I prije nego što će se u Buči i čitavom nizu ukrajinskih gradova i mjesta otkriti masovne grobnice s civilnim žrtvama, postavljeno je pitanje međunarodne kaznene odgovornosti Rusije i njezina režima, s Vladimirom Putinom na čelu.

Na stranicama Slobodne Dalmacije, možda među prvima u cijelom svijetu, ovakvu je mogućnost otvorila dr. Nevenka Tromp, bivša istražiteljica u Tužiteljstvu Suda u Haagu, a danas profesorica na Sveučilištu u Amsterdamu.

 

Ona kaže da u ovom trenutku na papiru postoji četiri grupe međunarodnih konvencija i pravila, poput Ženevske, Haaške, onih o sprječavanju zločina protiv čovječnosti i kršenja običaja i pravila ratovanja, kao i univerzalne pravne jurisdikcije, ali su stvarni problem (ne)postojeći mehanizmi koji bi Putina i ruske generale, ali i druge uključene u krvavi rat, jednoga dana mogli dovesti na optuženičku klupu.

Zbog toga se dr. Tromp nemalo iznenadila pročitavši prošlog tjedna što je izjavila bivša tužiteljica Međunarodnog suda za bivšu Jugoslaviju (ICTY) Carla del Ponte, koja je zatražila da se hitno izda uhidbeni nalog za Putina.

– To je jedini instrument koji imamo, a koji nam omogućuje uhićenje počinitelja ratnih zločina i njihovo dovođenje pred Međunarodni kazneni sud (ICC). (...) Ako (Putin) ostane u Rusiji, nikada ne bi došlo do toga. Ali uhidbeni bi mu nalog onemogućio napuštanje zemlje i bio bi to snažan signal da protiv sebe ima mnogo država – objasnila je.

Za dr. Tromp ovakve riječi istaknute protagonistice u međunarodnim pravosudnim krugovima nisu ništa drugo nego nepoznavanje jurisdikcije, odnosno pravosudne nadležnosti i organa koji bi takvo što mogli učiniti u prvom koraku. Ako je i od Carle del Ponte, puno je, rekli bismo.

– Del Ponte govori o individualnoj kaznenoj odgovornosti. Za nju, međutim, postoje dvije mogućnosti. Jedna je da se to radi preko ICC-a, ali problem je u tome što taj sud zapravo može učiniti. Njegova jurisdikcija počinje od trenutka osnivanja 2002. godine i obuhvaća sve zločine počinjene nakon toga, znači i one u Ukrajini. Međutim, za otvaranje istraga, i pogotovo za početak suđenja, potrebno je naći način tko i kako to može. Rusija ne priznaje ovaj sud, niti će ga ikada priznati, dok Ukrajina čak nije ni ratificirala svoje članstvo, ali je ipak priznala nadležnost. Ako se, pak, računa na Ujedinjene narode, svi znamo koji je problem tamo, odnosno Rusija kao stalna članica Vijeća sigurnosti ima jednu od najvažnijih uloga, i što god odlučila Opća skupština, bilo koja odluka mora proći kroz taj “mišić”, organ. I to je veliki problem. ICC i njegov glavni tužitelj poručili su da oni ispituju neke slučajeve, ali i sami su svjesni problema kako to može pravosudno zaživjeti. Do sada nije bilo takvog slučaja da čelnik jedne od pet stalnih članica Vijeća sigurnosti bude optužen – objasnit će naša sugovornica.

Osim što ne razumije del Ponte, dr. Tromp je iznenađena i odjekom koji su njezine riječi imale u medijima. Jer, reći će, ako se i nađe rješenje za to tko će podignuti optužnicu i izdati uhidbeni nalog, tko je taj koji će otići u Rusiju i uhititi Putina, pa je vjerojatnije da će samo ostati zarobljenik svojeg okružja. Osim toga, veli i da su prilično promašene paralele sa slučajem Slobodana Miloševića.

– Ti se slučajevi – objašnjava – potpuno razlikuju. Prvo, u momentu kad se podizala prva optužnica protiv Miloševića, ICTY je postojao već šest godina. Sudište poput ICTY-a je ad hoc tribunal, takva mogućnost postoji i za Ukrajinu, ali otvara se pitanje legitimnosti i legalnosti jer se ne može računati na punu podršku UN-a, kakvu smo imali za bivšu Jugoslaviju ili Ruandu.

