Dijete se, kaže zakon, može osloboditi dužnosti uzdržavanja roditelja koji ga iz neopravdanih razloga nije uzdržavao u vrijeme kada je to bila njegova zakonska obveza.

Otac je tužio sina koji ga odbija uzdržavati i pobijedio. Općinski sud u Čakovcu donio je presudu prema kojoj je sin dužan doprinositi za uzdržavanje svog oca koji je smješten u Domu za odrasle osobe, i to s tisuću kuna mjesečno, piše Večernji list.

Otac je u tužbi naveo da mu je rješenjem Centra za socijalnu skrb priznato pravo na socijalnu uslugu privremenog smještaja u Domu za odrasle osobe, gdje je puna cijena smještaja 4500 kuna. Radno je nesposoban i korisnik invalidske mirovine od 1400 kuna. Ima troje punoljetne djece, od kojih je dvoje pristalo plaćati smještaj, no naknadno su oslobođeni sudjelovanja u troškovima zbog slabijeg imovinskog stanja.

Smještaj u Domu do pune cijene podmiruje Ministarstvo za demografiju, obitelj, mlade i socijalnu politiku. Tuženi sin je rekao da je najstariji od troje punoljetne djece i da otac pomoć može tražiti i od dvoje mlađe djece, a osim toga, dodao je, otac bi prodajom dijela oranice, kojoj je suvlasnik, mogao sam platiti dio troškova.

Sud je podsjetio da je sukladno čl. 292. st. 1. Obiteljskog zakona punoljetno dijete dužno uzdržavati roditelja koji nije sposoban za rad i nema dovoljno sredstava za život ili ih ne može ostvariti iz svoje imovine. Dijete se, kaže zakon, može osloboditi dužnosti uzdržavanja roditelja koji ga iz neopravdanih razloga nije uzdržavao u vrijeme kada je to bila njegova zakonska obveza.

Sud je utvrdio i da suvlasništvo oranice od 480 četvornih hvati nije dostatno za pokrivanje troškova, pa da sin koji je radno sposoban treba pomoći ocu, piše Večernji list.

Otac je tužio sina koji ga odbija uzdržavati i pobijedio. Općinski sud u Čakovcu donio je presudu prema kojoj je sin dužan doprinositi za uzdržavanje svog oca koji je smješten u Domu za odrasle osobe, i to s tisuću kuna mjesečno, piše Večernji list.

Otac je u tužbi naveo da mu je rješenjem Centra za socijalnu skrb priznato pravo na socijalnu uslugu privremenog smještaja u Domu za odrasle osobe, gdje je puna cijena smještaja 4500 kuna. Radno je nesposoban i korisnik invalidske mirovine od 1400 kuna. Ima troje punoljetne djece, od kojih je dvoje pristalo plaćati smještaj, no naknadno su oslobođeni sudjelovanja u troškovima zbog slabijeg imovinskog stanja.

Smještaj u Domu do pune cijene podmiruje Ministarstvo za demografiju, obitelj, mlade i socijalnu politiku. Tuženi sin je rekao da je najstariji od troje punoljetne djece i da otac pomoć može tražiti i od dvoje mlađe djece, a osim toga, dodao je, otac bi prodajom dijela oranice, kojoj je suvlasnik, mogao sam platiti dio troškova.

Sud je podsjetio da je sukladno čl. 292. st. 1. Obiteljskog zakona punoljetno dijete dužno uzdržavati roditelja koji nije sposoban za rad i nema dovoljno sredstava za život ili ih ne može ostvariti iz svoje imovine. Dijete se, kaže zakon, može osloboditi dužnosti uzdržavanja roditelja koji ga iz neopravdanih razloga nije uzdržavao u vrijeme kada je to bila njegova zakonska obveza.

Sud je utvrdio i da suvlasništvo oranice od 480 četvornih hvati nije dostatno za pokrivanje troškova, pa da sin koji je radno sposoban treba pomoći ocu, piše Večernji list.
