Devet puta su radnici Vodovoda dolazili spajati nelegalni priključak mog susjeda i devet puta sam ih zaustavljao. Došli su i deseti put, u sedam sati ujutro, i priključili ga, ali ja neću odustati.

Tako glasi uvod u priču Darija Dundovića, mještanina Radovina koji tvrdi da se dugo „bori s vjetrenjačama iz zadarskog Vodovoda.

-Rekao sam radnicima da ne mogu spajati priključak jer nisu riješeni imovinski odnosi između mene i susjeda. Jednom su pozvali policajce, a oni su mi, iako nisam stvarao nered niti bilo kome prijetio, oduzeli tri lovačke puške kao da sam kršio javni red i mir. U stvari, to su radili radnici Vodovoda jer se sve to događa na zemljištu za koje imam vlasnički list, uvjeren je Dundović.

Odlazio je, tvrdi, 20 puta u Vodovod, zvao i tražio sastanak s direktorom Tomom Matekom.

-Želio sam ih pitati kako su ga priključili bez građevinske dozvole i legalizacije. Jedna osoba iz pravne službe Vodovoda mi je rekla da su oni napisali rješenje da je priključak nelegalan, ali je Matek rekao da to do njega nije došlo i tražio da mu otkrijem tko mi je to rekao. Odbio sam to, a on je predamnom dao nalog da se priključak ukloni. Ali, ni nakon toga se nije dogodilo ništa, priključak je i dalje tamo, na dijelu mog zemljišta kojeg je susjed uzurpirao, a spojna cijev, bez ikakvog odobrenja, ide preko moje druge parcele. Neka susjed dobije vodu, nemam ja ništa protiv toga, pogotovo što ima djecu i bavi se turizmom, ali mora se poštivati zakonska procedura i moje vlasništvo, kaže Dundović.

Umoran od svega, odlučio je podnijeti prijave:

-Prošlog tjedna sam podnio kaznenu prijavu protiv direktora Mateka zbog pogodovanja. Ne mogu to dokazati, ali sam uvjeren da je sve to išlo preko „političke linije” i veza s Općinom Ražanac koja je o ovome sve znala. Prijavu sam podnio i protiv zemljišnoknjižne referentice koja je susjeda „na riječ” upisala kao vlasnika mog zemljišta, zaključuje Dario Dundović.

Iz Vodovoda su nam potvrdili da su sredinom 2017. godine dobili zahtjev za odobrenje spornog priključka, te da je Dundovićev susjed “tom prilikom priložio svu potrebnu dokumentaciju za ostvarenje prava na privremeni priključak za vodu i to iz razloga što u to vrijeme nije bio dovršen postupak legalizacije objekta koji se spaja na vodoopskrbni sustav”.

U Vodovodu, dakako, znaju za otpor Darija Dundovića I višekratno obustavljanje priključivanja i tvrde da je Dundović upozoravao da vlasnik priključka nije zakoniti posjednik dijela terena na kojeg je trebala biti položena spojna cijev.

-Dundović u prilog svojim tvrdnjama nije imao valjan pisani dokaz, dok je korisnik predočio pravomoćnu presudu kojom je odbijen tužbeni zahtjev za predaju u posjed spornog dijela č.z. nakon čega je dana 10.03.2021. godine priključak izveden uz asistenciju službenika PU Zadarske, kažu iz Vodovoda.

Ipak, iz zadarskog komunalca skreću pažnju I na neke druge činjuenice.

-Početkom 2021. godine započet je postupak nove izmjere na području k.o. Radovin, te je tijekom tog postupka formirana č.z. koja nije u vlasništvu Dundovićevog susjeda, a na kojoj se nalazi prilazni put do nekretnine korisnika kao i spojni vod, dok je šaht priključka na č.z. u njegovom vlasništvu. Upozorili smo ga na neriješene imovinsko-pravne odnose na č.z. na kojoj je spojni vod, te je pozvan da se očituje o novim okolnostima, zaključuju iz Vodovoda.

Devet puta su radnici Vodovoda dolazili spajati nelegalni priključak mog susjeda i devet puta sam ih zaustavljao. Došli su i deseti put, u sedam sati ujutro, i priključili ga, ali ja neću odustati.

Tako glasi uvod u priču Darija Dundovića, mještanina Radovina koji tvrdi da se dugo „bori s vjetrenjačama iz zadarskog Vodovoda.