Otvaraju se i pitanja financiranja i logistike za jedno takvo sudište, koje bi trebalo biti u svijetu općeprihvaćeno ili barem u nekoj hibridnoj formi, poput onih za Libanon i Kambodžu, gdje je pola plaćao UN, pola same zemlje. U slučaju Rusije nema nikakve šanse da UN doprinese legitimizaciji takvog nečega – veli profesorica iz Amsterdama, uvjerena da bi Moskva svaki takav korak prikazala kao formu specijalnog rata.

Na koncu se opet vratila na Carlu del Ponte, sada zbog uloge koju je imala kao specijalna istražiteljica zločina počinjenih u Siriji.

– Ona je bila članica tročlane UN-ove komisije koja se bavi konfliktima koji su u tijeku da bi se stvorila baza podataka ako bi to trebalo jednoga dana. Na samom početku sukoba imali smo vijesti da Asad, na čijoj su strani bili i ostali Rusi, koristi kemijsko oružje, koje je, kao i nuklearno, svrstano u klasu oružja za masovno uništenje.

A što je učinila del Ponte? Iako nije bila predsjednica komisije, ona je izišla s podatkom da i oporba, koju je podržavao Zapad, koristi isto oružje, što je stvorilo veliku pomutnju u svjetskoj javnosti. Na koncu nije odmah došlo do intervencije, nego se sve pretvorilo u dugotrajni rat i u njega se uvuklo neke zemlje uvijek nesklone Americi i Zapadu, poput Irana.

Uloga Carle del Ponte nikada nije edukativna, nikada konstruktivna, nego je uvijek “antiprotivna”. Koliko poznajem njezin način funkcioniranja, njezin je jedini interes pojavljivanje u medijima i stvaranje bombastičnog imidža, često na štetu činjenica i razumijevanja prava i pravne strukture – rekla je bez ustručavanja profesorica Tromp.

I prije nego što će se u Buči i čitavom nizu ukrajinskih gradova i mjesta otkriti masovne grobnice s civilnim žrtvama, postavljeno je pitanje međunarodne kaznene odgovornosti Rusije i njezina režima, s Vladimirom Putinom na čelu.

Na stranicama Slobodne Dalmacije, možda među prvima u cijelom svijetu, ovakvu je mogućnost otvorila dr. Nevenka Tromp, bivša istražiteljica u Tužiteljstvu Suda u Haagu, a danas profesorica na Sveučilištu u Amsterdamu.

 

Ona kaže da u ovom trenutku na papiru postoji četiri grupe međunarodnih konvencija i pravila, poput Ženevske, Haaške, onih o sprječavanju zločina protiv čovječnosti i kršenja običaja i pravila ratovanja, kao i univerzalne pravne jurisdikcije, ali su stvarni problem (ne)postojeći mehanizmi koji bi Putina i ruske generale, ali i druge uključene u krvavi rat, jednoga dana mogli dovesti na optuženičku klupu.

Zbog toga se dr. Tromp nemalo iznenadila pročitavši prošlog tjedna što je izjavila bivša tužiteljica Međunarodnog suda za bivšu Jugoslaviju (ICTY) Carla del Ponte, koja je zatražila da se hitno izda uhidbeni nalog za Putina.

– To je jedini instrument koji imamo, a koji nam omogućuje uhićenje počinitelja ratnih zločina i njihovo dovođenje pred Međunarodni kazneni sud (ICC). (...) Ako (Putin) ostane u Rusiji, nikada ne bi došlo do toga. Ali uhidbeni bi mu nalog onemogućio napuštanje zemlje i bio bi to snažan signal da protiv sebe ima mnogo država – objasnila je.

Za dr. Tromp ovakve riječi istaknute protagonistice u međunarodnim pravosudnim krugovima nisu ništa drugo nego nepoznavanje jurisdikcije, odnosno pravosudne nadležnosti i organa koji bi takvo što mogli učiniti u prvom koraku. Ako je i od Carle del Ponte, puno je, rekli bismo.

