U Slobodnoj Dalmaciji pročitao sam vaš intervju vezan uz Pravilnik o brodicama, čamcima i jahtama, pa imam jedno pitanje koje se u tekstu ne spominje. Naime, prema novom Pravilniku, velika je stvar je li vam brodica namijenjena za višednevni boravak na moru, a da nitko nije definirao što taj pojam točno znači.

Konkretno, posjedujem malu jedrilicu koja nema WC ni kupaonicu, nema kuhinju, ima dvije spužve na koje možeš leći. E sad, u nekim lučkim kapetanijama to tumače da je dovoljno, neki da nije, a po meni to nije dovoljno za višednevni boravak na moru jer, po toj logici, ajmo ovako slobodno reći, gurneš glavu pod provu na pašari, staviš spužvu, otvoriš suncobran i možeš spavati. Stoga me zanima vaš komentar, s obzirom da svaki lučki kapetan tumači drukčije.

Intervju je zatražen nakon gostovanja u emisiji Otvoreno Hrvatske televizije, gdje je tema bila kako poboljšati sigurnost plovidbe. Tamo sam samo spomenuo kako bi možda trebalo krenuti već od samog novog Pravilnika, koji je nedorečen, nelogičan, u nekim stavkama nejasan, a u nekima čak i kontradiktoran.

Mnogi dijelovi Pravilnika, pa tako i ovaj koji navodite, premda zvuče kao da se navedeno samo po sebi podrazumijeva, niti su jasni, niti definirani.

Konkretno za ovaj slučaj, problem se nalazi u Dodatku 12 (PREGLED BRODICA I ČAMACA), pod točkom 4.2.3 Periodi obavljanja redovnih pregleda, u kojem je, među ostalim, navedeno: Redovni pregled brodica/čamaca, čija starost ne prelazi 20 godina, obavlja se: ... svakih pet godina za brodice/čamce za osobne potrebe duljine trupa veće od 7 metara ili snage porivnog uređaja većeg od 15 kW ukoliko: – su opremljene sanitarnim čvorom i/ili; – kuhinjom s ugrađenim plinskim trošilom i/ili; – predviđene za višednevni boravak na moru i/ili; – opremljene ugrađenim porivnim strojem i/ili; – imaju ugrađeni spremnik benzinskog goriva.

Dakle, osobne brodice dulje od 7 metara i one snage motora veće od 15 kW podliježu redovnom pregledu, ali tek ako imaju i navedenih ovih pet stavki, međutim, nije jasno je li svih pet ili samo neku od navedenih. Čini se logično svih pet, ali ovo i/ili unosi pomutnju.

Naime, ako je i, onda podrazumijeva svih pet stavki, a ako je ili, onda bilo koju od navedenih. Stoga se nemojte čuditi što i nadležna tijela to mogu tumačiti dvojako jer i oni rade po istom Pravilniku.

U pravu ste, pojam višednevni boravak na moru nigdje nije definiran niti ima ikakvih tumačenja ili pojašnjenja, a isto se može reći i za veliki dio ovog Pravilnika. Ipak, u jednom intervjuu, objavljenom neposredno nakon donošenja ovog Pravilnika, državni tajnik za more pojašnjava:

Potrebno je dodatno pojasniti kako se pod brodicama opremljenim za višednevni boravak na moru smatraju one brodice koje su opremljene kabinama za smještaj, odgovarajućim sanitarnim čvorom te kuhinjom, pa se stoga brodice koje su opremljene samo ležajevima ne smatraju brodicama za višednevni boravak na moru. Isto tako se pod ugrađenim strojem smatra stroj ugrađen u potpalublju.

Kasnijom izmjenom Pravilnika ovo sa strojem je definirano, kao i zatvorena kuhinja, ali ne i sva ostala tumačenja i pojašnjenja.

Dojam je kako se ovakav Pravilnik donio na brzinu, bez ikakvih konzultacija sa stručnim tijelima ili onima na koja se on i odnosi. S obzirom na to da je ovaj, sada nakon dvije i pol godine i ne više tako novi Pravilnik u mnogim stavkama nedorečen, nelogičan, nejasan i kontradiktoran, nemojte se čuditi da ga se može različito tumačiti, pa i kod nadležnih tijela. S obzirom na to da postoji velik broj zamjerki, možda je bolje raditi novi negoli za sve nejasne i nelogične stavke davati pojašnjenja.

