spolova, pobijedivši u brojnim raspravama baš pred Vrhovnim sudom.
Kao pro-bono odvjetnica dugo je radila za Američku uniju građanskih sloboda, te bi se bez pretjerivanja moglo reći da je predstavljala oličenje vrijednosti posve suprotnih Donaldu Trumpu. Nisu se slagali doslovno ni oko jedne teme, a sutkinja Ginsburg jednom ga je javno, krajnje nediplomatski, nazvala običnim prevarantom.
Kao dar s nebesa, njezina je smrt aktualnom predsjedniku SAD-a otvorila iznimnu priliku da manje od mjesec i pol dana prije krajnje neizvjesnih izbora osigura utjecaj nad najvišom pravnom instancom u zemlji i osvoji presudan strateški položaj za naknadne pravne bitke.
Trump je šansu odmah prepoznao, te najavio da će za nasljednicu sutkinje Ginsburg već idućeg tjedna harno nominirati također ženu, te da će se proces njezina izbora svakako završiti do izlaska na birališta.
Premda je unuka sutkinje Ginsburg Clara Spera objavila da je posljednja želja njene bake bila da joj ne imenuju nasljednika u Vrhovnom sudu dok novi predsjednik ne bude u Bijeloj kući, samo su naivci povjerovali kako će joj Trump uvažiti zadnju volju.
Čelnik konzervativne većine u Senatu Mitch McConnell je također obznanio kako odmah pokreću proces odabira novog suca, a čelnik demokratske manjine Chuck Schumer za to ne želi ni čuti, te poručuje da se prije toga imenovanja svakako treba čuti glas američkih građana.
Zanimljivo je da se istom frazom baš republikanac Mconnell 2016. godine uspješno poslužio u blokadi izbora novog suca Vrhovnog suda nakon smrti Antonina Scalie. Republikanski Senat tad je odbio potvrditi imenovanje suca Merricka Garlanda kojega je predložio tadašnji predsjednik Barack Obama.
Aktualnim naprasnim imenovanjem konzervativnog Trumpova kandidata ili kandidatkinje više bi se nego izgledno poremetila ideološko-politička ravnoteža među devet američkih vrhovnih sudaca o kojoj se tradicionalno pomno vodi računa: pet ih se dosadašnjih smatralo konzervativcima, a četvero liberalima, pa bi drastična prevaga od 6 naprema 3 itekako utjecala ne samo na postizborne rasprave, nego i na brojne pravorijeke u dugogodišnjoj američkoj sudskoj praksi. Suci Vrhovnog suda SAD-a imenuju se, naime, doživotno.
Demokratski predsjednički kandidat Joe Biden zatražio je i osobno od članova Senata da ne glasaju o kandidatu za Vrhovni sud prije predsjedničkih izbora. Plan aktualnog predsjednika i svog rivala Donalda Trumpa nazvao je izrazom "najsirovije političke moći“.
Mišljenje o Trumpovim namjerama nije, međutim, usko uvjetovano bojom političke opcije, jer i neki republikanski senatori također zagovaraju fair-play i nominiranje kandidata za Vrhovni sud nakon izbora. Senatorica Susan Collins i senatorica Lisa Murkowski, obje republikanke, zadnje su se otvoreno usprotivile Trumpovom planu, svjesne da je i većina Amerikanaca, prema provedenim anketama, nesklona takvom rješenju.
Prema anketi koju je objavio Reuters, 62 posto građana SAD-a sklono je izbor nove sutkinje Vrhovnog suda prepustiti pobjedniku skorih izbora, a samo 23 posto njih misli suprotno. S odgodom imenovanja slaže se oko 80 posto demokrata i čak 50 posto republikanaca, shvaćajući da će u suprotnom slučaju pogaziti vlastitu stranačku logiku iz 2016. godine.
