Devet mjeseci od službenog kraja turbulentnog braka, sudska trakavica zadarskog pjevača i kantautora Mladena Grdovića (61) i njegove dvanaest godina mlađe supruge Brankice i dalje traje.

Najnovijom presudom od 9.veljače Općinski sud u Zadru odbio je tužbu kojom Brankica Paleka traži da Grdović ispuni uvjete Ugovora o trajnom nalogu kojim je 28. kolovoza 2019. obavezao banku da na teret njegovog računa mjesečno supruzi za cijelog njezinog života uplaćuje iznos od 15 tisuća kuna u 120 rata počevši od 1. listopada 2019.

U postupku je utvrđeno kako je jedna isplata Brankici bila izvršena u rujnu 2019., nakon čega je Grdović namjerno onemogućio izvršenje svojih obveza iz sporazuma, na način da novčana sredstva koja mu budu isplaćena na račun, odmah podiže ili dalje transferira.

Brankica je na sudu tražila iznos od 45 tisuća kuna sa zateznim kamatama za listopad, studeni i prosinac 2019. godine, međutim Grdović se tome usprotivio, a sud je u konačnici donio odluku Grdoviću u korist jer na njegovim računima nema dovoljno sredstava, pa banka ne može izvršavati nalog i isplaćivati mjesečne iznose na koje se on obavezao sporazumom.

U obrazloženju se navodi kako trajni nalog prestaje vrijediti ako korisnik naloga nije osigurao sredstva na računu. K tome je pravomoćnim rješenjem Općinskog suda u Zadru, od 9. studenog 2020., utvrđeno i da je Brankica povukla tužbu koju je podnijela protiv Mladena Grdovića i banke radi otvaranja trajnog naloga.

- Evidentno je da je i tužiteljica odustala od zahtjeva za isplatu sredstava od tuženika putem trajnog naloga, kada je povukla tužbu podnesenu protiv tuženika i banke radi isplate na taj način. Parnične stranke su zasnovale obveznopravni odnos te su u smislu odredbe članka 9. ZOO dužne ispunjavati svoje obveze i odgovorne su za ispunjenje istih. Međutim, u konkretnom slučaju nije jasan sadržaj obveze tuženika, obzirom da nije definirano dospijeće tražbine, posebno u situaciji kada je ugovor o trajnom nalogu prestao zbog nedostatka sredstava, a tužiteljica odustala od zahtijevanja otvaranja istog prisilnim putem. Sadržaj obveze tuženika propisan odredbom članka 166. stavka 1. ZOO nije određen. Nadalje, rok ispunjenja obveze nije određen sporazumom stranaka niti je propisan Zakonom, sve u smislu odredbi članka 173. stavaka 1. i 2. ZOO. Stoga je ovaj sud stava da je činidba iz predmetnog sporazuma neodređena i neodrediva, pa da je sukladno odredbi članka 270. stavaka 1. ZOO, taj sporazum stranaka ništetan - navodi se u obrazloženju presude.

Iako je pjevač cijelo vrijeme opovrgavao loše odnose tvrdeći kako “ljubav sve pobjeđuje” Brankica je 21. svibnja prošle godine nakon 22 godine braka podnijela tužbu protiv pjevača radi razvoda braka, a sud je njezinu tužbu potvrdio u kolovozu zaključivši kako nema šanse da se par pomiri.

Brankica je u tužbi navela kako su ona i Mladen zaključili brak 4. svibnja 1998. godine, no da su njihovi bračni odnosi teško i trajno poremećeni, te da zajednički život više nije moguć.

Devet mjeseci od službenog kraja turbulentnog braka, sudska trakavica zadarskog pjevača i kantautora Mladena Grdovića (61) i njegove dvanaest godina mlađe supruge Brankice i dalje traje.

Najnovijom presudom od 9.veljače Općinski sud u Zadru odbio je tužbu kojom Brankica Paleka traži da Grdović ispuni uvjete Ugovora o trajnom nalogu kojim je 28. kolovoza 2019. obavezao banku da na teret njegovog računa mjesečno supruzi za cijelog njezinog života uplaćuje iznos od 15 tisuća kuna u 120 rata počevši od 1. listopada 2019.

U postupku je utvrđeno kako je jedna isplata Brankici bila izvršena u rujnu 2019., nakon čega je Grdović namjerno onemogućio izvršenje svojih obveza iz sporazuma, na način da novčana sredstva koja mu budu isplaćena na račun, odmah podiže ili dalje transferira.

Brankica je na sudu tražila iznos od 45 tisuća kuna sa zateznim kamatama za listopad, studeni i prosinac 2019. godine, međutim Grdović se tome usprotivio, a sud je u konačnici donio odluku Grdoviću u korist jer na njegovim računima nema dovoljno sredstava, pa banka ne može izvršavati nalog i isplaćivati mjesečne iznose na koje se on obavezao sporazumom.

U obrazloženju se navodi kako trajni nalog prestaje vrijediti ako korisnik naloga nije osigurao sredstva na računu. K tome je pravomoćnim rješenjem Općinskog suda u Zadru, od 9. studenog 2020., utvrđeno i da je Brankica povukla tužbu koju je podnijela protiv Mladena Grdovića i banke radi otvaranja trajnog naloga.