U Slobodnoj Dalmaciji pročitao sam vaš intervju vezan uz Pravilnik o brodicama, čamcima i jahtama, pa imam jedno pitanje koje se u tekstu ne spominje. Naime, prema novom Pravilniku, velika je stvar je li vam brodica namijenjena za višednevni boravak na moru, a da nitko nije definirao što taj pojam točno znači.

Konkretno, posjedujem malu jedrilicu koja nema WC ni kupaonicu, nema kuhinju, ima dvije spužve na koje možeš leći. E sad, u nekim lučkim kapetanijama to tumače da je dovoljno, neki da nije, a po meni to nije dovoljno za višednevni boravak na moru jer, po toj logici, ajmo ovako slobodno reći, gurneš glavu pod provu na pašari, staviš spužvu, otvoriš suncobran i možeš spavati. Stoga me zanima vaš komentar, s obzirom da svaki lučki kapetan tumači drukčije.

Intervju je zatražen nakon gostovanja u emisiji Otvoreno Hrvatske televizije, gdje je tema bila kako poboljšati sigurnost plovidbe. Tamo sam samo spomenuo kako bi možda trebalo krenuti već od samog novog Pravilnika, koji je nedorečen, nelogičan, u nekim stavkama nejasan, a u nekima čak i kontradiktoran.

Mnogi dijelovi Pravilnika, pa tako i ovaj koji navodite, premda zvuče kao da se navedeno samo po sebi podrazumijeva, niti su jasni, niti definirani.

Konkretno za ovaj slučaj, problem se nalazi u Dodatku 12 (PREGLED BRODICA I ČAMACA), pod točkom 4.2.3 Periodi obavljanja redovnih pregleda, u kojem je, među ostalim, navedeno: Redovni pregled brodica/čamaca, čija starost ne prelazi 20 godina, obavlja se: ... svakih pet godina za brodice/čamce za osobne potrebe duljine trupa veće od 7 metara ili snage porivnog uređaja većeg od 15 kW ukoliko: – su opremljene sanitarnim čvorom i/ili; – kuhinjom s ugrađenim plinskim trošilom i/ili; – predviđene za višednevni boravak na moru i/ili; – opremljene ugrađenim porivnim strojem i/ili; – imaju ugrađeni spremnik benzinskog goriva.

Dakle, osobne brodice dulje od 7 metara i one snage motora veće od 15 kW podliježu redovnom pregledu, ali tek ako imaju i navedenih ovih pet stavki, međutim, nije jasno je li svih pet ili samo neku od navedenih. Čini se logično svih pet, ali ovo i/ili unosi pomutnju.

Naime, ako je i, onda podrazumijeva svih pet stavki, a ako je ili, onda bilo koju od navedenih. Stoga se nemojte čuditi što i nadležna tijela to mogu tumačiti dvojako jer i oni rade po istom Pravilniku.

U pravu ste, pojam višednevni boravak na moru nigdje nije definiran niti ima ikakvih tumačenja ili pojašnjenja, a isto se može reći i za veliki dio ovog Pravilnika. Ipak, u jednom intervjuu, objavljenom neposredno nakon donošenja ovog Pravilnika, državni tajnik za more pojašnjava:

Potrebno je dodatno pojasniti kako se pod brodicama opremljenim za višednevni boravak na moru smatraju one brodice koje su opremljene kabinama za smještaj, odgovarajućim sanitarnim čvorom te kuhinjom, pa se stoga brodice koje su opremljene samo ležajevima ne smatraju brodicama za višednevni boravak na moru. Isto tako se pod ugrađenim strojem smatra stroj ugrađen u potpalublju.

Kasnijom izmjenom Pravilnika ovo sa strojem je definirano, kao i zatvorena kuhinja, ali ne i sva ostala tumačenja i pojašnjenja.

Dojam je kako se ovakav Pravilnik donio na brzinu, bez ikakvih konzultacija sa stručnim tijelima ili onima na koja se on i odnosi. S obzirom na to da je ovaj, sada nakon dvije i pol godine i ne više tako novi Pravilnik u mnogim stavkama nedorečen, nelogičan, nejasan i kontradiktoran, nemojte se čuditi da ga se može različito tumačiti, pa i kod nadležnih tijela. S obzirom na to da postoji velik broj zamjerki, možda je bolje raditi novi negoli za sve nejasne i nelogične stavke davati pojašnjenja.