-Rekao sam radnicima da ne mogu spajati priključak jer nisu riješeni imovinski odnosi između mene i susjeda. Jednom su pozvali policajce, a oni su mi, iako nisam stvarao nered niti bilo kome prijetio, oduzeli tri lovačke puške kao da sam kršio javni red i mir. U stvari, to su radili radnici Vodovoda jer se sve to događa na zemljištu za koje imam vlasnički list, uvjeren je Dundović.

Odlazio je, tvrdi, 20 puta u Vodovod, zvao i tražio sastanak s direktorom Tomom Matekom.

-Želio sam ih pitati kako su ga priključili bez građevinske dozvole i legalizacije. Jedna osoba iz pravne službe Vodovoda mi je rekla da su oni napisali rješenje da je priključak nelegalan, ali je Matek rekao da to do njega nije došlo i tražio da mu otkrijem tko mi je to rekao. Odbio sam to, a on je predamnom dao nalog da se priključak ukloni. Ali, ni nakon toga se nije dogodilo ništa, priključak je i dalje tamo, na dijelu mog zemljišta kojeg je susjed uzurpirao, a spojna cijev, bez ikakvog odobrenja, ide preko moje druge parcele. Neka susjed dobije vodu, nemam ja ništa protiv toga, pogotovo što ima djecu i bavi se turizmom, ali mora se poštivati zakonska procedura i moje vlasništvo, kaže Dundović.

Umoran od svega, odlučio je podnijeti prijave:

-Prošlog tjedna sam podnio kaznenu prijavu protiv direktora Mateka zbog pogodovanja. Ne mogu to dokazati, ali sam uvjeren da je sve to išlo preko „političke linije” i veza s Općinom Ražanac koja je o ovome sve znala. Prijavu sam podnio i protiv zemljišnoknjižne referentice koja je susjeda „na riječ” upisala kao vlasnika mog zemljišta, zaključuje Dario Dundović.

Iz Vodovoda su nam potvrdili da su sredinom 2017. godine dobili zahtjev za odobrenje spornog priključka, te da je Dundovićev susjed “tom prilikom priložio svu potrebnu dokumentaciju za ostvarenje prava na privremeni priključak za vodu i to iz razloga što u to vrijeme nije bio dovršen postupak legalizacije objekta koji se spaja na vodoopskrbni sustav”.

U Vodovodu, dakako, znaju za otpor Darija Dundovića I višekratno obustavljanje priključivanja i tvrde da je Dundović upozoravao da vlasnik priključka nije zakoniti posjednik dijela terena na kojeg je trebala biti položena spojna cijev.

-Dundović u prilog svojim tvrdnjama nije imao valjan pisani dokaz, dok je korisnik predočio pravomoćnu presudu kojom je odbijen tužbeni zahtjev za predaju u posjed spornog dijela č.z. nakon čega je dana 10.03.2021. godine priključak izveden uz asistenciju službenika PU Zadarske, kažu iz Vodovoda.

Ipak, iz zadarskog komunalca skreću pažnju I na neke druge činjuenice.

-Početkom 2021. godine započet je postupak nove izmjere na području k.o. Radovin, te je tijekom tog postupka formirana č.z. koja nije u vlasništvu Dundovićevog susjeda, a na kojoj se nalazi prilazni put do nekretnine korisnika kao i spojni vod, dok je šaht priključka na č.z. u njegovom vlasništvu. Upozorili smo ga na neriješene imovinsko-pravne odnose na č.z. na kojoj je spojni vod, te je pozvan da se očituje o novim okolnostima, zaključuju iz Vodovoda.

Devet puta su radnici Vodovoda dolazili spajati nelegalni priključak mog susjeda i devet puta sam ih zaustavljao. Došli su i deseti put, u sedam sati ujutro, i priključili ga, ali ja neću odustati.

Tako glasi uvod u priču Darija Dundovića, mještanina Radovina koji tvrdi da se dugo „bori s vjetrenjačama iz zadarskog Vodovoda.

-Rekao sam radnicima da ne mogu spajati priključak jer nisu riješeni imovinski odnosi između mene i susjeda. Jednom su pozvali policajce, a oni su mi, iako nisam stvarao nered niti bilo kome prijetio, oduzeli tri lovačke puške kao da sam kršio javni red i mir. U stvari, to su radili radnici Vodovoda jer se sve to događa na zemljištu za koje imam vlasnički list, uvjeren je Dundović.

Odlazio je, tvrdi, 20 puta u Vodovod, zvao i tražio sastanak s direktorom Tomom Matekom.

-Želio sam ih pitati kako su ga priključili bez građevinske dozvole i legalizacije.
