Jasenko Houra i Mladen Bodalec do okončanja sudskog spora više ne smiju nastupati pod imenom Prljavo kazalište. Tako je odlučio Trgovački sud u Zagrebu, potvrdila nam je Krstina Delfin Kanceljak, odvjetnica Tihomira Fileša, piše Jutarnji list.

- Kao što smo se već prethodno očitovali, smatramo da je pitanje korištenja žiga Prljavo kazalište pravno pitanje koje se na taj način mora i sagledavati i rješavati. U tom kontekstu ponovno naglašavamo da nije interes Tihomira Fileša bio, niti jest zabraniti Jasenku Houri izvođenje pjesama koje je skladao, no kontinuirano kršenje prava primoralo je Fileša da posegne za sudskom zaštitom - objašnjava Filešova odvjetnica i nastavlja:

- Trgovački sud u Zagrebu je stoga, na podneseni prijedlog T. Fileša, koji je sadržavao sve odgovarajuće dokaze koji se odnose na utvrđivanje vjerojatnosti da se zaštićeni žigovi povređuju, odnosno da i ubuduće prijete opasnosti od daljnjih povreda, usvojio zahtjev moje stranke, te je dana 1.srpnja 2022. donio rješenje o određivanju privremene mjere kojom se nalaže Houri i Bodalecu da prestanu s radnjama kojima povrjeđuju registrirane žigove, te da otkažu sve dogovorene aktivnosti kojima bi se vršila povreda, sve pod prijetnjom novčanih kazni za svaku buduću povredu - kaže Kristina Delfin Kanceljak i napominje kako ova privremena mjera stupa na snagu dostavom rješenja Jasenku Houri i Mladenu Bodalecu i traje do pravomoćnog okončanja spora koji njena stranka sada treba pokrenuti.

- Slijedom navedenog vidljivo je da je Tihomir Fileš na žalost bio primoran posegnuti za sudskom zaštitom (iako je isto odgađao), obzirom da s druge strane nije pokazan niti minimum želje za vansudskim, odnosno mirnim rješavanjem otvorenih pitanja. Naprotiv, svi medijski istupi Jasenka Houre, kao i koncertno djelovanje više nego jasno su ukazivali na to da isti namjerava i nadalje nastaviti kao i do sada, bez obzira na pravne fakte te postojeće pozitivne propise, svjesno ih kršeći, što je uočio i nadležni sud - kaže Delfin Kanceljak.

Što na privremenu mjeru kaže Fileš?

- Ne želim komentirati ovakav rasplet situacije nakon 45-godišnjeg zajedničkog rada, jer takve se situacije znaju desiti i supružnicima nakon 45 godina zajedničkog braka. Ne bih sve to komentirao i stoga što je cijeli taj slučaj na moju veliku, veliku žalost krenuo u smjeru svog sudskog epiloga, pa ne želim tijekom procesa i komentirati njegov tijek. Sada je najvažnija stvar na sudu dokazati tko govori istinu - kaže Fileš koji ističe kako je žig Prljavog kazališta još od 2008. godine prijavljen u njegovom vlasništvu, te dodaje da mu je drago da pravna država i sudstvo u ovoj državi, bez obzira što god tko o tome mislio, ipak funkcioniraju.

- I na kraju, opet i iznova, ne mogu dovoljno puta ponoviti da Houri nitko ne brani da sa svojim bendom izvodi svoje pjesme, jedino ne pod od nas stvorenim brendom Prljavo kazalište - naglašava Fileš.

Houra na sve nema komentara. Kako kaže, stvar je prepustio svojim odvjetnicima, a na upit pod kojim će imenom sada on, Bodalec i njegova ekipa nastati kratko kaže:

- Pod istim onim pod kojim smo i do sada nastupali - rekao nam je Houra, piše Jutarnji list.

Jasenko Houra i Mladen Bodalec do okončanja sudskog spora više ne smiju nastupati pod imenom Prljavo kazalište. Tako je odlučio Trgovački sud u Zagrebu, potvrdila nam je Krstina Delfin Kanceljak, odvjetnica Tihomira Fileša, piše Jutarnji list.

- Kao što smo se već prethodno očitovali, smatramo da je pitanje korištenja žiga Prljavo kazalište pravno pitanje koje se na taj način mora i sagledavati i rješavati. U tom kontekstu ponovno naglašavamo da nije interes Tihomira Fileša bio, niti jest zabraniti Jasenku Houri izvođenje pjesama koje je skladao, no kontinuirano kršenje prava primoralo je Fileša da posegne za sudskom zaštitom - objašnjava Filešova odvjetnica i nastavlja:

- Trgovački sud u Zagrebu je stoga, na podneseni prijedlog T. Fileša, koji je sadržavao sve odgovarajuće dokaze koji se odnose na utvrđivanje vjerojatnosti da se zaštićeni žigovi povređuju, odnosno da i ubuduće prijete opasnosti od daljnjih povreda, usvojio zahtjev moje stranke, te je dana 1.srpnja 2022. donio rješenje o određivanju privremene mjere kojom se nalaže Houri i Bodalecu da prestanu s radnjama kojima povrjeđuju registrirane žigove, te da otkažu sve dogovorene aktivnosti kojima bi se vršila povreda, sve pod prijetnjom novčanih kazni za svaku buduću povredu - kaže Kristina Delfin Kanceljak i napominje kako ova privremena mjera stupa na snagu dostavom rješenja Jasenku Houri i Mladenu Bodalecu i traje do pravomoćnog okončanja spora koji njena stranka sada treba pokrenuti.

- Slijedom navedenog vidljivo je da je Tihomir Fileš na žalost bio primoran posegnuti za sudskom zaštitom (iako je isto odgađao), obzirom da s druge strane nije pokazan niti minimum želje za vansudskim, odnosno mirnim rješavanjem otvorenih pitanja. Naprotiv, svi medijski istupi Jasenka Houre, kao i koncertno djelovanje više nego jasno su ukazivali na to da isti namjerava i nadalje nastaviti kao i do sada, bez obzira na pravne fakte te postojeće pozitivne propise, svjesno ih kršeći, što je uočio i nadležni sud - kaže Delfin Kanceljak.

Što na privremenu mjeru kaže Fileš?

- Ne želim komentirati ovakav rasplet situacije nakon 45-godišnjeg zajedničkog rada, jer takve se situacije znaju desiti i supružnicima nakon 45 godina zajedničkog braka. Ne bih sve to komentirao i stoga što je cijeli taj slučaj na moju veliku, veliku žalost krenuo u smjeru svog sudskog epiloga, pa ne želim tijekom procesa i komentirati njegov tijek. Sada je najvažnija stvar na sudu dokazati tko govori istinu - kaže Fileš koji ističe kako je žig Prljavog kazališta još od 2008. godine prijavljen u njegovom vlasništvu, te dodaje da mu je drago da pravna država i sudstvo u ovoj državi, bez obzira što god tko o tome mislio, ipak funkcioniraju.

- I na kraju, opet i iznova, ne mogu dovoljno puta ponoviti da Houri nitko ne brani da sa svojim bendom izvodi svoje pjesme, jedino ne pod od nas stvorenim brendom Prljavo kazalište - naglašava Fileš.

Houra na sve nema komentara. Kako kaže, stvar je prepustio svojim odvjetnicima, a na upit pod kojim će imenom sada on, Bodalec i njegova ekipa nastati kratko kaže:

- Pod istim onim pod kojim smo i do sada nastupali - rekao nam je Houra, piše Jutarnji list.