- Evidentno je da je i tužiteljica odustala od zahtjeva za isplatu sredstava od tuženika putem trajnog naloga, kada je povukla tužbu podnesenu protiv tuženika i banke radi isplate na taj način. Parnične stranke su zasnovale obveznopravni odnos te su u smislu odredbe članka 9. ZOO dužne ispunjavati svoje obveze i odgovorne su za ispunjenje istih. Međutim, u konkretnom slučaju nije jasan sadržaj obveze tuženika, obzirom da nije definirano dospijeće tražbine, posebno u situaciji kada je ugovor o trajnom nalogu prestao zbog nedostatka sredstava, a tužiteljica odustala od zahtijevanja otvaranja istog prisilnim putem. Sadržaj obveze tuženika propisan odredbom članka 166. stavka 1. ZOO nije određen. Nadalje, rok ispunjenja obveze nije određen sporazumom stranaka niti je propisan Zakonom, sve u smislu odredbi članka 173. stavaka 1. i 2. ZOO. Stoga je ovaj sud stava da je činidba iz predmetnog sporazuma neodređena i neodrediva, pa da je sukladno odredbi članka 270. stavaka 1. ZOO, taj sporazum stranaka ništetan - navodi se u obrazloženju presude.

Iako je pjevač cijelo vrijeme opovrgavao loše odnose tvrdeći kako “ljubav sve pobjeđuje” Brankica je 21. svibnja prošle godine nakon 22 godine braka podnijela tužbu protiv pjevača radi razvoda braka, a sud je njezinu tužbu potvrdio u kolovozu zaključivši kako nema šanse da se par pomiri.

Brankica je u tužbi navela kako su ona i Mladen zaključili brak 4. svibnja 1998. godine, no da su njihovi bračni odnosi teško i trajno poremećeni, te da zajednički život više nije moguć.

Problemi popularnog pjevača nakon razvoda: Brankica traži mjesečno 15.000 kuna, ali je Mladen ispraznio račun, pa opet završio na sudu!

Devet mjeseci od službenog kraja turbulentnog braka, sudska trakavica zadarskog pjevača i kantautora Mladena Grdovića (61) i njegove dvanaest godina mlađe supruge Brankice i dalje traje.

Najnovijom presudom od 9.veljače Općinski sud u Zadru odbio je tužbu kojom Brankica Paleka traži da Grdović ispuni uvjete Ugovora o trajnom nalogu kojim je 28. kolovoza 2019. obavezao banku da na teret njegovog računa mjesečno supruzi za cijelog njezinog života uplaćuje iznos od 15 tisuća kuna u 120 rata počevši od 1. listopada 2019.

U postupku je utvrđeno kako je jedna isplata Brankici bila izvršena u rujnu 2019., nakon čega je Grdović namjerno onemogućio izvršenje svojih obveza iz sporazuma, na način da novčana sredstva koja mu budu isplaćena na račun, odmah podiže ili dalje transferira.

Brankica je na sudu tražila iznos od 45 tisuća kuna sa zateznim kamatama za listopad, studeni i prosinac 2019. godine, međutim Grdović se tome usprotivio, a sud je u konačnici donio odluku Grdoviću u korist jer na njegovim računima nema dovoljno sredstava, pa banka ne može izvršavati nalog i isplaćivati mjesečne iznose na koje se on obavezao sporazumom.

U obrazloženju se navodi kako trajni nalog prestaje vrijediti ako korisnik naloga nije osigurao sredstva na računu. K tome je pravomoćnim rješenjem Općinskog suda u Zadru, od 9. studenog 2020., utvrđeno i da je Brankica povukla tužbu koju je podnijela protiv Mladena Grdovića i banke radi otvaranja trajnog naloga.

- Evidentno je da je i tužiteljica odustala od zahtjeva za isplatu sredstava od tuženika putem trajnog naloga, kada je povukla tužbu podnesenu protiv tuženika i banke radi isplate na taj način. Parnične stranke su zasnovale obveznopravni odnos te su u smislu odredbe članka 9. ZOO dužne ispunjavati svoje obveze i odgovorne su za ispunjenje istih. Međutim, u konkretnom slučaju nije jasan sadržaj obveze tuženika, obzirom da nije definirano dospijeće tražbine, posebno u situaciji kada je ugovor o trajnom nalogu prestao zbog nedostatka sredstava, a tužiteljica odustala od zahtijevanja otvaranja istog prisilnim putem. Sadržaj obveze tuženika propisan odredbom članka 166. stavka 1. ZOO nije određen. Nadalje, rok ispunjenja obveze nije određen sporazumom stranaka niti je propisan Zakonom, sve u smislu odredbi članka 173. stavaka 1. i 2. ZOO. Stoga je ovaj sud stava da je činidba iz predmetnog sporazuma neodređena i neodrediva, pa da je sukladno odredbi članka 270. stavaka 1. ZOO, taj sporazum stranaka ništetan - navodi se u obrazloženju presude.

Iako je pjevač cijelo vrijeme opovrgavao loše odnose tvrdeći kako “ljubav sve pobjeđuje” Brankica je 21. svibnja prošle godine nakon 22 godine braka podnijela tužbu protiv pjevača radi razvoda braka, a sud je njezinu tužbu potvrdio u kolovozu zaključivši kako nema šanse da se par pomiri.

Brankica je u tužbi navela kako su ona i Mladen zaključili brak 4. svibnja 1998. godine, no da su njihovi bračni odnosi teško i trajno poremećeni, te da zajednički život više nije moguć.