– Del Ponte govori o individualnoj kaznenoj odgovornosti. Za nju, međutim, postoje dvije mogućnosti. Jedna je da se to radi preko ICC-a, ali problem je u tome što taj sud zapravo može učiniti. Njegova jurisdikcija počinje od trenutka osnivanja 2002. godine i obuhvaća sve zločine počinjene nakon toga, znači i one u Ukrajini. Međutim, za otvaranje istraga, i pogotovo za početak suđenja, potrebno je naći način tko i kako to može. Rusija ne priznaje ovaj sud, niti će ga ikada priznati, dok Ukrajina čak nije ni ratificirala svoje članstvo, ali je ipak priznala nadležnost. Ako se, pak, računa na Ujedinjene narode, svi znamo koji je problem tamo, odnosno Rusija kao stalna članica Vijeća sigurnosti ima jednu od najvažnijih uloga, i što god odlučila Opća skupština, bilo koja odluka mora proći kroz taj “mišić”, organ. I to je veliki problem. ICC i njegov glavni tužitelj poručili su da oni ispituju neke slučajeve, ali i sami su svjesni problema kako to može pravosudno zaživjeti. Do sada nije bilo takvog slučaja da čelnik jedne od pet stalnih članica Vijeća sigurnosti bude optužen – objasnit će naša sugovornica.

Osim što ne razumije del Ponte, dr. Tromp je iznenađena i odjekom koji su njezine riječi imale u medijima. Jer, reći će, ako se i nađe rješenje za to tko će podignuti optužnicu i izdati uhidbeni nalog, tko je taj koji će otići u Rusiju i uhititi Putina, pa je vjerojatnije da će samo ostati zarobljenik svojeg okružja. Osim toga, veli i da su prilično promašene paralele sa slučajem Slobodana Miloševića.

– Ti se slučajevi – objašnjava – potpuno razlikuju. Prvo, u momentu kad se podizala prva optužnica protiv Miloševića, ICTY je postojao već šest godina. Sudište poput ICTY-a je ad hoc tribunal, takva mogućnost postoji i za Ukrajinu, ali otvara se pitanje legitimnosti i legalnosti jer se ne može računati na punu podršku UN-a, kakvu smo imali za bivšu Jugoslaviju ili Ruandu.

Otvaraju se i pitanja financiranja i logistike za jedno takvo sudište, koje bi trebalo biti u svijetu općeprihvaćeno ili barem u nekoj hibridnoj formi, poput onih za Libanon i Kambodžu, gdje je pola plaćao UN, pola same zemlje. U slučaju Rusije nema nikakve šanse da UN doprinese legitimizaciji takvog nečega – veli profesorica iz Amsterdama, uvjerena da bi Moskva svaki takav korak prikazala kao formu specijalnog rata.

Na koncu se opet vratila na Carlu del Ponte, sada zbog uloge koju je imala kao specijalna istražiteljica zločina počinjenih u Siriji.

– Ona je bila članica tročlane UN-ove komisije koja se bavi konfliktima koji su u tijeku da bi se stvorila baza podataka ako bi to trebalo jednoga dana. Na samom početku sukoba imali smo vijesti da Asad, na čijoj su strani bili i ostali Rusi, koristi kemijsko oružje, koje je, kao i nuklearno, svrstano u klasu oružja za masovno uništenje.

A što je učinila del Ponte? Iako nije bila predsjednica komisije, ona je izišla s podatkom da i oporba, koju je podržavao Zapad, koristi isto oružje, što je stvorilo veliku pomutnju u svjetskoj javnosti. Na koncu nije odmah došlo do intervencije, nego se sve pretvorilo u dugotrajni rat i u njega se uvuklo neke zemlje uvijek nesklone Americi i Zapadu, poput Irana.

Uloga Carle del Ponte nikada nije edukativna, nikada konstruktivna, nego je uvijek “antiprotivna”. Koliko poznajem njezin način funkcioniranja, njezin je jedini interes pojavljivanje u medijima i stvaranje bombastičnog imidža, često na štetu činjenica i razumijevanja prava i pravne strukture – rekla je bez ustručavanja profesorica Tromp.
