Vrhovni sud Republike Hrvatske u trećem je stupnju donio presudu kojom je odbio žalbu oca (54), koji je svoje četvero djece bacio s balkona kuće na Pagu, kao neosnovanu i potvrdio drugostupanjsku presudu Vrhovnog suda Republike Hrvatske iz 11. svibnja 2021.

Time je postala pravomoćna presuda kojom je otac s Paga osuđen na jedinstvenu kaznu dugotrajnog zatvora od trideset godina. U kaznu je uračunato vrijeme provedeno u istražnom zatvoru u kojem se i dalje nalazi od 28. veljače 2019. Uz kaznu mu je izrečena i sigurnosna mjera obveznog psihijatrijskog liječenja koja će se provoditi u okviru zatvorskog sustava i može trajati do prestanka izvršenja kazne zatvora.

Žalbu je podnio zbog „bitne povrede odredaba kaznenog postupka, kaznenog zakona, pogrešno i nepotpuno utvrđenog činjeničnog stanja i odluke o kazni, s prijedlogom da Vrhovni sud Republike Hrvatske „pobijanu presudu ukine i uputi predmet prvostupanjskom sudu na ponovno suđenje i odlučivanje“. Sjednica vijeća je održana 21. prosinca u prisutnosti optuženika uz pomoć tehničkog uređaja za vezu na daljinu,

Razmatrajući optuženikovo odrastanje i obiteljsko okruženje, vještaci su mu dijagnosticirali disocijalni poremećaj ličnosti koji ima sekundarni značaj u odnosu na dijagnosticirani psihoorganski sindrom koji je nastao prvenstveno razvojem hidrocefalusa. Kod osoba s tim sindromom, prema mišljenju neurologa, vrlo mali povod može dovesti do oscilacija u psihičkom stanju, koje mogu dovesti do oslobađanja agresivnih impulsa, ali i do bržeg vraćanja na normalnu razinu funkcioniranja što je karakteristika hipertenzivnog cefalusa. U konkretnom slučaju, prema mišljenju vještaka, nema elemenata koji bi upućivali na zaključak da bi kod optuženika došlo do potpunog isključenja njegovih sposobnosti shvaćanja djela i upravljanja svojom voljom, niti je došlo do prekida odnosa s realitetom.

Osuđen je zbog pokušaja teškog ubojstva svoje četvero djece u dobi 3, 5, 7 i 8 godina 28. veljače 2019. godine.

U šest sati ujutro uzeo je jedno po jedno dijete iz kreveta u kojima su spavali. Bacio ih je s terase ispred ulaznih vrata stana s visine od gotovo pa pet metara na betonsku podlogu u dvorištu. Djeca su ozlijeđena. Jedno je dijete zadobilo teške i po život opasne ozljede, a drugo teške ozljede. Smrt djece izbjegnuta je samo stjecajem sretnih okolnosti.

Vrhovni sud smatra da je odluka drugostupanjskog suda o kazni u svemu primjerena ličnosti optuženika i svim okolnostima počinjenih kaznenih djela. Kazna nije ni prestroga ni preblaga. Otegotna okolnost bila je dosadašnja osuđivanost zbog kaznenog djela povrede djetetovih prava. Olakotnim je optuženiku cijenjeno njegovo priznanje, izraženo žaljenje, te bitno smanjena ubrojivost koju nije skrivio.

Utvrđen je psihoorganski sindrom uzrokovan organskim činiteljima (oštećenje moždanih funkcija) zbog čega ima trajno oštećenje psihičkih funkcija i oscilacije u psihičkom stanju. Narušeno mu je i fizičko zdravstveno stanje. Kaznena djela ostala su u pokušaju.

Vrhovni sud RH smatra da će se jedinstvenom kaznom dugotrajnog zatvora 30 godina, koja obuhvaća i kaznu iz opozvane uvjetne osude, ispuniti svrha kažnjavanja i izraziti jasna društvena osuda. Kazna treba utjecati na optuženika da shvati krajnju neprihvatljivost vlastitog postupka i ubuduće ne čini kaznena djela, a svim građanima pokazati da je činjenje kaznenih djela pogibeljno, a kažnjavanje njihovih počinitelja pravedno. Osim toga, pojačat će se povjerenje građana u pravni poredak koji treba biti utemeljen na vladavini prava.

Protiv presude Vrhovnog suda Republike Hrvatske donesene u trećem stupnju nije dopuštena žalba.

Vrhovni sud Republike Hrvatske u trećem je stupnju donio presudu kojom je odbio žalbu oca (54), koji je svoje četvero djece bacio s balkona kuće na Pagu, kao neosnovanu i potvrdio drugostupanjsku presudu Vrhovnog suda Republike Hrvatske iz 11. svibnja 2021.

Time je postala pravomoćna presuda kojom je otac s Paga osuđen na jedinstvenu kaznu dugotrajnog zatvora od trideset godina. U kaznu je uračunato vrijeme provedeno u istražnom zatvoru u kojem se i dalje nalazi od 28. veljače 2019. Uz kaznu mu je izrečena i sigurnosna mjera obveznog psihijatrijskog liječenja koja će se provoditi u okviru zatvorskog sustava i može trajati do prestanka izvršenja kazne zatvora.

Žalbu je podnio zbog „bitne povrede odredaba kaznenog postupka, kaznenog zakona, pogrešno i nepotpuno utvrđenog činjeničnog stanja i odluke o kazni, s prijedlogom da Vrhovni sud Republike Hrvatske „pobijanu presudu ukine i uputi predmet prvostupanjskom sudu na ponovno suđenje i odlučivanje“. Sjednica vijeća je održana 21. prosinca u prisutnosti optuženika uz pomoć tehničkog uređaja za vezu na daljinu,

Razmatrajući optuženikovo odrastanje i obiteljsko okruženje, vještaci su mu dijagnosticirali disocijalni poremećaj ličnosti koji ima sekundarni značaj u odnosu na dijagnosticirani psihoorganski sindrom koji je nastao prvenstveno razvojem hidrocefalusa. Kod osoba s tim sindromom, prema mišljenju neurologa, vrlo mali povod može dovesti do oscilacija u psihičkom stanju, koje mogu dovesti do oslobađanja agresivnih impulsa, ali i do bržeg vraćanja na normalnu razinu funkcioniranja što je karakteristika hipertenzivnog cefalusa. U konkretnom slučaju, prema mišljenju vještaka, nema elemenata koji bi upućivali na zaključak da bi kod optuženika došlo do potpunog isključenja njegovih sposobnosti shvaćanja djela i upravljanja svojom voljom, niti je došlo do prekida odnosa s realitetom.

Osuđen je zbog pokušaja teškog ubojstva svoje četvero djece u dobi 3, 5, 7 i 8 godina 28. veljače 2019. godine.

U šest sati ujutro uzeo je jedno po jedno dijete iz kreveta u kojima su spavali. Bacio ih je s terase ispred ulaznih vrata stana s visine od gotovo pa pet metara na betonsku podlogu u dvorištu. Djeca su ozlijeđena. Jedno je dijete zadobilo teške i po život opasne ozljede, a drugo teške ozljede. Smrt djece izbjegnuta je samo stjecajem sretnih okolnosti.

Vrhovni sud smatra da je odluka drugostupanjskog suda o kazni u svemu primjerena ličnosti optuženika i svim okolnostima počinjenih kaznenih djela. Kazna nije ni prestroga ni preblaga. Otegotna okolnost bila je dosadašnja osuđivanost zbog kaznenog djela povrede djetetovih prava. Olakotnim je optuženiku cijenjeno njegovo priznanje, izraženo žaljenje, te bitno smanjena ubrojivost koju nije skrivio.

Utvrđen je psihoorganski sindrom uzrokovan organskim činiteljima (oštećenje moždanih funkcija) zbog čega ima trajno oštećenje psihičkih funkcija i oscilacije u psihičkom stanju. Narušeno mu je i fizičko zdravstveno stanje. Kaznena djela ostala su u pokušaju.

Vrhovni sud RH smatra da će se jedinstvenom kaznom dugotrajnog zatvora 30 godina, koja obuhvaća i kaznu iz opozvane uvjetne osude, ispuniti svrha kažnjavanja i izraziti jasna društvena osuda. Kazna treba utjecati na optuženika da shvati krajnju neprihvatljivost vlastitog postupka i ubuduće ne čini kaznena djela, a svim građanima pokazati da je činjenje kaznenih djela pogibeljno, a kažnjavanje njihovih počinitelja pravedno. Osim toga, pojačat će se povjerenje građana u pravni poredak koji treba biti utemeljen na vladavini prava.

Protiv presude Vrhovnog suda Republike Hrvatske donesene u trećem stupnju nije dopuštena žalba.

Vrhovni sud Republike Hrvatske u trećem je stupnju donio presudu kojom je odbio žalbu oca (54), koji je svoje četvero djece bacio s balkona kuće na Pagu, kao neosnovanu i potvrdio drugostupanjsku presudu Vrhovnog suda Republike Hrvatske iz 11. svibnja 2021.

Time je postala pravomoćna presuda kojom je otac s Paga osuđen na jedinstvenu kaznu dugotrajnog zatvora od trideset godina. U kaznu je uračunato vrijeme provedeno u istražnom zatvoru u kojem se i dalje nalazi od 28. veljače 2019. Uz kaznu mu je izrečena i sigurnosna mjera obveznog psihijatrijskog liječenja koja će se provoditi u okviru zatvorskog sustava i može trajati do prestanka izvršenja kazne zatvora.

Žalbu je podnio zbog „bitne povrede odredaba kaznenog postupka, kaznenog zakona, pogrešno i nepotpuno utvrđenog činjeničnog stanja i odluke o kazni, s prijedlogom da Vrhovni sud Republike Hrvatske „pobijanu presudu ukine i uputi predmet prvostupanjskom sudu na ponovno suđenje i odlučivanje“. Sjednica vijeća je održana 21. prosinca u prisutnosti optuženika uz pomoć tehničkog uređaja za vezu na daljinu,

Razmatrajući optuženikovo odrastanje i obiteljsko okruženje, vještaci su mu dijagnosticirali disocijalni poremećaj ličnosti koji ima sekundarni značaj u odnosu na dijagnosticirani psihoorganski sindrom koji je nastao prvenstveno razvojem hidrocefalusa. Kod osoba s tim sindromom, prema mišljenju neurologa, vrlo mali povod može dovesti do oscilacija u psihičkom stanju, koje mogu dovesti do oslobađanja agresivnih impulsa, ali i do bržeg vraćanja na normalnu razinu funkcioniranja što je karakteristika hipertenzivnog cefalusa. U konkretnom slučaju, prema mišljenju vještaka, nema elemenata koji bi upućivali na zaključak da bi kod optuženika došlo do potpunog isključenja njegovih sposobnosti shvaćanja djela i upravljanja svojom voljom, niti je došlo do prekida odnosa s realitetom.
